CC RESOLUTION 4982 RESOLUTION NO. 4982 A RESOLUTION RECITING THE FACT OF AND DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD APRIL 12, 2016. The City Council of the city of El Segundo does resolve as follows: SECTION 1: The City Council finds and declares as follows: A. A General Municipal Election was held in the City of El Segundo on Tuesday, April 12, 2016, as required by law; B. Notice of the election was given in the manner provided by law; C. Voting precincts were properly established, election officers were appointed, votes were cast, votes were received and canvassed and the returns made and declared in the time and manner required by the Elections Code for holding elections in general law cities; D, The City Clerk canvassed the returns of the election and certified the results to the City Council. These results are attached as Exhibit "A," and incorporated by reference. SECTION 2: The whole number of ballots cast in the precincts, except provisional ballots, was 1592. The number of provisional ballots cast in the City was 498. The number of vote by mail ballots cast in the City was 1535, making a total of 3625 ballots cast in the City. SECTION 3: The names of persons voted for at the election for Members of the City Council are as follows: Carol Pirsztuk Don Brann Drew Boyles Marie Fellhauer Dave Atkinson SECTION 4: The name of the person voted for at the election for City Clerk is as follows: Tracy Weaver SECTION 5: The name of the person voted for at the election for City Treasurer is as follows: Crista Binder RESOLUTION No. 4982 Page 2 of 3 SECTION 6: The number of votes given at each precinct and the number of votes given in the City to each of the persons named above for the respective offices for which the persons were candidates are as listed in attached Exhibit A. SECTION 7. The City Council declares and determines that Carol Pirsztuk, Don Brann and Drew Boyles were elected as Members of the City Council for full terms of four years. SECTION 8: The City Council declares and determines that Tracy Weaver was elected as City Clerk. SECTION 9,: The City Council declares and determines that Crista Binder was elected as City Treasurer. SECTION 10: That the measure voted upon at the election (Measure B) is as follows: .........................................................................r._ SHALL THE HOTEL TAX MEASURE WHICH INCREASES TRANSIENT Yes ❑ OCCUPANCY TAXES ON LODGING FROM 8% TO 12% (INDEFINITELY INCREASING ANNUAL GENERAL FUND REVENUES BY AN ESTIMATED No ❑ $3,200,000.00) FOR ALL CITY SERVICES BE ADOPTED? SECTION 11: That the number of votes given at each precinct and the number of votes given in the City for and against these measures are as listed in Exhibit A. The City Council declares and determines that as a result of the election, a majority of the voters voting on Measure B did vote in favor of it, and that Ordinance No. 1519, is duly passed and adopted by the Electorate of the City of El Segundo. SECTION 12: The Mayor and City Clerk are hereby authorized and directed to execute Ordinance No. 1519, "A PROPOSITION AMENDING EL SEGUNDO MUNICIPAL CODE § 3-4-3 TO INCREASE THE TRANSIENT OCCUPANCY TAX TO FUND GENERAL MUNICIPAL SERVICES INCLUDING, WITHOUT LIMITATION, POLICE PROTECTION AND CRIME SUPPRESSION SERVICES, FIRE PREVENTION AND SUPPRESSION SERVICES, AND PARK AND RECREATION FACILITIES AND SERVICES," and the City Clerk will certify to the passage of Ordinance No. 1519, by the People of the City of El Segundo, enter it into the book of ordinances and cause such ordinance to be codified in the El Segundo Municipal Code. SECTION 13: The City Clerk is directed to enter in the City's records a statement of the result of the election, showing: (1) the whole number of ballots cast in the City; (2) the names of the persons voted for; (3) the measures voted upon; (4) for what office each person was voted for; (5) the number of votes given at each precinct to each person RESOLUTION No. 4982 Page 3 of 3 and for and against the measure; and (6) the total number of votes given in the City to each person and for and against each measure. SECTION 14: The City Clerk will immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; the City Clerk will also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and will have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected will then be inducted into the respective office to which they have been elected. SECTION 15: The City Clerk will certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
