CONTRACT 5412A Amendment CLOSED Agreement No. 5412A Agreement No. 5412 FIRSTAMENDMENT TO AGRE�MENT NO. 5412 BETWE�N THE CITY OF EL SEGUNDO AND SCS ENGINEERS THIS FIRST AMENDMENT ("Amendment") is made and entered into this 25t�' day of .iuly 2018, by and between the CITY OF EL SEGUNDO, a general Law city and municipal corporation existing under the laws of California ("CITY"), and SCS ENGINEFRS, a California corporation ("CONSULTANT"). The parties agree as follows: �. In addition to the amount set forth in Section 1 (C) of the Agreement No. 5412, the CITY agrees to pay CONSULTANT an additional sum for CONSULTANT'S services, at the rates specified in Exhibit "A". The CITY agrees to pay CONSULTANT for CONSULTANT's services a sum not to exceed fifteen thousand dollars ($15,000.00) over the course of the term of the Agreement in exchange for CONSULTANT's provision of additional services. CITY will pay this sum on the basis of the hourly rates and cost reimbursement rates as specified in the attached Exhibit"A", which is incorporated herein. 2, The Agreement is amended to extend the term to December 31st, 2018. The Agreement may be renewed upon mutual consent of the parties. 3, This Amendment may be executed in any number or counterparts, each of which will be an original, but all of which together constitutes one instrument executed on the same date. 4. Except as modified by this Amendment, all other terms and conditions of the Agreement, as amended, remain the same. The work will include assisting the Ciry with its CalRecycle campliance efforts, includingA6 1826 efforts and the Electronic Annual Report,and preparation of a Request for Proposals for residential solid wa;��:services and evaluation of the responses. SC4PE OF WORK The following scope of work has been prepared based on our ongoing work with the City,and the City's needs through September 30,2018. Task 1 Residential Servlces RFP For this task,SCS will assist the City with the RFP process, including the following: • Prepare Draft and Final RFP • Prepare for and attend pr�proposal conference Task 2 AB 1826 (Mandatory Organics Recycling) Compliance CalRecycle staff has requested from the City an update on the City's program development, implementation and any pertinent documents such as ordinance, rate sheet,revised hauler's contract etc. In addition,they would like a timeline when various activities have or will take place. This is to ensure the City has a program developed,and is implementing education,outreach,and monitoring and route pick-up in relations to AB1826. SCS has requested and received data from two of the primary halers,WM and Republic,and will use that data,as well as information received from CalRecycle and the City,to prepare the response. The information will be submitted to CalRecycle on Tuesday,July 24,2018 Task 3 Electronic Annual Report The City has requested SCS to prepare the Electronic Annual Report(EAR)that is due to CalRecycle on August 1. SCS will utilize the information gathered under Task 2,as well as information provided by the City to prepare a draft of the EAR for review by the City. We will incorporate any edits received from the City,and prepare the final EAR for submittal on August 1,2018. Agreement No. 5412A Ken Berkman July 19,2018 Page 2 PROJECT FEES The proposed fees to complete the above-described scope of work are included in Exhibit 1. The original project budget was $24,720. To date,we have invoiced the City$18,025, leaving a remaining budget of$6,695. We will use the remaining budget, plus an additional $9,995 to complete the above-described tasks. The fees include the labor and direct costs to undertake each task. We will conduct the work under the existing agreement between SCS and the City. Exhibit ].
