WHEREAS, the City is the owner of certain public street rights -of -way commonly known as IMPERIAL HIGHWAY, SEPULVEDA BOULEVARD, AND SELBY STREET, in the City, as shown on the maps attached hereto as Exhibit A; and WHEREAS, BSS wants to receive permission to perform certain acts upon, under, along and across the property described above, specifically to install and maintain 4" PVC communications conduits, NOW, THEREFORE, it is agreed as follows: 1 The City, for and in consideration of the full and prompt performance of the things to be performed by BSS as hereinafter set out and contained, hereby grants to BSS subject to termination as hereinafter provided and under the terms, conditions and provisions hereinafter contained, a temporary, non - exclusive, non - possessory license to lay, construct, maintain, operate, repair and remove a series of communications conduits in, under, along and across those certain public street rights - of -way situated in the City of El Segundo, County of Los Angeles, State of California described herein above 2 Said communications conduits shall be for the exclusive use of BSS and installed in the general locations shown on Exhibit A (enclosed herewith and hereby made a part thereof) and as more specifically to be shown on maps to be filed with the City Director of Public Works subject to the approval of the City which are incorporated herein by this reference and made a part hereof BSS shall not lease or otherwise transfer the use of any portion of the capacity of the telecommunication conduit that is the subject of this agreement to any third party without the express, written consent of the City 3 BSS shall submit engineering plans and specifications for the installation of conduits These plans shall be prepared by a State of California licensed professional engineer. 4 All work within the public street rights -of -way shall be in accordance with the City Standards, and the Standard Specifications for Public Works Construction and shall require a City Department of Public Works Excavation permit. This fee has been computed on a unit fee rate of $0.1276 / lineal foot / year of each separate conduit and total estimated installation of 3,000 linear feet of A" diameter conduit. This fee shall be adjusted each year (from the effective date of the agreement) based on the change in the Consumer Price Index, for the Los Angeles Area as issued by the United States Department of Commerce. 6 BSS shall bear all costs of expenses in connection with the construction, maintenance, operation or repair of said communications conduits installed pursuant to this Agreement so long as this Agreement shall remain in effect. 7 BSS shall not unreasonably interfere with or obstruct the public use of said street rights -of -way, and shall promptly and properly backfill any excavations made by or for BSS as a part of installing the communications conduits and appurtenances Both parties shall use their best efforts to cooperate in the construction, maintenance, operation or repair of the communications conduits 8 The City reserves the right to change the grade of any street or road over which this License is granted or to locate or relocate municipal water pipes, sewer lines or any other city owned subsurface installations, and BSS shall within thirty (30) days after demand by the City, start to relocate the location of all affected conduits, and appurtenances laid, constructed or erected hereunder, so as to conform to such changes in grade, or such location or relocation of subsurface installations and proceed diligently to complete such relocation, all at the sole expense of BSS. In case BSS shall fail to comply with the City's instructions given therefor, the City may cause the work required to be done by others and shall keep an itemized account of the cost thereof, which BSS shall pay immediately upon its being presented with said accounting as hereinafter set forth 9 If any street or portion thereof along, across, or under which said communications conduits are installed or maintained hereunder, shall be damaged by reason of the usage of the conduits, or by reason of any other cause arising from the operation by BSS of said communications conduits, BSS shall, at its own cost and expense, immediately repair any and all such damage and restore said street or portion thereof to as good condition as before such usage or cause of damage occurred, 'such work to be done under the direction of said Director of the Department of Public Works, and to his or her satisfaction 10 BSS and its employees and agents, at any and all times when necessary, shall have reasonable access to the communications conduits. However, BSS shall comply with all applicable provisions of the city's Municipal Code and shall ensure that all materials furnished and used in installation of said communications conduits conform to the City standards for such type of work and improvement. All designs, materials, and work shall be subject to the approval of, and finished to the satisfaction of, the City. Page 2 of 6 0 2 9 11 The License granted herewith is temporary only and may be revoked by the City at any time on ninety (90) days written notice of such revocation to BSS, which right the City does specifically reserve. Such revocation may be made for any reason wnich the City. in the exercise of its sole but reasonable discretion, deems sufficient. No such revocation, however, shall be made or ordered unless and until BSS is afforded an opportunity to be heard on the question of such revocation upon at least ten (10) days prior written notice to BSS of the time, place and purpose of such hearing. The decision of the City in said matter, however, shall be final and conclusive 12. In the event the License granted herewith is revoked, BSS shall at its own cost and expense, promptly remove from the property, if the City so requires, said communications conduits or portion thereof which the City in its discretion may designate for such removal, if any. Upon removal, the streets from which the conduit is removed shall be restored to the condition which they were in prior to removal, or to a better condition when required to meet the then in effect standards of the City. 13 BSS shall indemnify, defend and hold harmless the City, its officers, employees and agents and each of them, from and against any and all suits, claims, actions, legal or administrative proceedings (excluding City administrative proceedings), demands, damages, liabilities, interest, attorney's fees, costs, expenses or judgements, of whatever kind, arising in any manner out of the construction by BSS permitted pursuant hereto and the operation and maintenance by BSS of the facilities constructed pursuant hereto This indemnity in favor of the City shall include, but not be limited to, any acts of negligence, or any omission to act where a duty to act exists, by or on behalf of BSS, and /or its officers, agents, contractors and subcontractors. The foregoing indemnification shall not be applicable to any suits, claims, actions, legal or administrative proceedings, demands, damages, liabilities, interest, attorneys' fees, costs, expenses or judgements, of whatever kind, caused by or arising from the active, negligent, willful or intentional misconduct of the City. BSS shall provide the City with a written certificate of insurance in an amount of at least $1,000,000 per incident combined single limit public liability, naming the City as additional insured, and shall provide that the City receives at least 30 days prior written notice by registered or certified mail of cancellation or significant change in said insurance. 14 The license granted herewith is personal to BSS and shall not be assigned by BSS, in whole or in part, without the written consent of the City first being received No written consent by the City hereunder shall be deemed a waiver by the City of any of the provisions hereof, except to the extent of such consent. 15 Nothing herein is intended or shall be interpreted to substitute for any permit or other authorization required by any federal, state or local agency other than the City or any private parties or party, or to limit any of the powers or authority of any federal, state or local agency other than the City or of any private parties or party. 16 In any action to interpret or enforce any provision of this Agreement, the prevailing party shall be entitled to its reasonable attorneys' fees. 030 Page 3 of 6 17 This Agreement shall be construed in accordance with the laws of the State of California. 18. Recently the City staff has performed an area wide survey of rates and services and has determined that the City is still receiving very favorable rates for this type of service A report prepared by Hilton, Farnkopf & Hobson, LLC, a certified management consultant, was also reviewed. This consultant has performed an area wide survey of rates and services of the entire South Bay and Los Angeles County areas. Hermosa Beach is a franchise, city with a costs of 98 99 per household for trash collection and 91.31 for curbside recycling Hermosa Beach has recently extended its existing contract for an additional three years Although their curbside recycling program does not include green waste, d still reduces the amount of trash which, in turn, reduces collection cost Their contract does not provide an annual clean -up week, or for a recycling drop -off center, as does the El Segundo contract Zakaroff provides the lowest cost seance when compared to any of the non - franchised cities surveyed They have provided excellent service to the City of El Segundo residential community during the first four (4) years of their contract They respond quickly and efficiently to staff inquiries and to the few complaints received. Zakaroff is equally as efficient in their operation of the El Segundo recycling drop -off center located at the City Maintenance Facility. The City of EI Segundo implemented a Public Safety Communications Center that went operational in August 2000 The authorized staffing level for the Center includes 3 Senior Dispatchers, 14 full time Dispatchers and 2 part time Dispatchers Although several of the dispatch personnel have the experience necessary to perform the fob, many need to be trained. It was the intent to have the Senior Dispatchers supervise the operations of the Center and provide all necessary training to communications personnel Further, it was the intent to staff each shift with a supervisor who would be functionally responsible for the shift throughout the week. Due to our commitment with the City of Hermosa Beach, as well as our commitment to our own City, a Senior Dispatcher staff member is needed to be on duty a majority of the time to address supervisory related issues. Additionally, Senior Dispatcher administrative duties limit their ability to provide full attention to trainees It is recommended that the El Segundo Police Department Communications Division develop a formal training program similar to the current Field Training Officer program utilized by the Police Patrol Division The CTO's shall be trained and certified as Communications Dispatch Trainers and compensated at an incentive rate of 4 5% above base salary while they are in the CTO program. It is further recommended that the Communications Division reduce authorized staffing for full time Dispatchers to 13, and increase the staff level for Senior Dispatchers to 4 Overall authorized staffing level for the Communications Center would remain unchanged Funding for the incentive based training compensation, as well as the salary increase from Dispatcher to Senior Dispatcher should be obtained from asset forfeiture for the remainder of fiscal year 2000/2001 The necessary amounts should then be budgeted for future years 3/27/014 21 PM 071 City of El Segundo INTER- DEPARTMENTAL CORRESPONDENCE March 12, 2001 TO: Mary Strenn, City Manager FROM: Tim Gnmmond, Chief of Poo;K SUBJECT: Communications Training Officer Program, Additional Senior Dispatcher Position Problem With the recent completion and operational status of the El Segundo Public Safety Communications Center, the police department has hired several new employees to staff the dispatch center Although many have hired on with dispatch knowledge, several have no background in public safety communications and therefore require a tremendous amount of on the fob training from experienced employees. During the conception of the communications center it was determined that the 3 senior dispatchers (supervisors) would provide the necessary training to new staff members. Due to the high number of trainees (currently 3, with 3 more anticipated), as well as the desire to expose trainees to multiple trainers, it is impractical to rely solely on the supervisors to conduct all training. Furthermore, it was anticipated that the 3 supervisors would be satisfactory for functional responsibility over each of the 3 shifts, Day shift, Swing shift, and Graveyard shift This has also proven to be an unviable operational procedure as it is necessary to maintain supervisory staffing within the Communications Center at near all times. To afford this necessity, it has been determined that a fourth supervisor position is required Proposal 1 Create a training program for Communication Dispatchers similar to the Field Training Officer (FTO) program used by the Uniformed Patrol Division 2 Increase authorized supervisory coverage by creating a fourth "Senior Dispatcher" supervisor position within the Communications Center staff. 3 Reduce authorized full time Dispatcher staff to thirteen. 072 CHAPTER 700 Communications Training Officer Program 701 COMMUNICATIONS TRAINING OFFICER MANUAL - ESTABLISHED 701 05 COMMUNICATIONS TRAINING OFFICER MANUAL- ESTABLISHED. The El Segundo Police CTO Manual is hereby established, and shall hereinafter be referred to as the CTO Manual. It shall be a composite of the rules, policies, and procedures of the El Segundo Police Department CTO Program 701 10 CONFORMITY OF RULES All members of the El Segundo Police Department CTO Program shall conform to all rules and provisions contained herein and where applicable to the manual of rules and regulations for the government of the Department of Police, El Segundo, California 701 15 COMMUNICATIONS TRAINING OFFICER MANUAL MAINTENANCE The CTO Manual shall be maintained by the Administrative Services Bureau Lieutenant All additions, amendments, or other changes in the CTO Manual shall be forwarded to the CTO Coordinator who shall be responsible for the insertion of same into the copies of the CTO Manual 701 20 AMENDMENT PROCEDURE Requests for amendments to the CTO Manual shall be prepared, in wnting, to the CTO Coordinator who shall review, and upon their approval, forward to the Administrative Services Bureau Lieutenant Prior to inclusion into the CTO Manual, all amendments shall receive the ultimate approval of the Chief of Police 705 OVERVIEW OF THE COMMUNICATIONS TRAINING OFFICER PROGRAM 70505 OVERVIEW OF THE COMMUNICATIONS TRAINING OFFICER PROGRAM The CTO is the essential means by which the goals of the recruit training program are achieved and is directly responsible for communications training and evaluation of the new trainee during the assigned period He/She provides on -going conventional instruction as well as utilizing innovative and practical training techniques He /She is responsible for producing guidance, direction, counsel, and educational evaluation for the assigned trainee. In that their personal performance is also subject to evaluation, the CTO's professional and personal conduct should be exemplary. The CTO should 075 understand that the effectiveness, Image, and future of the Department is substantially decided by the quality of this recruit Th° CTO must be knowledgeable of, and subscribe tn, the Department'% goals and policies and be willing to instruct the trainee in the significance of these goals and policies The CTO's need to be abreast of new training and methods is essential, and they are urged to participate in area semmars and other training if they can be spared from regular duties He /She must have requisite skills necessary to become a reliable evaluator of a recruit's performance He /She is required to write Weekly Performance Evaluations (WPE's) of the recruit's performance and submit additional documentation as required The CTO has two primary roles to fulfill; that of a Communications Dispatcher assuming full dispatching responsibilities and that of a trainer of recruit personnel The CTO program shall consist of thirty seven weeks of training by CTO's and Supervisors Written evaluations begin on the 2ND week of training During the first week only verbal evaluations are given The first week is a familiarization period for the trainee The CTO shall make a recommendation by the end of the thirty sixth week of the training program concerning the trainee's ability to perform as a Communications Dispatcher If the CTO feels the trainee has gamed sufficient skill and knowledge to operate as a solo dispatcher, the CTO will forward this information through channels to the Administrative Services Bureau Lieutenant After week 36, with recommendation by the CTO, the trainee will be working in a solo capacity with a Supervisor for a one week transition phase. The Supervisor will act only as an observer and evaluate the trainee's abilities. The Supervisor will avoid interfering with the recruit's dispatching performance in any way, except in emergencies or in situations which have developed beyond the recruit's ability to control Following the transition phase, the Supervisor will make final recommendation to release the trainee from the CTO program The CTO will, at this point, continue to provide training input and feedback to both the Communications Supervisor and Probationary Communications Dispatcher in the way of Incident Reports unto probation is successfully completed The CTO is also charged with the responsibility of recommending termination of a recruit when the recruit does not meet standards and the prospects of retention no longer exist This may occur at anytime during the formal training process 076 710 SELECTION PROCESS FOR COMMUNICATIONS TRAINING OFFICERS '710 10 SELECTION PROCESS FOR COMMUNICATIONS TIt=AINING OFFICERS. Openings for the position of CTO shall be filled through appointment by the Chief of Police Recommendations for potential appointments should be made by the Administrative Services Bureau Lieutenant upon completion of the selection process. The selection process shall consist of an oral interview, a review of the candidate's last quarterly and annual evaluations, supervisory rating of qualifications and peer evaluation by current CTO's Minimum requirements for consideration will be: A Possession of a POST Basic Dispatch Certificate. B Two years of dispatching experience C Communications Dispatchers shall not be on the "Performance Enhancement Plan" and their performance review shall reflect at least a standard rating in all categories D No negative recommendations from swom or non -sworn Supervisors A negative recommendation is grounds for disqualification. E No negative recommendations from the current CTO's A negative recommendation is grounds for disqualification. Communications Dispatchers shall apply for the position of CTO in writing through a Request for a Change of Assignment form. Regarding CTO compensation - refer to current M.0 U 712 APPOINTMENT TO PROGRAM 71205 TRAINING REQUIREMENT Prior to being assigned a trainee, the CTO must have successfully completed a POST certified Communications Training Officer Course 715 CHAIN OF COMMAND FOR COMMUNICATIONS TRAINING OFFICERS 71510 CHAIN OF COMMAND FOR COMMUNICATIONS TRAINING OFFICER'S The CTO Program shall be functionally supervised by the Administrative Services Bureau Lieutenant currently assigned to the Communications Trairung Officer Program The coordinator will conduct the monthly meetings of the CTO's These meetings provide verbal and written data on recruits to assist in arriving at a comprehensive evaluation of the trainee's performance. During these meetings, decisions will be made concerning any remedial training for 077 recruits exhibiting performance deficiencies. The CTO program coordinator is responsible for the filing of the WPE's and records in a central location for review by the CTO's and department administration. The coordinator works directly for the Adtninistrative Services Bureau Lieutenant and7fhe Chief of Police concerning the operation of the CTO program. The coordiz>rtor will keep them abreast of the progress of all trainees In addition, it is the coordinator's responsibility to keep the CTO Manual updated after approval of the Administrative Services Bureau Lieutenant 720 CONDUCT 72010 CONDUCT All CTO's are to conform to the General Rules and Regulations of the El Segundo Police Department, which are found in the Department Manual, starting with 2/101 725 OPERATION OF THE COMMUNICATIONS DISPATCHER TRAINING PROGRAM 725 10 OPERATION OF THE CTO PROGRAM - NEW HIRES. The CTO Program consists of thirty -seven weeks of structured training. The trainee will be assigned to six CTO'S, six weeks each The thirty seventh week the trainee will be assigned to a Supervisor for final evaluation/observation and recommendation for release During these thirty -six weeks the trainees are evaluated on their progress by means of a WPE The recruit and the CTO both have copies of the Standardized Evaluation Guidelines used to evaluate the trainees' progress by objective observation of the trainees' work performance and abilities During the CTO program, WPE's are given to each recruit, except during the transition period and the first week of Cycle One The first week is a familiarization period by both the trainee and the CTO. Verbal evaluations only made during the transition period 72520 OPERATION OF THE CTO PROGRAM - LATERALS The CTO Program for lateral dispatchers is the same as in 725 10 except that the dispatcher may be released early from each phase and/or from the training program when the CTO, the CTO Coordinator and the Administrative Services Bureau Lieutenant so recommend and the Chief of Police approves. 730 SUPERVISOR'S EVALUATIONS 73010 SUPERVISOR'S EVALUATIONS Nothing in the CTO Program is intended to circumvent or replace the authority of the Communications Supervisor or C17 8 Administrative Services Bureau Lieutenant. The supervisor's observations, recommendations, and experience is a very valuable portion of the program. At thr "d of en), phase of training with each CTO, the CTO liU complete a phase summary evaluation on the trainee This phase summary will be completed on a WPE The CTO will write the phase number on the form and indicate which weeks are being evaluated. This phase summary report is to be a condensation of the weekly reports; a synopsis of the recruit's abilities at the time of the evaluation When the CTO has completed this evaluation it should be reviewed by the Communications Supervisor The rating supervisor should review the evaluation as soon as it is received Additional comments concerning the supervisors observations should be added if applicable.
