Burrowes City Clerk 350 Main Street RESOLUTION NO. 2999 El Segundo, CA. 90245 FREE H A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING THE VACATION (SUBJECT TO THE RESERVATION AND EXCEPTION OF CERTAIN EASEMENTS AND RIGHTS -OF -WAY) OF A CER- TAIN PORTION OF PINE AVENUE WITHIN SAID CITY AS CONTEMPLATED BY RESOLUTION OF INTENTION NO. 2993 SO- 575979 The City Council of the City of E1 Segundo, California, pursuant to the provisions of the "Street Vacation Act.of 1941," being Part 3 of'Division 9 of the Streets and Highways Code of the State of California, does hereby resolve, declare, find, determine and order as follows: SECTION 1. Said City Council after public hearing duly and regularly called, noticed and held, finds and determines from all the evidence submitted, that that certain portion of Pine Avenue within said city described in Resolution of Intention No. 2993 of said Council adopted on the 6th day of MAY , 1980, is unnecessary for present or prospective public street purposes. SECTION 2. That the public interest and convenience require, and it is hereby ordered, subject to the reservations and exceptions hereinafter set forth, that the following portion of the following public street within the city, to wit: That portion of Pine Avenue in the City of E1 Segundo, County of Los Angeles, State of California, being a por- tion of Lot 3 and a portion of Lot 434, in Block 123, El Segundo as said Lot 3 and Lot 434 are shown per map recorded in Book 22, Pages 106 and 107 of Maps in the office of the County Recorder of said County, described ,as .follows: BEGINNING at the northeasterly corner of the intersection of Center Street, 60.00 feet wide, and Pine Avenue, 50.00 feet wide, said corner being a point on the westerly �ine of above said Lot 434, distant South 0 02136" East, 51.58 feet along said westerly line from the northwesterly corner of said Lot 434; THENCE along the northerly line of Pine Avenue, North o 89 52150" East, 71.16 feet to a point on the northeasterly line of said Lot 434 and the southwesterly line of said Lot 3, said point OF LOS ANGELES COUNTYCO ADS `} PASSi 8 A.M. JUN 13 1980 Recorder's Office being distant South 54 °09'12" East, 87.83 feet along said northeasterly line of Lot 434 from the northwesterly corner of said Lot 434; THENCE continuing along said northerly line of Pine Avenue, North 89 °52'50" East, 15.45 feet; THENCE South 0 °07'10" East, 11.21 feet to the above said northeasterly line of Lot 434; THFdNCE along last said northeasterly line South 54 09112" East, 66.05 feet to the southerly line of said Pine Avenue; THENCE along last said southerly line South 89 52150" West, 136.22 feet to the southwesterly line of above said Lot 434; THENCE along last said south- westerly line North 54 °09'12" West, 4.83 feet to the easterly line of the above said Center Street; THENCE along last said easterly line, North 0 °02'36" West, 47.16 feet to the point of beginning. be, and the same, is hereby closed, vacated and abandoned for pub- lic street purposes, all as contemplated by Resolution of Intention No. 2993 of the City Council of the City of El Segundo, California, adopted on the 6th day of MAY , 1980. Reference is hereby made to said Resolution of Intention No. 2993 and to the map or plan entitled, "PORTION OF PINE AVENUE PROPOSED TO BE VACATED BY RESOLUTION OF INTENTION NO. 2993 ," referred to therein, both of which are on file and open to public inspection in the office of the City Clerk in the City Hall of said City, and both of which, by this reference, are incorporated herein and made a part hereof for further particulars. SECTION 3. The City Council does hereby determine that the public convenience and necessity require the reservation of certain easements and rights -of -way for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California, and these proceedings are takenv subject to'such reser- vations and exceptions. . The easements and rights -of -way hereby reserved and excepted from the vacation are the following, to wit: The permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any - 2 - 80- 575979 _ street or part thereof proposed to be vacated and pur- suant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electric energy, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city, shall make a minute of the passage and adoption thereof in the records and proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted; and shall cause a certified copy thereof, attested by the City Clerk under the seal of said city, to be recorded in the office of the County Recorder of Los Angeles County, State of California.
