CONTRACT 4929A AmendmentAgreement No. 4929A FIRST AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT NO. 4929 BETWEEN THE CITY OF EL SEGUNDO AND TINA GALL THIS FIRST AMENDMENT ( "Amendment ") is made and entered into this 1 st day of October, 2016, by and between the CITY OF EL SEGUNDO, a general law city and municipal corporation existing under the laws of California ( "CITY "), and TINA GALL, an individual ( "CONSULTANT "). The parties agree as follows: I . On or about October 1, 2015, the parties entered into an Agreement for Professional Consultant Services ( "Agreement "). The CONSULTANT agreed to provide professional Community Development Block Grant (CDBG) consulting services for program administration. In exchange, the CITY agreed to pay CONSULTANT an hourly rate of $70 per hour, not to exceed a total contract amount of $14,000. The Agreement expires September 30, 2016. 2. Pursuant to Section 31 of the Agreement, the parties agree to extend the term of the Agreement an additional year, to expire September 30, 2017. CONSULTANT agrees to provide the same services to CITY as reflected in the attached Exhibit "A," which is incorporated herein by this reference. 3. This Amendment may be executed in any number of counterparts, each of which will be an original, but all of which together constitutes one instrument executed on the same date. 4. Except as modified by this Amendment, all other terms and conditions of Agreement No. 4929 remain the same. Mar° D.uHensley,� City Attorney 2 Agreement No. 4929A EXHIBIT A SCOPE OF SERVICES COMMUNITY DEVELOPMENT BLOCK GRANT ADMINISTRATION Tina Gall will provide professional Community Development Block Grant (CDBG) consulting services for program administration, implementation and monitoring. The proposed CDBG services to be offered are as follows: • Provide technical assistance for the administration and implementation of the City of El Segundo's CDBG projects and activities; • Prepare contracts and amendments, as necessary, with the Los Angeles County Community Development Commission (CDC) including project descriptions and budgets; • Prepare and publish public hearing notices for citizen comment on all proposed CDBG projects and allocation of funds; • Coordinate and provide technical support and audit preparation for all programmatic monitoring conducted by the Community Development Commission, and draft responses to any monitoring findings or concerns, including corrective action plans, if necessary. Assist, if necessary, with documentation for the Single Audit Act; • Conduct programmatic and financial monitoring of subrecipients funded with CDBG funds; • Prepare and complete Community Development Commission reports and documents including, but not limited to, the quarterly Comprehensive Performance Report, Contractor /Subcontractor Activity Report, and labor standards report; • Prepare staff reports for City Council review and approval of CDBG projects and budgets; and attend City Council meetings, as necessary; • Assist City staff in the preparation of Request for Proposals for professional services funded under the CDBG Program, to ensure compliance with all federal procurement standards and guidelines; • Provide CDBG financial management assistance, including preparation of all reimbursable funding requisitions. This will include monthly review of the City's revenue and expenditure reports and general ledger detail to ensure consistency with CDBG annual project budgets, and maintenance of all financial documentation of CDBG expenditures including invoices, warrants, timesheets, etc; 1 Agreement No. 4929A • Represent the City and act as liaison to the Community Development Commission; • Ensure compliance with all applicable federal, state and local laws and policies including maintaining current files of CDBG regulations and handbooks, circulating relevant CDBG information and policy changes with all CDBG- funded subrecipients, and attendance at all CDC - mandated CDBG training workshops and/or meetings; • Provide on -site services at El Segundo City Hall, Department of Planning and Building Safety, at least one day per week; • Attend, when necessary, El Segundo City Council meetings, or other related meetings upon request. 2 Agreement No. 4929A EXHIBIT B SCOPE OF SERVICES COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM LABOR COMPLIANCE CONSULTANT will provide the following services to meet the requirements of the Community Development Block Grant (CDBG) Program, Federal Labor Standards Compliance: Pre - Construction Activities • Assist in the preparation of bid documents for conformance with funding agency requirements, including insertion of federal forms, latest General Wage Decisions, and approval of bid documents by the Los Angeles County Community Development Commission's Labor Compliance Officer. • Coordinate with the Los Angeles County Community Development Commission's (CDC) Labor Compliance Officer for presentation of federal labor standards at pre - bid meeting. « Ensure compliance with 10 -day call and follow -up call for wage decision changes and coordinate changes as necessary. • Verify contractors and all subcontractors licensing status prior to contract award recommendation. • Attend the pre- construction conference, distribute federal labor and wage recordkeeping forms and requirements to contractors, and prepare meeting minutes for federal compliance. Davis -Bacon Compliance Activities • Monitor compliance with labor, subcontracting, and apprenticeship laws. • Verify posting of required labor information. • Conduct employee wage interviews at the job sites, as required. • Check weekly payroll forms and related documentation submitted by contractors and subcontractors for compliance with Davis -Bacon regulations, and collect all payroll certification forms. • Verify wage compliance via payrolls filed by contractor and subcontractors. Agreement No. 4929A PAGE 2 Check and verify apprentice classifications and use, and equivalent service classifications and actual activity. 0 Maintain a general information project file with relevant bids, bid opening minutes, notice to proceed, contract award, and contracts. Individual files will be prepared and maintained for each contractor and subcontractor for compiling all of the necessary labor compliance documentation, interviews and wage rate processing calculation sheets. 0 Prepare and pursue wage discrepancies, if necessary. Receive and document all complaints and actions taken. Contractor files with labor standards enforcement documentation will be maintained including all related complaints, and supplemental wage payments. Maintain regular communications between CDC, City and contractors regarding compliance with applicable regulations, including all delinquent items, using "Certified Mail" letters, and coordinate with City staff for withholding payments, if necessary. o Prepare and complete CDC and HUD labor reports. Coordinate file and labor compliance review meetings with the CDC's Labor Compliance Officer and HUD. If necessary, consult with CDC and HUD to resolve any wage discrepancies and /or wage violations committed by the Contractor or subcontractors.
