The right to use as an easement for public streets the surface, sixteen (16) feet only above the street curb and twelve (12) feet only below the street curb and, 2. The right to use as a nonexclusive easement for public street lights and street trees together with the right to use, for the installation, maintenance and repair of public street lights, and the installation, and maintenance of street trees in the air space over and above sixteen (16) feet above the street curb. The grant of this easement shall in no way interfere with Grantor's rights to use said air space as hereafter set forth. Grantor agrees to pay the cost of removing any trees and /or street lights or relocating any street lights which in Grantor's opinion, inhibits Grantor's planned use of these air rights. IT IS ACKNOWLEDGED, UNDERSTOOD and AGREED by Grantee that the above grant by Grantor is limited both in purpose and in the extent of the property granted for that purpose as follows: 1. Grantor shall not erect, construct, or install any building over any public street heretofore dedicated by this instrument which said building is more than two hundred (200) feet in width at the location where it crosses the public street. 2. Grantor covenants that it shall not erect, construct or install any building or structure excepting pedestrian bridges over any public street which is located within one hundred fifty (150) feet of any other structure over any public street. 3. Grantor covenants that between any two intersecting public streets not more than fifty (50) percent of the area of any street shall be covered by buildings or structures and that not more than twenty -five (25) per- cent of the total street surface area above dedicated shall be covered by buildings. 4. Grantor covenants that not more than fifty (50) percent of the total subsurface area under any public street between intersecting public streets shall be occupied by any tunnel, basement, or other substructure. 3 %D7237PG275 5. Glickman Subiocr: Request for Council Action -- Recommendation Regarding Acceptance of Corrected Easement -- Street Purposes -- Northerly Extension of Continental Boulevard -- Sepulveda Properties, Inc. At the City Council meeting of September 7, 1976, a public street easement deed for the northerly extension of Continental Boulevard was accepted by the City Council from Sepulveda Properties, Inc. Subsequently, the County Engineer, in checking the calculations for Parcel Map No. 6684, discovered an error in closure. This error affects the legal description for the dedication of the northerly extension of Continental Boulevard. A corrected deed has been prepared and executed by Sepulveda Properties. It is recommended that the attached corrected document be accepted by the City Council and that the Mayor be authorized to sign three copies of the document, and the City Clerk to attest.
