CONTRACT 4350A CLOSEDFIRST AMENDMENT TO "t a AGREEMENT NO. 4350 BETWEEN THE CITY OF EL SEGUNDO AND WILLDAN ENGINEERING THIS FIRST AMENDMENT ( "Amendment ") is made and entered into this 1 st day of July 2013, by and between CITY OF EL SEGUNDO, a general law city and municipal corporation existing under the laws of California ( "City "), and WILLDAN ENGINEERING, a California Corporation ( "Consultant "). L Pursuant to Section 35 of Agreement No. 4350, Section 1(C) is amended to read as follows: "As additional consideration, CITY agrees to pay CONSULTANT a sum not to exceed Seventy Five Thousand Dollars ($75,000) for a total contract amount not to exceed One Hundred Forty Five Thousand Dollars ($145,000) for CONSULTANT'S services." 1 Pursuant to Section 35 of Agreement No 4 50, Section 8 is amended to read as follows: "8. TERM. The term of this Agreement is from October 1, 2012 to October 31, 2013. Unless otherwise determined by written amendment between the parties, this Agreement will terminate in the following instances: A. Completion of the work specified in Exhibit "A "; B. Termination as stated in Section 16." 1 This Amendment may be executed in any number of counterparts, each of which will be an original, but all of which together constitutes one instrument executed on the same date. k ° 4. Except as modified by this Amendment, all other terms and conditions of Agreement No. 4350 remain the same. The maximum compensation shall not exceed $145,000 as approved by the City Council for FY 12/13. The hourly rates to be charged for the classifications of planners that may be involved in providing the services shall be as follows: Senior Planner $95.00 an hour
