APPROVED BY: Greg Carpenter, City Manager BACKGROUND & DISCUSSION: On November 20th, 2012 the City Clerk's office opened bids for Project RSI 12 -11 (Group 47 of the City's Residential Sound Insulation (RSI) Program). Four bids were submitted, and the results are as follows: Karabuild Development, Inc. $ 852,397.00 Big West Construction Corporation $ 930,000.00 AZ Home $1,048,100.00 Harry H. Joh Construction $1,099,000.00 With the exception of some minor irregularities, the bid submitted by Karabuild Development, Inc. ( "Karabuild ") appears responsive. Staff met with the representatives for Karabuild and asked them to formally address the City's findings, and it has. In an abundance of caution, staff recommends that the following items be identified as minor irregularities and waived by the City Council: 1. Sufficient evidence of signature authority was required; 2. Evidence of Responsibility was not provided for the mechanical subcontractor was missing; 3. The Submittal of a Sample Warranty Package indicates that, although a warranty is intended to be provided, it would not be provided by the various subcontractors, not the General Contractor; 4. Submittals for secondary storm doors did not include some technical information. City staff was notified by the owner of Home 47.14 (53 5 East Walnut Avenue, Unit A) that unexpected repairs are necessary and extensive. After discussing the issue with the property owner, City staff has concluded that the timing of the repairs and the schedule for the Group 47 project would be impractical for the Residential Sound Insulation Program work at the home to be performed as part of the Group 47 project. As such, staff is recommending that the home be removed from the project and the bid price for the work ($38,750) be deducted from the contract price prior to award of the project. Additionally, City staff received a protest to Karabuild's bid based on three findings by another of the bidders. After careful review, staff recommends that those three items, listed below, also be identified as minor irregularities and waived by the City Council: 5. Owner Upgrades were not priced individually — although not priced individually, the upgrades were actually priced. Karabuild has since provided individual pricing that equals the lump sum subtotals listed on the Bidder's Proposal and Statement. The bid error does not give Karabuild a competitive advantage in the bidding since the lump price included owner upgrades and such amounts were unchanged after clarification with Karabuild; 6. Bid Bond is stated as a percentage not in dollars — although it does not state a dollar amount, the amount can be ascertained and conforms with the bid instructions which simply state that the bid amount must be 10% of the total contract price; 7. Neither a manufacturer, nor a supplier, was listed for the storm door specified for Home 47.17 — A submittal was provided as part of the product submittals, and a price for the product was included in the Schedule of Values submitted by Karabuild. This oversight was correct and is minor — it does not change the price and does not give Karabuild a competitive advantage. Staff spent some time in its due diligence to resolve issues with Karabuild. These efforts delayed bringing this matter to the City Council (the published Preliminary Construction Schedule indicated an anticipated City Council of January 15, 2013). Karabuild has, in addition to the necessary corrections identified above, agreed to expedite the signing of the contract and securing required bonds and insurance and submit those items by the close of business on February 6ffi, to allow for Karabuild to "catch up" to the original dates of the Preliminary Construction Schedule and avoid further delays. The amount requested for the contract is $895,012 which represents the amount of Karabuild Development, Inc.'s bid of $852,397, less $38,750 for the work bid at Home 47.14 (535 East Walnut Avenue), and an additional 10% contingency amount. Construction is scheduled to start May 6di, 2013. City Council is reminded that eighty percent (80 %) of the costs associated with the Residential Sound Insulation Program are covered by the federal grant funding from the Federal Aviation Administration (FAA). This remains a funding source until those funds identified in the Grant Implementation Plan to the City of Los Angeles are exhausted. Remaining expenses, except for elective "Owner Upgrades" selected by property owners, are paid for by funding received as part of the settlement agreement with Los Angeles World Airports (LAWA). Three bids were submitted, and the results are as follows: Karabuild Development, Inc. $ 944,781.00 Big West Construction Corporation $1,120,000.00 AZ Home $1,129,200.00 With the exception of some minor irregularities, the bid submitted by Karabuild Development, Inc. ( "Karabuild ") appears responsive. Staff met with the representatives for Karabuild and asked them to formally address the City's findings, and it has. 12 In an abundance of caution, staff recommends that the following items be identified as minor irregularities and waived by the City Council: 1. Sufficient evidence of signature authority was required; 2. Evidence of Responsibility was not provided for the mechanical subcontractor was missing; 3. The Submittal of a Sample Warranty Package indicates that, although a warranty is intended to be provided, it would be provided by the various subcontractors, not the General Contractor; 4. Submittals for secondary storm doors did not include some technical information. Staff spent some time in its due diligence to resolve issues with Karabuild. These efforts delayed bringing this matter to the City Council (the published Preliminary Construction Schedule indicated an anticipated City Council of January 15, 2013.) Karabuild has, in addition to the necessary corrections identified above, agreed to expedite the signing of the contract and securing required bonds and insurance and submit those items by the close of business on February 6h, to allow for Karabuild to "catch up" to the original dates of the Preliminary Construction Schedule and avoid further delays. The amount requested for the contract is $1,039,259 which represents the amount of Karabuild Development, Inc.'s bid of $944,781 and an additional 10% for contingencies.
