BACKGROUND AND DISCUSSION:
Construction on the Richmond Street Rehabilitation Project commenced on Monday, April 25,
2016. Within hours of that start date, the City was notified by its prime contractor, Sully Miller,
of a dispute between itself and the electrical subcontractor listed in the original bid package.
Although the prime contractor was able to proceed with the tree removal and saw cutting
activities last week, the City ordered the contractor to forego demolition of the sidewalks until
the dispute could be resolved, citing concerns about the negative impact to businesses should the
sidewalks not be replaced expeditiously due to delays in resolving the underground electrical
work. As of last Thursday, no additional work has occurred on the project, and none will
commence until this issue is resolved.
Over the past week, the prime contractor has been actively working with the subcontractor on a
resolution and has given them a deadline of this Thursday to resolve this issue. Should their
dispute not be resolved, the Public Contract Code (PCC) § 4107 outlines procedures by which a
subcontractor may be replaced. Staff has identified two possible scenarios which would allow
work to resume next Monday, May 9h without incurring any additional delays due to electrical
conduit work:
1. If the dispute is not resolved, conduit would be eliminated from the project for one -half
of the west side of the 100 block of Richmond Street (approximately 325 linear feet); it is
also worth noting that the PCC procedure would require additional City Council
direction; or
2. If the dispute is resolved, the project resumes as designed with no elimination of conduit.
If the dispute is not resolved, and should City Council wish for all of the conduit to remain in the
project, the construction delay will continue until the procedures outlined in the PCC have been
executed.
Overall, the most significant impact is the potential loss of conduit for approximately 325 feet on
the west side of Richmond Street (1 /z of the block on one side of the street). The other conduit
segments will not be affected because the subcontractor issue will be fully resolved before
construction staging reaches the next segment requiring electrical conduit. Therefore, staff
recommends that City Council approve removal of up to 325 linear feet from the project to
minimize any further delays related to this issue.
