W011In consideration of the sum of One Dollar ($1.00) to it in hand paid, receipt of which is hereby acknowledged, and of other good and sufficient consideration passing to it, the CITY OF MANHATTAN BEACH, a municipal corporation of the sixth class located in the County of Los Angeles, State of California, does hereby grant to the CI`T'Y OF EL BEGND02 a municipal cor- poration of the sixth class located in the County of Los Angeles, State of California, permits and easements in, through, over and upon each and all of the following described parcels of real property located in said City of Manhattan Beach, in the County of Los Angeles, State of California, to -wit: PARCEL N0. 1. A strip of land ten (10) feet in Rafh—, measured five feet at right angles, on either side of a line extending northerly and southerly through, and distant 9.1k feet westerly from the easterly line of, that certain easement for public street purposes conveyed to said City of Manhattan Beach by "Street Deed" dated the 25th day of September, 1948, from Benjamin F. Brown and Flevia T. Brown, husband and wife, to said City in, over, upon, and across those certain pieces or parcels of land situated, lying and being in the City of Manhattan Beach, County of Los Angeles, State of California,described as follows, to wit; A strip of land thirty feet in width, the easterly line of said strip being the easterly line of portion of Lot 9, lying within Section 19, Township 3 S, Range 14 W, S.B.B. & M. Rancho Sausal Redondo, Partition Showing Property Formerly of The Redondo Land Company, as shown on Recorder's Filed Map No. 140 on file in the office of the County Recorder of Los Angeles County, Cali- fornia; The northerly boundary of said thirty foot strip being the southerly line of Lot A, Tract No. 141, ae per map recorded in Book 13, pages 178 -179, of Maps, Records of Los Angeles County, and southerly line of said thirty foot strip being the northerly line of Manhattan Beach Boulevard (formerly Center Street) eighty feet in width, and which is to be named and known as "Redondo Avenue ". -1- MEPARE N0. 2. A strip of land ten (10) feet in h northerly and southerly through Redondo Avenue within said City of Manhattan Beach between the southerly line of Lot A of Tract No. 141, as per map recorded in Book 13, pages 178 -179, of Maps, Records of Los Angeles County on file in the office of the County Recorder of said County, and the southerly line of Marine Avenue, and which lies five (5) feet, measured at right angles, on each side of a line distant eleven (11) feet easterly, measured at right angles, from the westerly line of said portion of said Redondo Avenue; PARCEL N0. 3. A strip of land between the southerly line of Rosecrans Avenue and the northerly boundary line of the City of Manhattan Beach ten (10) feet in width which lies five (5) feet, measured at right angles, easterly and westerly of a line which is parallel with and distant fifteen (15) feet westerly from the extended easterly line of Lot 2, Rancho Sausal Redondo, Partition Showing Property Formerly of The Redondo Land Company, in the said City of Manhattan Beach, as per Recorderts File Map No. 163 on file in the office of the Recorder of Los Angeles County; for the purpose of constructing, installing, repairing, replacing, maintaining, using and removing, in, through, over and upon the real property described in said Parcels Nos. 1, 20 3 and 4 above, a twenty -seven (27 ") inch main, including all fittings and appurtenances, for the transportation of water, all sub- stantially in the manner, at the locations, and of the dimensions shown on, and in conformity with, the plans for said work or improvement hereinafter referred to. PARCEL N0. 5. The northerly one -half of the southerly-eighty (80) feet of the westerly fifteen (15) feet of the property covered by the thirty (30) foot easement for public street purposes conveyed to said City of Manhattan Beach by "Street Deed" dated the 25th day of September,1948, from Benjamin F. Brown and Flevia T. All of the work and improvements to be made under the permits and easements herein granted upon the real properties hereinabove described in Parcels Nos. 1, 20 3, 4 and 5 hereof shall be done, made and performed substantially in the manner, at the locations, and of the dimensions shown on, and in conformity with, Plan No. M -220 of the City of Manhattan Beach entitled "Map Showing Location of Vault Area & $1 Segundo Trans- mission Main between Manhattan Beach & Rosecrans Blvds.K�__ heretofore approved by the City Council of the City of Manhattan Beach and now on file in the office of the City Engineer of said City of Manhattan Beach, open to public inspection and hereby referred to and by this reference expressly incorporated herein and made a part hereof. A full, true and correct copy of the said Plan No. M -220 is hereunto annexed, designated as "Exhibit A ", and said "Exhibit A" is hereby referred to and made a part hereof. The grantee of the permits and easements hereby granted.. City of E1 Segundo, by acceptance of this grant of permits and easements, does thereby agrees Firsts That any work, facilities and installations made in any portion of any public street covered by the permits and easements hereby granted will be made and maintained with due regard for the prior and paramount public street purposes for which the public street or streets affected were or are dedicated, and that all street surfaces disturbed in the exercise of any rights or privileges granted by this instrument will be promptly restored as nearly as reasonably possible by the grantee, at its own expense, to the same condition in which the same existed immedi- -3- e s • Book = qPage 240 ately prior to the making of any excavation in, or disturbance of, the surface and sub - surface of any such public street; and Second: That all work and installations performed or installed under or pursuant to the rights and easements herein granted shall be done, performed, installed, completed and maintained to the satisfaction and approval of the City Engineer of the City of Manhattan Beach, and that any permits for actual excavation required under the ordinances or regu- lations of said City with reference to such matters shall be applied for and notice given to the City Engineer prior to the making of any such excavations. _� Each and all of the rights, permits and easements herein granted are temporary only and may be revoked by the City Council of the City of Manhattan Beach upon one year's written notice of such revocation delivered to the grantee herein, and this grant must be accepted accordingly. In the event the permits and easements hereinabove granted are not used for the purposes above stated, or if after having been used for such purposes such uses are abandoned, then and in that event all permits, rights and easements granted hereunder shall thereupon and in such event cease and terminate.
