R542Recording Requested By: City of El Segundo City Clerk When Recorded Return To: City Clerk City Hall - 350 Main St. El Segundo, CA 90245 RECORDER'S OFFICE LOS ANGELES COUNTY CALIFORNIA 11 MIN. 2 PM-NOV PAST. 141984 PUBLIC STREET EASEMENT DEED 84- 1355199 FREE I SEPULVEDA PROPERTIES, INC., a California corporation, hereinafter referred to as "GRANTOR," subject to each and all of the conditions, covenants, exceptions, reservations and rights hereinafter set forth, hereby grants to the CITY OF EL SEGUNDO, a municipal corporation, hereinafter referred to as "GRANTEE," the following described easement to supplement a prior grant of easement by Grantor dated October 5, 1976, for the improvement of Continental Boulevard in the City of El Segundo pursuant to Parcel Map 6684, filed in Book 71, Page 93 of Parcel Maps, Records of Los Angeles County: I. The right to use as an easement for public streets the surface, sixteen (16) feet only above the street curb and twelve (12) feet below the street curb and, 2. The right to use as a nonexclusive easement for public street lights and street trees together with the right to use, for the installation,: maintenance and repair of public street lights, and the installation, and maintenance of street trees in the air space over and above sixteen (16) feet above the street curb. The grant of this easement shall in no way interfere with Grantor's rights to use said air space as hereafter set forth. Grantor agrees to pay the cost of removing any trees and /or street lights or relocating any street lights which in Grantor's opinion, inhibits Grantor's planned use of these air rights. Said easements are located over that certain real property in the County of Los Angeles, State of California, described as follows: Aft Parcel 1 That portion of Parcel 2 in the City of E1 Segundo, County of Los Angeles, State of California, as shown on Parcel Map No. 6684, filed in Book 71, Page 93 of Parcel Maps, records of said county, described as follows: That portion of said Parcel. 2 lying northeasterly, easterly and southeasterly of the following described line: Beginning at a point on the Northerly line of said Parcel 2, said point being N 89 °55'25" W, 9.28 feet from the Northeasterly corner thereof; thence southerly along a curve having a radius of 390.00 feet and a radial bearing of N 59 °13'32" E, through a central angle of 30 °51'03 ", an arc distance of 209.99 feet, said curve being concentric with the curve on the Easterly line of said Parcel having a radius of 398.00 feet; thence parallel with and 8 feet Westerly of the Easterly line of said Parcel, S 0 °04'35" W, 536.94 feet to the beginning of a tangent curve concave Northwesterly, thence Southerly, Southwesterly and Westerly along said curve having a radius of 25.00 feet, through a central angle of 90 °00'00" an arc distance of 39.27 feet to the Northerly line of Grand Avenue, 106 feet wide, as shown on said Parcel Map. Parcel 2 That portion of Parcel 3 in the City of El Segundo, County of Los Angeles, State of California, as shown on Parcel Map No. 6684, filed in Book 71, Page 93 of Parcel Maps, records of said county, described as follows: 40 41,IJ That portion of said Parcel 3 lying Westerly and Southwesterly of the following.described line: Beginning at a point on the Northerly line of said Parcel 3, said point being S 89 °55'25" E, 8.78 feet from the Northwesterly corner thereof; thence Southerly along a�cuJrvve concave Westerly having a radius of 490.00 feet and a radial bearing of N 65' 59'-11'E, through a central angle of 24 °05'22 ", an arc distance of 206.01 feet, said curve being concentric with the curve on the Westerly line of said Parcel having a radius of 482.00 feet; thence parallel with and 8 feet Easterly of the Westerly line of said Parcel, S 0 °04'35" W, 536.94 feet to the beginning of a tangent curve concave Northeasterly, thence Southerly, Southeasterly and Easterly along said curve having a radius 84 -1355? 99 - 2 - of 25.00 feet, through a central angle of 90000100" an arc distance of 39.27 feet to the Northerly line of Grand Avenue, 106 feet wide, as shown on said Parcel Map. In the event the subject property is abandoned for such purposes or vacated as a public street, then and in that event, without further act by Grantor or its successors and assigns, the easement shall terminate and the property shall revert to Grantor or its successors and assigns. IT IS ACKNOWLEDGED, UNDERSTOOD and AGREED by Grantee that the above grant by Grantor is limited both in purpose and in the extent of the property granted for that purpose as follows: I. Grantor shall not erect, construct, or install any building over any public street heretofore dedicated by this instrument which said building is more than two hundred (200) feet in width at the location where it crosses the public street. 2. Grantor covenants that it shall not erect, construct or install any building or structure excepting pedestrian bridges over any public street which is located within one hundred fifty (150) feet of any structure over any public street. 3. Grantor covenants that between any two intersecting:.pWJ.c streets not more than fifty (50) percent of the area of any street shall be covered by buildings or structures and that not more than twenty -five (25) percent of the total street surface area above dedicated shall be covered by buildings. 4. Grantor covenants that not more than fifty (50) percent of the total subsurface area under any public street between intersecting public streets shall be occupied by any tunnel, basement, or other substructure. 5. Grantor covenants that notwithstanding the zoning on the area over and below streets, Grantor shall submit to Grantee for approval, the plans and specifications for any proposed structure over or beneath the area dedicated 3 84'1355199 ,r and to comply with such restrictions; requirements, and regulations as the City Council may impose, including but not limited to structural requirements more stringent than those imposed by the City's Building Code and aesthetic requirements to assure the compatibility of any such proposed structure with the use of the public street above or below such structure.
