COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AT.
ITS REGULAR MEETING HELD DECEMBER 12, 1951.
"WHEREAS, there has been presented to this Council a
certain "EASEMENT". dated the 29th day of October, 1951,
executed by Santa Fe Land Improvement Company, a California
corporation, granting to the City of E1 Segundo a right of
way easement for the construction, maintenance, operation,
inspection, repair and reconstruction of a water pipe line
through, under and across two parcels of land situate in
the City of E1 Segundo, County of Los Angeles, State of
California, to wit:
Portions of the Northeast Quarter of Section 7,
Township 3 South, Range 14 West, in the Rancho
Sausal Redondo, as more particularly set forth
in said easement,
upon certain terms and conditions therein set forth; and
WHEREAS, this Council has examined said document and
the City Attorney has approved the same as to form, and the
City Council is satisfied therewith;
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of E1 Segundo, California, does hereby approve
the said form of easement and does hereby accept the same
on behalf of the said City; and
BE IT FURTHER RESOLVED, that the City Clerk be and she
is hereby authorized and directed to cause said instrument
to be recorded in the office of the County Recorder of the
County of Los Angeles.„

erly line, being along the are of a curve, concave southeasterly
and having a radius of 589.81 feet, a distance of 68.28 feet, more
or less, to a point in a line which is concentric with and distant
radially 20.00 feet southeasterly from the southerly line of said
2.007 acre parcel; thence southwesterly along said concentric
curve, concave northwesterly and having a radius of 648.805 feet,
a distance of 84.80 feet, more or less, to a point in the easterly
line of said 18.•877 acre parcel; thence northeasterly along said
easterly line, being along the are of a curve concave southeasterly
and having a radius of 632.81 feet, a distance of 35.16 feet, more
or less, to the point of beginning, containing an area of 0.047 of
an acre, more or less.
EXCEPTING AND RESERVING the right,to be exercised by Land Company and
by any others who have obtained or may obtain permission or authoity from Land
Company so to do, (a) to operate, maintain, renew and/or relocate any and all
existing railroad track or tracks, wires, pipes and other facilities of like
character upon, over or under the surface of the premises hereinabove described;

and (b) from time to time to construct, operate, maintain, renew, and/or relocate
upon, over or under the surface of said premises additional facilities of the
character described in Clause (a) of this paragraph, without in any instance
being required to obtain the consent of the City, provided, however, that
said additional facilities shall be constructed, operated, maintained, renewed
and/or relocated by Land Company and others above referred to, at all times
in such a manner as shall not in any wary endanger, damage, or interfere with
said pipe line; provided further that said railroad track or tracks shall be
constructed across the premises hereinabove described and not longitudinally
along said premises; and provided further that Land Company and others above
referred to shall not place or permit to be placed on said premises any per-
manent buildings or structures; and (c) to use or dedicate to the public an
easement for street purposes upon, over or under the surface of the premises
hereinabove described.
TO IAPE AND TO HOLD the above described easement unto City solely
for water pipe line purposes so long as said premises shall be so used, to-
gether with the right to enter upon and to pass and repass over and along said
premises for the purpose of constructing, maintaining, operating, inspecting
and repairing said pipe line, subject, however, to all valid and existing con-
tracts, leases, licenses, easements and encumbrances.which may in any wise
affect the said premises, and subject also to the express conditions subsequent
following:
(a) That City will restore and replace the surface of, and improvements
on, the aforesaid premises and will repair any and all damage to the prop-
arty of Land Company upon or adjoining said premises which is injured or

damaged in the construction, maintenance or performance of other work on
said pipe line.
(b) That City will install said pipe line at least three (3) feet
below the surface of the ground and at all times maintain same in good con-
dition and repair, and should it fail to do so, the Land Company may make
such repairs under the direction of its Engineer as he may deem necessary
for the preservation of Land Company property, and in such event City shall
pay to the Land Company the amount expended therefor.
(c) That City will adequately protect said pipe line to the ex-
tent such protection may be required by reason of the construction and
operation of railroad tracks and facilities upon, along and/or across said
land.
(d) That if the premises hereinabove described.. or any portion
thereof, shall cease to be used for the purposes above stated, or upon the
breach of any of the conditions herein set forth, then and in that event the
easement hereby given shall cease and determine, as to such portion or por-
tions, in the ease of non -user, and in its entirety in the case of breach of
any other condition herein stated, and Land Company, its successors and
assigns, may re-enter thereon and resume possession thereof the same as
though this easement had not been executed.
In case of the eviction of City by any one owning or claiming title
to or any interest in the premises herei.nabove described, Land Company shall
not be liable to City for any damage of any nature whatsoever.
Each of the foregoing conditions shall also be deemed to be covenants
which the City by its acceptance hereof agrees to perform, and shall be binding

upon and shall. inure to the benefit of the parties hereto and their respective
successors and assigns.
