In the event the property is not so used or, if after being so used, it is abandoned for such purposes or vacated as a public street or if any of Grantee's cove- nants or obligations herein are breached, then and in that event, without further act by Grantor or its successors and assigns, the easement shall ter- minate and the property shall revertto Grantor or its successors and assigns. IT IS ACKNOWLEDGED, UNDERSTOOD AND AGREED by Grantee that the above grant by Grantor is limited both in purpose and in the N n extent of the property granted for that purpose as follows: 1. Grantor covenants that it shall not erect, construct or in- stall any building or structure excepting pedestrian bridges over any public street which is located within one hundred fifty (150) feet of any other struc- ture over any public street. 3. Grantor covenants that between any two intersecting public streets not more than fifty (50) percent of the area of any street shall be covered by buildings or structures and that not more than twenty -five (25) percent of the total street surface area above dedicated shall be covered by buildings. 4. Grantor covenants that not more than fifty (50) percent of the total subsurface area under any public street between intersecting pub- lic streets shall be occupied by any tunnel, basement, or other substructure. 5. Grantor covenants that notwithstanding the zoning on the area over and below streets, Grantor shall submit to Grantee for approval, the plans and specifications for any proposed structure over or beneath the area dedicated and to comply with such restrictions, requirements, and regulations as the City Council may impose, including but not limited to structural require- ments more stringent than those imposed by the City's building code and aesthetic requirements to assure the compatibility of any such proposed struc- ture with the use of the nuhlic etreet ahnve or haln.x. -,,..h This is to certify that the interest in the real property conveyed by the within deed to the city of El Segundo, a municipal corporation is hereby accepted by order of the City Council on February 8 , 19 71 and the grantee consents to recordation thereof by its duly authorized officer.
