It is the intent of the Legislature in enacting this act to consolidate and i� simplify the statutes relating to the organization and financing of city and county planning agencies, departments, and commissions. (Ord. 300). 1 EL SEGUNDO PLANNING COMMISSION RULES Adopted January 12, 1988 SECTION 1. MEETINGS The Planning Commission shall meet on the second and fourth Thursday of each month at 7:00 P.M. in the City Council Chambers. The time and place of the meetings may be altered or changed by the Commission at any regularly scheduled meeting. Additional meetings may be held at any time upon the call of the Chairperson or by a majority of the voting members of the Commission or upon request of the City Council following at least twenty -four hour notice to each member of the Commission. SECTION 2. OFFICERS A. The elected officers of the Commission shall be a chairperson and a vice - chairperson. The vice - chairperson will serve in the absence of the chairperson. In the absence of both the chairperson and the vice- chairperson, the members present at such a meeting may elect a chairperson pro tem. The City Planning Director shall serve as the secretary of the Commission. The duties and powers of the officers of the Planning Commission shall be as follows: B. Chairperson: (1) Preside at all meetings of the Commission; (2) Call special meetings of the Commission in accordance with these rules; (3) Sign documents of the Commission; (4) See that all actions of the Commission are properly taken C Vice - Chairperson: During the absence, disability, or disqualification of the Chairperson, the Vice - Chairperson shall exercise or perform all the duties and be subject to all the responsibilities of the Chairperson. The Vice - Chairperson shall succeed the Chairperson if he vacates his office before his term is completed, the Vice- Chairperson to serve the unexpired term of the vacated office. The new Vice - Chairperson shall be elected at the next regular meeting following such a resignation. D Secretary: The secretary shall keep the minutes of all meetings of the Public Commission In addition, the secretary shall maintain all other records of the Planning Commission including all applications made under provisions of law and the complete files of proceedings and actions. SECTION 3. AGENDA A. A written agenda shall be prepared for each regular and adjourned regular meeting of the Commission; B. The agenda shall contain a brief general description of each item of business to be transacted or discussed at the meeting, C. Each agenda shall contain a clear statement of the time and location of the meeting, as well as, a statement that reports and documents relating to each agenda item are on file in the office of the Director of Planning and are available for public inspection; D The agenda shall be posted no less that 72 hours in advance of the regular or adjourned regular meeting to which it relates; E. The agenda shall be posted in a location freely accessible to the public at City Hall, the public libraries, or in other locations as designated by the City Clerk. The person posting the agenda shall complete and sign a Certificate of Posting, F. In addition to the other notice requirements, the call and notice of a special meeting shall be posted at least 24 hours before the meeting at the locations specified in subparagraph E. Where feasible, an agenda shall be prepared for the special meeting in accordance with the procedures described in this section; G. Emergency meetings pursuant to Government Code Section 54956.5 and other applicable law can be held without complying with the agenda requirements of this paragraph; H. The Commission shall not take action on any item which does not appear on the posted agenda except as follows: (1) Emergency Situation. An emergency situation is defined as a work stoppage or other activity which severely impairs public health, safety or both, or a crippling disaster which severely impairs pubic health, safety, or both. Before proceeding to act upon an emergency item not appearing on the agenda, the Commission must, by a majority vote, determine that an emergency situation exists and that prompt action is required by the Commission. The Commission shall include in the minutes of its meeting the facts upon which it relied in finding the existence of-an emergency situation. (2) "Subsequent Need" Items. The Commission may act upon an item not appearing on the agenda if it finds, by a two- thirds vote or by a unanmious vote if less than two - thirds but more RVW /RES7923 El Segundo Planning Commission Rules Adopted 01/12/88 than a quorum of its members are present, that the need to take action on the non - agenda item is required because the need to act arose after the posting of the agenda. If such a determination is to be made, a statement of facts upon which the determination is based shall be included in the minutes supporting the action taken. (3) Held Over Item. Items not appearing on the posted agenda may be acted upon at a meeting if: (a) the item appeared on a properly posted agenda for a previous meeting, and (b) the previous meeting occurred not more than five calendar days prior to the date of the meeting at which the item is proposed to be considered; and (c) the item was continued from the previous meeting at which action is proposed to be taken. I. The Commission shall not take up an item on the agenda after 12:00 A.M. J. The Commission may, by a majority vote, designate any matter to be placed on the agenda of any future meeting. SECTION 4. DUTIES AND POWERS OF THE A. The Planning Commission shall have the power to recommend to the City Council, after a public hearing thereon, the adoption, amendment or appeal of a General Plan, or any part thereof, for the physical development of the City. B. The Planning Commission shall exercise such functions with respect to land subdivision, planning, and zoning as may be prescribed by ordinance. C. The Commission shall advise the City Council on those matters falling within its charged responsibilities in a manner reflecting concern for the overall development and environment of the City as a setting for human activities. SECTION 5. MEETINGS A. Public Meetings All meetings shall be held in compliance with the provisions of state law, ordinances of the City and procedures established by the Commission. B. In the event that it is the wish of the Commission to adjourn its meeting to a certain hour or on another day, a specific date, time and place must be set by the Commission prior to the regular motion to adjourn. D. Special Meetings. Special meetings of the Planning Commission may be held at any time upon the call of the Chairperson or by a majority of the voting members of the Commission or upon request to the City Council following at least 24 hours notice to each member of the Commission and to the press. The time and place of the special meeting shall be determined by the Commission. E. Study Session/Workshops. (1) . The Commission may be convened as a whole or as a committee for the whole in the same manner as prescribed for the calling of a special meeting for the purpose of holding a study session provided that no official action will be taken and no quorum shall be required. (2) Such meeting shall be open to the public; but, unless the Commission invites evidence or comments to be given, participation by interested members of the public need not take place at such study sessions. F. Quorum A numerical majority of the appointed members of the Commission shall constitute a quorum and a majority of members present at a meeting shall be sufficient to act, except when the action to be taken is for a recommendation or adoption or amendment of the City's General Plan in which case a majority of all the members of the Commission shall be required. In event of a lack of a quorum at a regular meeting, the Chairperson or Vice - Chairperson or Chairperson Pro Tem, in that order, shall adjourn the meeting to another date in the same calendar month and such declaration of adjournment shall serve as sufficient notice thereof to all members present and it shall be the duty of the Secretary to employ such reasonable means as may be necessary to notify the absentees. G. Tie Votes. A tie vote on any matter properly before the Commission shall be considered "no action" on that matter. An applicant may appeal such a vote to the City Council and is not precluded from reapplying for the same matter immediately following such a vote if no appeal is taken. H. Finality of Commmssion Action. An action shall be considered to be final, whether approved or denied, at the time and upon the date that the vote on the matter is taken. Any subsequent resolution shall merely constitute documentation of the action and the findings supporting the action. If the Commission denies a form of resolution for an action previously taken, it shall either consider rewording of the Resolution or, in the alterative, reopen the matter of reconsideration. I. Resolution. The Commission may, except where required by law, to adopt a resolution, at its own discretion choose to memorialize any action which it takes by ordering the preparation and execution of a minute resolution, letter from the Commission or other resolution in a form approved by the Commission. RV W /RES7923 El Segundo Planning Commission Rules Adopted 01/12/88 4 SECTION 6. PUBLIC PARTICIPATION A. PUBLIC HEARINGS (1) Staff shall first present its report on the matter. The applicant, if one exists for the matter, shall then be permitted to make its presentation to the Commission. (2) Members of the public, shall then be permitted to speak on the matter upon the Chairperson's announcing that the hearing is open. (3) Each person speaking shall give his or her name and address for the record. (4) The applicant shall be given an opportunity for rebuttal following public comment. (5) The Chairperson, with the majority consent of the Commission, may limit the number of witnesses and the time of their testimony, and may establish a maximum total period of time for public testimony during the hearing. (6) The Chairperson may ascertain if there are a good number of persons for or against the matter, and if so, to request that they appoint a spokesperson. (7) There will be no public input once the Commission starts deliberation on the matter before them unless the Commission requests additional information from either staff or the public. B. AGENDA ITEMS WHICH ARE NOT PUBLIC HEARINGS (1) Agenda items which are not public hearings need not be open to public participation. However, the Commission may, upon request of a Commissioner, open any such item to public participation. (2) Prior to the opening of oral communications, the Chairperson shall indicate that any person wishing to speak on any agenda item which is not a public hearing may do so during oral communications. C. ORAL COMMUNICATIONS (1) The Commission shall set aside a period at each meeting for those persons wishing to discuss non -public hearing agenda items and non - agenda items. (2) Persons may address the Commission only on items pertaining to the subject matter jurisdiction of the Commission. A determination of whether an item is appropriate for discussion shall be made by the Chairperson. (3) Persons addressing the Commission during the oral communication portion of the meeting shall be limited to five (5) minutes, unless the time is extended by the Chairperson. (5) The Commission may take immediate action upon any non - agendized matter raised in oral communications which satisfies the criteria set forth in Section 3F(1) "Emergency Situation ". (6) Pursuant to Section W of these Rules, the Commission may, by a majority vote, designate any item brought up during oral communications as an agenda item for a future meeting. D. DISRUPTION OF MEETING The Chairperson may cause an individual to be ejected from a meeting if the Chairperson determines that the individual's actions substantially impair the effective conduct of the meeting. The individual may be effected only after the Chairperson: (1) informs the individual that the Commission's rules of procedure prohibit activities which substantially impair the conduct of the meeting; (2) requests the individual to cease the disruptive activities; and (3) warns the individual that he or she will be ejected from the meeting unless the disruptive activities cease. SECTION 7. COMMISSION AUTHORITY The Commission shall have the authority to waive provisions of the procedures established by these Rules unless the procedure is required by law. Failure of the Commission to follow the procedures established by this Resolution shall not invalidate or otherwise affect any action of the Commission.
