BACKGROUND AND DISCUSSION:
Approximately every five years, the City of El Segundo reviews its water and sewer rates to
determine what rates should be set for the next five years such that the full cost of operating a
Water Enterprise and Sewer Enterprise is fully self - supported. The last time water raters were
increased was in 2009, and the last time sewer rates were increased was in 2006. In anticipation
of the need to raise rates for the next five year period, staff initiated two rate studies in the spring
of 2014. Those studies were presented to City Council on September 16th, along with various
tiered options for setting new water rates and sewer rates for FY 2014/15 through FY 2018/19.
On September 16, 2014 the City Council approved the studies, selected a preferred water rate tier

structure and adopted Resolution No. 4888 setting forth the procedures required by Proposition
218 to implement the new water and sewer rate increases for residential and non - residential
water and wastewater services. It is worth noting that rates can only be raised for a maximum
period of five (5) years before rate increases must again be approved through the Proposition 218
protest ballot process.
Proposed Rate Increases
The proposed Ordinance (attached) provided for increases to the City's water and sewer rates to
be implemented over the next five years, from FY 2014/15 through FY 2018/19. The new rates
proposed in the 2014 Water Rate Study and Sewer Rate Study (available at
httn://www.elsegundo.oraJnews/diMIMews.aM?NewslD= 1 511 &.Tar etlD =t ) are designed to
fully cover the associated costs incurred by the Water Enterprise Fund and Sewer Enterprise
Fund for the next five years. Soon the Enterprise revenues will not be able to cover the rising
cost of imported water and also provide funding for operations, treatment of wastewater,
emergencies and planned capital projects, thus making passage of new rates necessary to
continue operations as self - sufficient Enterprises.
Protest Ballots, Public Hearing and Resolution Certifying Ballot Results
On September 16, 2014, City Council directed staff to administer the Proposition 218 majority
protest process and set a public hearing for January 20, 2015 for consideration of the proposed
water and sewer rate increases. On December 5, 2015, protest ballots were mailed out to the
recorded owners of each parcel and the water users in the City (ballot sample is attached),
allowing the minimum 45 days notification prior to the Proposition 218 hearing. In all 6395
ballots were mailed for 5290 total parcels. To successfully protest the water and sewer rate
increases, a simple majority of property owners and/or water users (2646 or more) must return
their ballots as instructed. Property owners and/or water users can turn in (by mail or hand
delivery) protest ballots at anytime prior to the close of the public hearing; however, only one
ballot will be counted for each parcel. At the public hearing, the City Council will be presented
with a resolution for purposes of verifying the result of the protest process and an Ordinance
reflecting the proposed water and sewer increases should there be less than a majority protest.
Ordinance Setting New Water and Sewer Rates
The ordinance recommended for introduction (attached) reflects the proposed water and sewer
rate increases set forth in the notice mailed with the protest ballots, but also allows for a pass
through of wholesale water cost increases to the City. The ordinance cannot be introduced and
adopted if a majority of the property owners file written protests. If introduced by City Council,
the second reading and adoption of the ordinance would be scheduled for the February 3, 2015
City Council meeting. Rate increases, if enacted, would take effect no earlier than March 3,
2015. Please note that passage of the Ordinance requires approval by a minimum of four (4)
Council Members in order to meet the (2/3) legislative requirement.
The Proposition 218 Process Recap
In November 1995, the California electorate approved Proposition 218 that requires certain
procedures be followed with regard to "property- related" fee increases imposed by governmental
agencies. Initially, case law indicated that these procedures would not be applicable to water rate
increases. However, a 2006 California Supreme Court decision held Proposition 218 fee
increase procedures must be followed for any proposed increases to the City's water rates. In
short, water and sewer rate increases are subject to a "majority protest" process that provides that

if a majority of the parcels in the City protest the proposed rate increases, then the City cannot
impose the increase.
Just as there was initially some disagreement between lawyers and court decisions regarding
which fees were subject to Proposition 218, there is currently a disagreement with respect to the
protest ballot process. Specifically, there is a disagreement amongst attorneys that represent
public agencies (and potentially between the language approved by the voters and some recent
legislation) as to whether tenants that pay for fees covered by Proposition 218 must be afforded
the opportunity to protest proposed fee increases. Last year the state legislature attempted to
clarify this issue by passing legislation that on its face requires that tenants be afforded the
opportunity to protest such fee increases. The City Attorney's Office believes the legislation is
not consistent with Proposition 218 and believes it is potentially invalid since the language in
Proposition 218 stated that the notice regarding the protest process must be sent to the "record
owner" and the owner was the person that had the right to file the protest.
Despite the City Attorney's Office opinion on this matter, staff and the City Attorney agree that
the most conservative approach is to send the protest ballots to the property owners and to the
tenants if the tenant is the water customer. The City is only required to count one protest per
parcel. Accordingly, even if both the owner and tenant file a protest, only one protest shall be
counted for purposes of determining whether there is a "majority protest" as described below.
Proposition 218 requires that the City provide all properties receiving the service for which the
fee is charged (in this case, water treatment and distribution) with a minimum of 45 days written
notice prior to City Council holding a public hearing on a proposed rate increase. The property
owners and now tenants have the ability to "protest" the proposed rate increase until the close of
the public hearing. If a majority of the parcels file written protests with the City prior to the close
of the public hearing, Proposition 218 states that the City cannot implement the proposed
increase. If a majority of the parcels do not protest the proposed increase, the Council has the
authority to implement the proposed rate increase.
In accordance with Proposition 218 requirements, several steps have been taken to comply with
the law. Notice to Parcel Owners of a Proposed Rate Increase, a Notice of a Public Hearing set
for January 20, 2015 at 7:00 p.m., and a Schedule of Proposed Water Rate Adjustments were
sent to property owners and water users on December 5, 2014, along with a cover letter stating
the reason for the second mailing. The most current assessor's parcel roll from the Los Angeles
County Assessor's office was obtained and direct mailing to each parcel owner within the City
was conducted. Likewise, direct mailing was also conducted to each water customer utilizing the
water billing address that the City has on file.

RESOLUTION NO. 4888
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO ESTABLISHING PROCEDURES FOR INCREASING
WATER, WASTEWATER, AND SOLID WASTE FEES IN
ACCORDANCE WITH THE REQUIREMENTS OF PROPOSITION 218.
The City Council for the City of El Segundo does resolve as follows:
SECTION 1: The City Council finds and declares as follows:
A. On July 24, 2006, the California Supreme Court confirmed that charges
for water and wastewater services are subject to Proposition 218
procedures (Bighorn - Desert View Water Agency v. Verjil (2006) 39 Cal.4th
205);
B. The City Council anticipates that there will be future increases in water,
wastewater, and solid waste rates. Adopting the policies and procedures
set forth in this Resolution will help implement the requirements set forth
in Article XIIID of the California Constitution and help ensure that the
rights of those persons that are authorized to protest service charges are
preserved;
C. Elections Code § 4000(c)(9) provides that any protest ballot proceeding
required or authorized by California Constitution Articles XIIIC or XIIID
may be conducted wholly by mail. In the event a protest ballot process is
required, the City Council seeks to achieve higher awareness of those
affected by the proposed increase, provide an orderly protest process for
both those receiving the ballots and the City, ensure to the extent
practicable that there is some verification process regarding the protests
received, and to reduce the costs of the protest ballot process; and
D. Adopting this Resolution is in the public interest for the reasons set forth
above and as further stated within Article XIIID and the Proposition 218
and state legislation relating to the implementation of Proposition 218.
SECTION 2: The City Council adopts the procedures set forth in this Resolution for
conducting all proceedings required by California Constitution Article XIIID for utility
fee (as defined below) increases. Where no specific procedures are imposed by Article
XIIID or the Proposition 218 Omnibus Implementation Act (Government Code §§ 53750,
et seq.), the procedures set forth in this Resolution apply. This Resolution may be
referred to as the "Proposition 218 Protest Proceedings Resolution."
SECTION 3: Definitions. Unless the contrary is stated or clearly appears from the
context, the following definitions govern the construction of the words and phrases used
in this Resolution. Words and phrases not defined by this Resolution will have the

meaning set forth in California Constitution Article XIIID or the Proposition 218
Omnibus Implementation Act.
A. "Act' ' means. the Proposition 218 Omnibus Implementation Act found at
Government Code §§ 53750, et seq.;
B. "Article 13D" means California Constitution Article XIIID, § 6;
C. "Manager" means the City Manager or designee;
D. "Property owner" has the same meaning set forth in Article 13D and also
pursuant to the Act includes tenancies of real property where tenants are
directly liable to pay the proposed water or wastewater fee or charge;
E. "Protest' ' means a written protest filed with the City Clerk in accordance
with Article 13D, the Act, and this Resolution as described in Article 13D,
§ 6(a)(2);
F. "Utility fee" means a fee or charge imposed for potable water, wastewater,
or solid waste services provided to customers in accordance with the El
Segundo Municipal Code ( "ESMC "), and other applicable law, by the City
of El Segundo.
SECTION 4: Calculation of the fee and proposed increase. Utility fees must be
calculated in accordance with the recommendations in the latest independent Rate Study
report or City's internal financial analysis.
SECTION 5: Administration of Proceedings. The City Manager, or designee, is
authorized to implement this Resolution in a manner consistent with the California
Constitution and other applicable law.
SECTION 6• Totira Notice of -a proposed utility, fee increase lC nrnvlderl aC folloWs-
A. In general, the City will identify the record property owner(s) of each
parcel to which the utility fee would be applied from it's billing system
database and /or the latest equalized tax roll produced by Los Angeles
County. The City's Utility Billing database and the equalized tax roll is
presumptive evidence of ownership of the land for voting purposes.
B. If either the City's Utility Billing Database or Los Angeles County
Recorder's website shows that more than one property owner has an
interest in a parcel, all property owners (each property owner) must
receive notice at the address shown for the property owner. Both property
owners and parties financially responsible for paying the fee will be
provided notice. In the event that notice is sent for a utility service for
which the City is not currently charging a fee, the notices will be sent to

the property owner based upon the Los Angeles County Recorder's
website and to the street address to which the service would be provided if
the address is different than the address designated for the property owner
on the Los Angeles County Recorder's website.
C. The notice must be sent by first class mail at least forty -five (45) days
before the date set for the public hearing on the utility fee.
D. The form of the notice of hearing will be approved by the City Council
and be on file with the City Clerk.
E. The notice provided by these procedures, in accordance with Article 13D,
supersedes and is in lieu of notice required by any other statutes to levy or
increase a utility fee.
F. The City Clerk, or designee, may certify the proper mailing of notices by
an affidavit which constitutes conclusive proof of mailing in the absence
of fraud.
G. Failure of any person to receive notice does not invalidate the proceedings.
SECTION 7: Protests against Utility Fee Increases.
A. The property owner(s) of parcels subject to the proposed fee increase are
entitled to a single protest for each parcel. When a parcel is held as
community property or in j oint tenancy or as a tenancy in common, any
spouse or joint tenant or tenant in common is presumed to have authority
to cast a protest on behalf of such parcel.
B. Executors, administrators, and guardians may cast a protest on behalf of
the estate represented by them. If such representatives are shown on the
latest accPssmPnt roll ac Having taxes and assessments on behalf of the
property owner(s), that fact establishes the right of such representative(s)
to cast a protest. If such representatives are not shown on the latest
assessment roll, the representatives may file with the City Clerk, at any
time before the commencement of the public hearing, or the date of the
election, as the case may be, certified copies of the written documentation
establishing the legal representation.
C. The protest of any public or quasi - public corporation, private corporation,
or unincorporated association may be signed by any person so authorized
in writing by the board of directors or trustees or other managing body
thereof.
D. The Manager is designated as the voting representative with respect to
City -owned property.

E. In any case where the documentation provided to the City Clerk in is
ambiguous or unclear, the City Attorney will determine whether the
documentation is adequate for the purpose provided.
F. In the event a property owner loses or misplaces a protest ballot, upon
request by the property owner the City will provide a replacement protest
ballot unless a properly filled out protest ballot has already been received
for the parcel of property.
SECTION 8: Public Hearing.
A. Only protest ballots that (i) were provided by the City to the property
owner in the form approved by the Council and (ii) are properly filled out
and legibly signed by an eligible property owner is made will be counted
as a valid protest. Only one protest shall be counted for each parcel of
property regardless of the number of protests filed by property owners for
the parcel.
B. The City Clerk must stamp each written protest the date and time it is filed
with the City Clerk for purposes of establishing whether the protest was
filed before the close of the public testimony portion of the public hearing.
No protest received after the close of the public testimony portion of the
public hearing can be counted in determining the amount of protest, but
the Council may, in its discretion, consider such protests in making its
decision. Written protests may be withdrawn in writing at any time before
the conclusion of the public testimony portion of the public hearing.
C. At the time and place fixed for the hearing, or at any time to which the
hearing is adjourned, the Council_ must:
1 Hear atl narenne interaeteri in the matter of the prnpnced fPP
increase;
2. Hear all objections, protests or other written communications from
any owner of property subject to the proposed utility fee; and
3. Take and receive oral and documentary evidence pertaining to the
proposed fee increase.
4. The hearing may be continued from time to time, as the Council
determines necessary to complete its consideration of the proposed
fee increase.
If the Council determines, at the close of the public testimony
portion of the public hearing, that votes were received from

property owners representing a majority of the parcels subject to
the proposed fee increase, the Council shall adopt a resolution
setting forth the results of the protest ballot process and the
proceedings shall then be closed and the utility fee cannot be
approved by the City Council.
6. If the Council determines at the close of the public testimony
portion of the public hearing that written protests were not received
from property owners representing a majority of the parcels subject
to the proposed utility fee, the Council shall adopt a resolution
setting forth the results of the protest ballot process and then may
by Ordinance change the utility fee so long as in an amount that
does exceed the amount and methodology set forth in the public
notices sent to the property owners.
SECTION 9: Environmental Review. This Resolution is exempt from review under the
California Environmental Quality Act (California Public Resources Code § § 21000, et
seq., "CEQA ") and CEQA regulations (14 California Code of Regulations §§ 15000, et
seq.) because it establishes rules and procedures to implement government funding
mechanisms; does not involve any commitment to a specific project which could result in
a potentially significant physical impact on the environment; and constitutes an
organizational or administrative activity that will not result in direct or indirect physical
changes in the environment. Accordingly, this Resolution does not constitute a "project"
that requires environmental review (see specifically 14 CCR § 15378(b)(4 -5)).
SECTION 10: If any part of this Resolution or its application is deemed invalid by a
court of competent jurisdiction, the city council intends that such invalidity will not affect
the effectiveness of the remaining provisions or applications and, to this end, the
provisions of this Resolution are severable.
SECTION 11: The City Clerk is directed to certify the passage and adoption of this

FOR ADOPTING WATER CHARGES IN ACCORDANCE WITH
ARTICLE XIIIO OF THE CALIFORNIA CONSTITUTION.
The City Council of the city of EI Segundo does resolve as follows:
SECTION 1: The City Council finds and declares 'as follows:
A. On January 20, 2015, the City Council held a public hearing to consider the results of
protest proceedings conducted in accordance with California Constitution Article
XIIID, § 6(a)(2) and Resolution No. 4888; and
B. After receiving documentary and oral testimony, the City Council declared the public
hearing closed and considered whether written protests were received from property
owners representing a majority of properties subject to the water and wastewater
charges.
SECTION 2: The total number of protest ballots mailed or provided to property owners eligible
to file a protest ballot was 6395. The number of valid protest ballots received by the City at the
end of the January 20, 2015 public hearing was
SECTION 3: The number of valid protest ballots required to prevent adoption of the
proposed water and wastewater charges is 2646 or more. Because the number of valid protest
ballots received by the City [ does does not] represent a majority of property owners
eligible to protest, the City Council [ may may not] adopt the proposed water and
wastewater charges.
SECTION 4: The City Clerk will certify to the passage and adoption of this Resolution and enter
it into the book of original resolutions.
SECTION 5: This Resolution will become effective immediately upon adoption.

AN ORDINANCE SETTING THE AMOUNT OF WATER
AND SEWER RATES AND CHARGES PURSUANT TO
HEALTH AND SAFETY CODE §5471 AND EL SEGUNDO
MUNICIPAL CODE § 11 -1 -5.
The City Council of the City of El Segundo does ordain as follows:
SECTION 1: The City Council finds and declares as follows:
A. The City of El Segundo requires a reliable supply of water meeting current and
anticipated water quality standards to protect the public general welfare, health and
safety.
B. The purpose of water rates and charges is to protect the public health, safety and
general welfare by providing a reliable and adequate supply of water meeting current
and anticipated water quality standards for the residential properties and non-
residential properties of the City of El Segundo and to pay for the cost of providing
such service.
C. The purpose of the wastewater rates and charges (sewer charges) is to protect the
public health, safety and general welfare by providing a reliable and adequate system
for the discharge, transmission and treatment of wastewater from residential and non-
residential properties located within the City.
D. There is a reasonable relationship between the amount of the rates and charges and
the cost of services and facilities necessary to deliver water and wastewater service to
the residents and non - residential development of the City.
E. The City Council previously set water rates and established administrative procedures
for billing and collecting water rates. These actions are reflected, without limitation,
in Ordinance No. 1435 (adopted November 17, 2009).
F. The City Council previously set sewer rates and established administrative procedures
for billing and collecting sewer rates. These actions are reflected, without limitation,
in Ordinance No. 1404 (adopted January 16, 2007).
G. Notice regarding the water and sewer rates included in this ordinance was provided in
accordance with California Constitution Article XII11), § 6(c) and Government Code
§ 54354.5.
H. On January 20, 2015, the City Council held a public hearing to consider the results of
the protest proceeding and to consider whether to increase the water and sewer rates
as proposed.

I. This Ordinance is exempt from review under the California Environmental Quality
Act (Cal. Pub. Res. Code §§ 21000, et seq.; "CEQA ") and CEQA regulations (Cal.
Code Regs. tit. 14, §§ 15000, et seq.) because it establishes, modifies, structures,
restructures, and approves rates and charges for meeting operating expenses;
purchasing supplies, equipment, and materials; meeting financial requirements; and
obtaining funds for capital projects needed to maintain service within existing service
areas. This Ordinance, therefore, is categorically exempt from further CEQA review
under Cal. Code Regs. tit. 14, § 15273.
J. This ordinance is adopted in accordance with Health and Safety Code § 5471 and EI
Segundo Municipal Code ( "ESMC ") § 11 -1 -5 to establish the City's current water
rates and ESMC § 12 -7 -3 to establish the City's current wastewater rates.
K. The City Council has considered the evidence and testimony presented at the public
hearing. Based in part upon that evidence, and the staff reports presented to the
Council regarding this issue, the City Council believes that it is in the public interest
to adopt this Ordinance.
SECTION 2: AMOUNT OF RATES AND CHARGES. Pursuant to ESMC § 11 -1 -5, the
City Council establishes the amount of water rates as set forth in attached Exhibit "A," which
is incorporated by reference ( "Water Charges "). Pursuant § 12 -7 -3. The City Council
established the amount of sewer rates as set forth in attached Exhibit "B," which is
incorporated by reference ( "Wastewater Charges ")
SECTION 3: COST ESTIMATES. The City Manager, or designee, will periodically, but not
less than annually, review the Water and Wastewater Charges to determine whether revenues
from such charges are meeting actual cost of services and facilities needed to deliver water
service and provide waste collection services to the residents and non - residential
developments within the City. If the City Manager determines that revenues do not
adequately meet costs, the City Manager will recommend to the City Council a revised rate
and charge schedule to be adopted by this City Council by ordinance.
SECTION 4: This Ordinance was adopted to comply with the California Supreme Court
decision in Bighorn- Desert View Water Agency v. Verjil (2006) 39 Cal.4th 205. To the extent
any provision of this Ordinance repeals or supersedes Ordinance No. 1435 and Ordinance
No. 1404, such repeal or replacement will not affect any penalty, forfeiture, or liability
incurred before, or preclude prosecution and imposition of penalties for any violation
occurring before, this Ordinance's effective date. Any such repealed or superseded part of
Ordinance No. 1435 and/or Ordinance No. 1404 will remain in full force and effect for
sustaining action or prosecuting violations occurring before the effective date of this
Ordinance.
SECTION 5: If any part of this Ordinance or its application is deemed invalid by a court of
competent jurisdiction, the City Council intends that such invalidity will not affect the
effectiveness of the remaining provisions or applications and, to this end, the provisions of
this Ordinance are severable.

SECTION 6: The City Clerk is directed to certify the passage and adoption of this
Ordinance; cause it to be entered into the City of El Segundo's book of original ordinances;
make a note of the passage and adoption in the records of this meeting; and, within fifteen
(15) days after the passage and adoption of this Ordinance, cause it to be published or posted
in accordance with California law.
SECTION 7: This Ordinance will become effective on the thirty -first (31St) day following its
passage and adoption.

Dear City of El Segundo Property Owner/Water & Sewer Billing Customer:
TAKE NOTICE that on JANUARY 20, 2015, AT 7:00 P.M., the City Council will conduct a Public Hearing at the City
Council Chambers, 350 Main Street, El Segundo, California to consider proposed rate increases associated with
providing water services and wastewater (sewer) collection services to properties located in the City of El Segundo.
Increases are proposed to pay for increases in the City's costs to acquire water from other agencies, to provide
potable water services to properties located within the City, to provide for treatment and discharge of wastewater
generated by those properties, and to meet the regulatory obligations imposed by the State of California Department
of Public Health (DPH) and the U.S. Environmental Protection Agency (EPA).
Water Rate Study
A recently completed water rate study proposed a multi -year rate schedule to adjust monthly water rates to
cover the City's cost of providing these services. The FY 2014 -2015 increase is proposed to be implemented
on or after March 6, 2015. FY 2015 -2016, FY 2016 -2017, FY 2017 -2018, FY 2018 -2019, rate increases are
proposed for implementation on the first of July and January of each subsequent year due to when annual
rate increases are passed through from the Metropolitan Water District and West Basin Municipal Water
District. Complete copies of the water study, entitled "City of El Segundo Water Rate Study 2014 ", dated
September 2014, are available at City of El Segundo City Hall, 350 Main Street in the City Clerk's office and/
or the City's website, www.elsegundo.org.

The proposed new rates are provided on the enclosed "Schedule of Proposed Service Charge Increases for Potable
Water" and "Schedule of Proposed Service Charge Increases for Wastewater (Sewer) Collection." Review these to
determine how your specific property would be affected. Customers are encouraged to review water and sewer
use history found on prior utility bills. Charges are based upon a combination of meter size and actual usage. If you
have any questions on the proposed increase please call (310) 524 -2368 for assistance. Any adjustment shown, if
enacted, will take effect no earlier than March 2015.
IMPORTANT INFORMATION: If you oppose an increase to your monthly water service charges or sewer service
charges and wish to protest these actions, you must do so in writing before the close of the public hearing on
January 20, 2015. If you do not oppose the proposed increases, no response is necessary. A majority protest
exists if, at the end of the Public Hearing, there are valid written protests submitted by a majority of the properties
subject to the fee increases. A majority protest will result in the fee increase not being imposed. Note that no
more than one protest per property will be counted. If you need more information, please contact the City's Water

BACKGROUND AND DISCUSSION:
Each year, Community Development Block Grant (CDBG) funds are allocated to cities by the
Federal Housing and Urban Development Department (HUD) and administered through the Los
Angeles County Community Development Commission (CDC). Participating cities receive
funding based upon the total number of cities participating in the County's program, census
population counts, estimates of poverty, overcrowding and aged housing stock.
Since 1986, the City of El Segundo participated in the annual Los Angeles Urban County's

CDBG Program. In order to continue its participation in the upcoming 2015 -2016 Program
Year, which begins on July 1, 2015, and ends on June 30, 2016, the City of El Segundo must
prepare and submit its proposed CDBG action plan and/or project descriptions to the Los
Angeles County Community Development Commission (CDC) by February 2, 2015, for review
and approval.
Pursuant to Federal requirements, notice of this public hearing was posted in public buildings
within the City. Federal requirements also mandate that as part of the hearing, the Council and
public be informed of the range of eligible housing and community development activities that
may be funded under the CDBG program. Interested persons may obtain a copy of the Federal
eligibility guidelines, available at the City of El Segundo's Department of Planning and Building
Safety, during regular business hours.
Proposed CDBG Projects and Budgets
The proposed 2015 -2016 CDBG allocation for the City of El Segundo is $52,861; a decrease of
approximately two percent (2 %) from 2014 -2015 levels. The decrease is due to on -going federal
entitlement program funding reductions. This proposed CDBG allocation is a planning estimate
only; the Los Angeles County Community Development Commission (CDC) will release final
appropriations in spring 2015. The City's final CDBG allocation is generally within 10% of the
estimate provided.
Prior Year CDBG Action Plan (2014 -2015)
In 2014 -2015, the City's annual allocation of CDBG funds will support the removal of existing
concrete curbs with steep grades and replacement with American with Disabilities Act (ADA)
compliant wheelchair accessible concrete ramps. Removal of architectural barriers to improve
mobility and accessibility of senior adults and severely handicapped persons is an example of an
eligible project under the CDBG Program.
The CDBG- funded ADA Sidewalk Ramp Improvement project is part of the City's continuing
effort to comply with the Americans with Disability Act (ADA) requirements that eliminate
architectural barriers that impede access to public facilities. Since 2006, more than 300
accessible sidewalk ramps have been installed throughout the City.
Recommended 2015 -2016 CDBG Action Plan
Staff recommends that the 2015 -2016 CDBG Program Year allocation totaling approximately
$52,861 plus unspent prior year CDBG funds in the amount of $11,401, for a total of $64,262 be
used to continue the implementation of ADA accessible sidewalk ramps at various intersections
throughout the City.

conditions from a grant award by Chevron U.S.A., Inc. in the amount of $175,000
to assist in Economic and Business Development within the City of El Segundo
over the next two fiscal years.
(Fiscal Impact: $175,000 Revenue for the Chevron USA, Inc. Grant Account
for FY 2014 -2015 and 2015 -16)
Council accepted the Grant Agreement with Chevron U.S.A., Inc. and appropriate grant
funding for FY 2014 -15 and 2015 -16 in the Economic Development Grant Fund
Account. This item was ratified Dec. 22, 2014.

the parking situation on Richmond Street.

each parking stall to minimum of 8'6 ", or more where feasible; relocate curb stops closer
to curb on the 200 block and no changes to parking stalls on the 100 of Richmond
Street. Loading Zones and ADA requirements will be eliminated on the 200 block and
will be relocated to the s/w corner of Franklin on the 100 block of Richmond Street.

A. SPECIAL ORDER OF BUSINESS (OPEN SESSION):
Consideration and possible action regarding acceptance of the terms and conditions from a
grant award by Chevron U.S.A., Inc. in the amount of $175,000 to assist in Economic and
Business Development within the City of El Segundo over the next two fiscal years.
(Fiscal Impact: $175,000 Revenue for the Chevron USA, Inc. Grant Account for FY
2014 -2015 and 2015 -16)
MOTION by Mayor Pro Tem, SECONDED by Council Member Fellhauer to authorize the City
Manager to execute the Grant Agreement with Chevron U.S.A., Inc. and appropriate grant funding
for FY 2014 -15 and 2015 -16 in the Economic Development Grant Fund Account. MOTION
PASSED BY UNANIMOUS VOICE VOTE. 4/0 Council Member Dugan removed himself from the
vote due to the fact that his is retired from Chevron, USA Inc.

BACKGROUND AND DISCUSSION:
The City of El Segundo has adjudicated ground water rights to pump 953 acre -ft of ground water
each year from the West Coast Basin aquifer, although it has no ability exercise those annual
pumping rights within the City's jurisdiction due to poor groundwater quality. However, El
Segundo can and does lease its water rights to other jurisdictions that have the ability to pump,
typically by auctioning off its allocation to the highest bidder on an annual basis. If El Segundo
does not lease its water rights, it results in a lost revenue opportunity to the water fund.
In November, staff released a bid package to all eligible pumpers in the West Coast Basin to
auction the City's water rights for two water years (July 1 — June 30 in 2014/15 and 2015/16).
On November 25, 2014 the City Clerk's office received only one bid, from Golden State Water
Company, for $70 per acre -ft for each water year (or $66,710 annually). This is the same rate
that was bid by Golden State Water Company during the previous biennial cycle and is reflective
of market conditions.
Staff recommends that City Council 1) award a contract for El Segundo's annual 953 ac -ft of
groundwater pumping rights to Golden State Water Company for water years 2014 -15 and 2015-

16 and 2) authorize the City Manager to execute the agreement in a form approved by the City
Attorney. The $133,420 received will be deposited into the Water Enterprise Fund for current
and future operations and maintenance.

LICENSE AGREEMENT BETWEEN THE
CITY OF EL SEGUNDO AND
GOLDEN STATE WATER COMPANY
THIS LICENSE is made and executed this 20th day of January, 2015, between the CITY
OF EL SEGUNDO, a municipal corporation ( "CITY "), and Golden State Water Company, a
corporation ( "LICENSEE ").
1. RECITALS. The Parties agree that this Agreement is entered into with reference to the
following facts and objectives:
A. In accordance with the judgment entered on August 19, 1961 in the case
captioned California Water Service Company v. City of Compton, LASC Case
No. 506806 ( "Judgment "), CITY may license its Adjudicated Rights in the West
Coast Basin;
B. LICENSEE requested 953 acre feet of water annually from CITY; and
C. CITY believes it is in the public interest to license 953 acre fee of water
( "Property ") to LICENSEE.
2. LICENSE; DESCRIPTION OF PROPERTY. CITY licenses to LICENSEE the right to
extract the Property during the term of this Agreement and exercise CITY's rights under the
terms and conditions of the Judgment. LICENSEE does not acquire any right to extract water
independent of CITY's rights. CITY's action is not, and should not be construed to be, a
conveyance of a property interest or a lease; it is a license to use property only.
3. USE OF PROPERTY.
A. LICENSEE must pay assessments levied on the pumping of the Property by the
Water Replenishment District of Southern California ( "District ").
B. LICENSEE must notify the District and the Watermaster that pumping the
Property was done pursuant to this Agreement and provide the Watermaster with
a copy of the document.
C. LICENSEE must note, in any recording of water production for the term of this
Agreement, that pumping was done pursuant to this Agreement.
D. LICENSEE'S privilege to extract the Property may be increased by the amount
licensed when computing carryover or allowable over extraction as provided by
Paragraph V in the Judgment.
E. LICENSEE acquires the privilege of pumping rights only and is responsible for

providing the means and location to effect said pumping itself and bears all
pumping costs.
4. TERM. Except as provided in Section 6, the term of this Agreement will commence on
January 20, 2015 and end on June 30, 2016
5. WARRANTY. CITY warrants that it has 953acre -feet of Adjudicated Right and it has not
pumped and will not pump or permit or license any other person to pump any part of said 953
acre -feet annually during periods of January 20, 2015 through June 30, 2015 and July 1, 2015
through June 30, 2016
6. TERMINATION. By executing this document, LICENSEE waives any and all claims for
damages that might otherwise arise from CITY's termination under this Section.
7. COMPENSATION. In exchange for the use of the Property, LICENSEE agrees to pay
CITY a sum of $133,420 dollar ($one hundred and thirty -three thousand, four hundred and
twenty dollars) for the term of this Agreement.
8. CONDEMNATION. If all or part of Property is acquired by eminent domain or purchase in
lieu thereof, LICENSEE acknowledges that it will have no claim to any compensation awarded
for the taking of Property or any portion thereof or for loss of or damage to LICENSEE's
improvements.
9. ASSIGNMENT. LICENSEE is not permitted to assign this Agreement or any interest
therein.
10. INDEMNIFICATION.
A. LICENSEE holds CITY harmless and free from any and all liability arising out of
this Agreement, or its performance. Should CITY be named in any suit, or should
any claim be against it, by suit or otherwise, whether the same be groundless or
not, arising out of this Agreement, or its performance, pursuant to this Agreement,
LICENSEE will defend CITY (at CITY's request and with counsel satisfactory to
CITY) and will indemnify it for any judgment rendered against it or any sums
paid out in settlement or otherwise.
B. For purposes of this section "CITY" includes CITY's officers, officials,
employees, agents, representatives, and certified volunteers.
C. LICENSEE expressly agrees that this release, waiver, and indemnity agreement is
intended to be as broad and inclusive as is permitted by the law of the State of
California and that if any portion is held invalid, it is agreed that the balance will,
notwithstanding, continue in full legal force and effect.
D. It is expressly understood and agreed that the foregoing provisions will survive

termination of this Agreement.
11. COMPLIANCE WITH LAW. LICENSEE will, at its sole cost and expense, comply with
all of the requirements of all federal, state, and local authorities now in force, or which may
hereafter be in force, pertaining to the Property and will faithfully observe in the use of Property
all applicable laws. The judgment of any court of competent jurisdiction, or the admission of
LICENSEE in any action or proceeding against LICENSEE, whether CITY be a party thereto or
not, that LICENSEE has violated any such ordinance or statute in the use of Property will be
conclusive of that fact as between CITY and LICENSEE.
12. NOTICES. Except as otherwise expressly provided by law, all notices or other
communications required or permitted by this Agreement or by law to be served on or given to
either party to this Agreement by the other party will be in writing and will be deemed served
when personally delivered to the party to whom they are directed, or in lieu of the personal
service, upon deposit in the United States Mail, certified or registered mail, return receipt
requested, postage prepaid, addressed to LICENSEE at:

Either party may change its address for the purpose of this Section by giving written
notice of the change to the other party.
13. ACCEPTANCE OF FACSIMILE SIGNATURES. The Parties agree that agreements
ancillary to this Agreement and related documents to be entered into in connection with this
Agreement will be considered signed when the signature of a party is delivered by facsimile
transmission. Such facsimile signature will be treated in all respects as having the same effect as
an original signature.
14. GOVERNING LAW. This Agreement has been made in and will be construed in
accordance with the laws of the State of California and exclusive venue for any action involving
this Agreement will be in Los Angeles County.
15. ENTIRE AGREEMENT. This instrument and its Attachments constitute the sole
agreement between CITY and LICENSEE respecting Property, the use of Property by
LICENSEE, and the specified Agreement term, and correctly sets forth the obligations of CITY
and LICENSEE. Any agreement or representations respecting Property or its licensing by CITY
to LICENSEE not expressly set forth in this instrument are void.

16. CONSTRUCTION. The language of each part of this Agreement will be construed simply
and according to its fair meaning, and this Agreement will never be construed either for or
against either party.
17. AUTHORITY /MODIFICATION. The Parties represent and warrant that all necessary
action has been taken by the Parties to authorize the undersigned to execute this Agreement and to
engage in the actions described herein. This Agreement may be modified by written agreement.
CITY's city manager, or designee, may execute any such amendment on behalf of CITY.
18. COUNTERPARTS. This Agreement may be executed in any number or counterparts, each
of which will be an original, but all of which together will constitute one instrument executed on
the same date.
IN WITNESS WHEREOF the parties hereto have executed this contract the day and year
first hereinabove written.

BACKGROUND AND DISCUSSION:
On November 18, 2014 City Council approved a contract to complete emergency work to repair
three dwelling units at the Park Vista Senior Housing Facility due to water intrusion caused by
improperly sloped decks. Contract and insurance documents were finalized in December and
designs for the repair have commenced. Construction designs will consist of several options
including drain modifications, slope realignment and adjustments to the height of the sliding
glass doors facing the decks for three be completed, each of which will help address the water
intrusion problems caused when it rains. Bidding and award of the construction portion of the
project will commence as soon as the designs are finalized and approved, which is expected to be
in February.

Public Contracts Code § 22050 (c) requires that the City Council receive updates at every
regularly scheduled meeting until the emergency repair is completed. Therefore, staff
recommends that City Council receive and file this report on the status of the emergency repair
to address the water intrusion issues at Park Vista Senior Housing Facility.

BACKGROUND AND DISCUSSION:
The City of El Segundo has installed and utilizes Cisco hardware and software for core computer
networking and telephone capabilities. This equipment includes routers, switches, wireless and
VoIP telephony equipment. Cisco SmartNet coverage provides warranty protection, technical
support and access to new versions of software as they are released.
In 2014, staff completed a fiber optic project connecting most City owned buildings. Staff
subsequently expanded the VoIP telephone system to these buildings. These new devices require
additional licensing and the SmartNet quote has been adjusted accordingly.

BACKGROUND AND DISCUSSION:
At its meeting on November 18, 2014, City Council authorized staff to move forward with the
creation of a new at -will classification of Senior Civil Engineer. Council authorized allocating two
of these positions to the Public Works Department to augment staffing dedicated to accomplishing
the capital infrastructure program (CIP) projects approved by the City Council during the Strategic
Planning Session earlier in the year and to address the increasing demand for public works plan
check services and permit issuance.
The proposed Senior Civil Engineer classifications will be performing the following functions:
One engineering position will be dedicated to capital projects as well as other department
plans and studies typically required for grant compliance. With thirty -nine (39) capita
projects either underway or in the queue, this position will supplement existing resources to
help achieve an accelerated schedule for CIP implementation as well as help the Public
Works Department's ability to respond more quickly to emergencies and other unplanned
capital projects.
• The second engineering position will be specifically dedicated to private development and
pubic right -of -way plan check activities. By bifurcating this task from capital projects and
construction oversight activities, the Public Works Department will be able to provide a
higher level of customer service to applicants ushered through the plan check process,
including achieving quicker turn around times as well as offering over - the - counter and
appointment plan checks services.
This new at -will classification will be placed in the Management and Confidential unrepresented
employee group based upon the broad management responsibilities and independent discretion
required to perform assigned responsibilities. Staff recommends slotting this classification into the
existing salary grade of 48M which has a monthly salary range of $6,858.96 - $8,334.68. The
recommended salary range for this classification is based on a review of its assigned level of
responsibilities, required qualifications, and its relative standing with other positions within this job
family.
Staff will bring back this item at the regular City Council meeting scheduled on February 3, 2015 to
recommend passage and adoption of the Ordinance.

AN ORDINANCE AMENDING EL SEGUNDO MUNICIPAL CODE
§1 -6 -4 REGARDING EXCLUSIONS.
The City Council of the City of El Segundo does ordain as follows:
SECTION 1: The City Council finds as follows:
A. The El Segundo Municipal Code ( "ESMC ") provides that the City Council may
from time to time by Ordinance designate departments, appointive officers, or
employees of the City; and
B. It is in the best interest of the City to list all existing officers and members of
departments excluded from the Personnel Merit System; and
SECTION 2: ESMC § 1 -6 -4 is amended in its entirety to read as follows:
"Sec 1 -6 -4. EXCLUSIONS
Those officers and members of departments in addition to department heads and elected
officers who are expressly excluded from the merit system are:

City Attorney

City Engineer
Construction Coordinator

before the effective date of this Ordinance.
SECTION 4: If any part of this Ordinance or its application is deemed invalid by a court of
competent jurisdiction, the city council intends that such invalidity will not affect the
effectiveness of the remaining provisions or applications and, to this end, the provisions of
this Ordinance are severable.

SECTION 5: The City Clerk is directed to certify the passage and adoption of this Ordinance;
cause it to be entered into the City of El Segundo's book of original ordinances, make a note
of the passage and adoption in the records of this meeting, and, within fifteen (15) days after

with California law.

Job Description
Definition: Under general supervision, this at -will position oversees and performs a variety of
complex professional civil engineering work and plan check services for public works services
and facilities and private development projects.
Essential Functions: Essential functions, as defined under the Americans with Disabilities Act,
may include the following duties and responsibilities, knowledge, skills and other characteristics.
This list of duties and responsibilities is ILLUSTRATIVE ONLY, and is not a comprehensive
listing of all functions and tasks performed by positions in this class.
Characteristic Duties and Responsibilities:
Designs and prepares specifications, drawings and contracts for a variety of complex public
works projects such as street and street lighting improvements, storm water /wastewater drain
systems, landscaping, parks and the like.
Develops cost estimates, coordinates contractor bidding and selection processes, evaluates
proposals and recommends awarding of contracts; serves as contract administrator for public
works projects; negotiates contract change orders; approves progress payments and completes
related reports and forms.
Serves as project engineer during construction; conducts field inspections of construction sites
to monitor progress and ensure conformance to engineering plans, specifications and
construction and safety standards; meets with contractors to resolve items of non - compliance;
makes corrections or revisions to plans and prepares conditions of approval.
Reviews development plans for private construction projects affecting the City right -of -way to
ensure conformance with City codes, specifications, policies and standards and prepares
comprehensive correction lists as necessary; reviews and determines fees associated with
development projects and issues permits and collects fees; provides information and
investigates complaints and service requests;; monitors, assesses, coordinates and trouble

BACKGROUND AND DISCUSSION:
The RSI Program offers modifications to owners of qualifying residential property in the City of
El Segundo that reduce interior sound levels of noise generated by air traffic from neighboring
Los Angeles International Airport (LAX).
At its meeting June 3, 2014 the City Council awarded a construction contract to Karabuild
Development, Inc. for the construction of thirty (30) homes, commonly referred to as Group 53
of the RSI Program. One home was removed from the project after it was determined that the
existing construction would not accommodate the RSI Improvements.
The work has now been completed and the final contract amount is $1,054,647.76.

BACKGROUND AND DISCUSSION:
The RSI Program offers modifications to owners of qualifying residential property in the City of
El Segundo that reduce interior sound levels of noise generated by air traffic from neighboring
Los Angeles International Airport (LAX).
At its meeting July 15, 2014 the City Council awarded a construction contract to Spec
Construction Co., Inc. for the construction of twenty -seven (27) homes, commonly referred to as
Group 54 of the RSI Program.
The work has now been completed and the final contract amount is $591,337.15.

BACKGROUND AND DISCUSSION:
On August 19, 2014, the City Council held a discussion regarding the proposed Due Diligence
and Ground Lease Agreement between ES CenterCal LLC and the City of El Segundo for the
purposes of developing a TopGolf Facility at The Lakes at El Segundo Driving Range. The
primary discussion was focused on the financial analysis of the current operations at The Lakes
and whether the TopGolf Development Proposal would be financially beneficial for the City.
Staff prepared and presented various analyses to City Council and due to differences in opinion
of what assumptions to use for the analysis, the City Council directed staff to seek proposals
from outside entities to prepare an objective financial analysis for the purposes of better
understanding the TopGolf Development Proposal. The analysis would compare the current and
future operations of The Lakes, including modifications resulting from the TopGolf proposal, to
the revenues anticipated from TopGolf from the ground lease and resulting tax generation. It
would also identify potential burdens and risks that may arise from the proposal.

City staff prepared the draft Request for Proposals (RFP), entitled Financial Analysis and
Comparison of The Lakes at El Segundo Golf Course and the TopGolf Development Proposal.
The scope of work for the financial analysis includes a number of tasks including:
• A five -year financial analysis of The Lakes apportioned by program areas (i.e. Golf
Course, Driving Range, Lessons, Pro Shop, and Restaurant, etc.);
• Analysis of the current infrastructure of The Lakes and cost estimates to improve and
maintain the facilities for the next 25 years;
• Identification of "what could be" alternatives for the future operations of The Lakes
for the purposes of improving its financial performance;
• Real estate appraisal of the various parcels at The Lakes and comparison to market
value of similar commercial real estate;
• Evaluation of the TopGolf proposal in terms of financial benefits and risks, short-
and long -term capital investments, and impact to the City during construction period
and non - operation; and finally,
• Comparison of the current and future operations at The Lakes to the TopGolf
proposal.
The RFP was approved by City Council on November 4, 2014, and distribution occurred shortly
thereafter to approximately 40 potential bidders. At the due date of December 16, 2014, the City
Clerk's office had received four proposals. The four proposals were as follows:
(1) Pro Forma Advisors, LLC - $19,960 (revised to $15,970)
(2) David Taussig & Associates - $94,400
(3) Titch Industries, Inc. - $11,750
(4) National Golf Foundation Consulting - $35,000 (revised to $30,000)
The Selection Committee comprised of City Manager Greg Carpenter, Recreation and Parks
Director Meredith Petit, and Council Members Dave Atkinson and Mike Dugan reviewed and
evaluated each proposal and initially selected the top two proposals to move forward in the
selection process with an oral interview. The top two proposals invited to interview were Pro
Forma Advisors, LLC, and National Golf Foundation Consulting. The Selection Committee as
well as the three community members of the Golf Course Sub - Committee conducted the
interviews on January 7, 2015.
Through the proposal review and interview process it is clear that both consulting firms are
highly experienced in conducting similar studies and capable of providing a quality finished
product. However, after a more thorough review of the specific tasks associated with the project
and sample work products, the National Golf Foundation has displayed a more comprehensive
approach to their analyses. With that said, below is a summary of the "Pros" to consider when
comparing each consulting agency:

Both firms were asked to review their original cost proposal and modify various tasks they
deemed of lesser importance with the goal to realize some cost savings. Both companies
indicated that a shift from full narrative appraisals to limited summary appraisals would reduce
costs by roughly the same amount. The selection is now between Pro Forma Advisors, LLC for
$15,970 and National Golf Foundation (NGF) for $30,000. Furthermore, the City requested each
party to provide an optional proposal for a full Economic Impact Analysis. Both Pro Forma
Advisors and National Golf Foundation have quoted that additional piece at $5,000.
It is still our understanding that a donation of $10,000 has been pledged to help the City fund this
project. As discussed on November 4, 2014, the Selection Committee was to return to the City
Council for further discussion if the selected proposal exceeded $10,000.
Based on the aforementioned "Pros" for each firm, it is recommended to select National Golf
Foundation to complete the work as identified in RFP #14 -31, Financial Analysis and
Comparison of The Lakes at El Segundo Golf Course and the TopGolf Development Proposal.
However, if cost is a determining factor, the City Council can select Pro Forma Advisors, LLC.
Once a proposal is selected, City Council needs to identify appropriate funds for the difference in
expense above $10,000.

All consulting work is conducted under the direction of Richard B. Singer, Director of
Consulting Services. The project director who will make the field visit and write the bulk of the
report will be assigned at the time of selection by the City. NGF Consulting will use the golf
appraisal firm of Brekan -Nava to provide appraisal and financial modeling support for the study.
Other staff members will work as part of the study team in gathering additional data, applying
participation models, conducting financial analyses, preparing valuations and reviewing the

To complete this engagement, the NGFC team proposes to match the phase program as
described by the City of El Segundo in its Request for Proposal, with only minor modifications.
The NGF proposes to complete a summary appraisal and valuations, as opposed to a full
narrative appraisal as originally requested. The NGF deliverable will not be a state certified
appraisal of value, but rather an independent summary opinion of value. The NGF will also
limit the review to an evaluation of two basic scenarios of economic performance: (1) review of
continued operation of the Lakes at El Segundo as a 9 -hole golf course with driving range (as
is); or (2) the continued operation of the Lakes at El Segundo as a 9 -hole golf course with the
addition of a new TopGolf facility to replace the driving range.

$30,000. This professional fee and expense limit is inclusive of all deliverables as noted up to
and through the delivery of a final report to the City of El Segundo. All direct project expenses
