CALIFORNIA, AT ITS REGULAR MEETING HELD OCTOBER 22, 1952• liusOLVED, that that certain Grant of Easement, dated the 25th day of August, 1952, executed by Southern California Edison Company, a corporation, granting to the City of E1 Segundo, a municipal corporation of Los Angeles County, Cali- fornia, an easement for public street and highway purposes in, on and over that certain real property in the City of E1 Segundo, County of Los Angeles, State of California, described as follows: PARCEL NO. 1: The South 5.00 feet of Lot 6, Block 113 of El Segundo, Sheet No. 5, as shown on map recorded in Book 20, pages 114 and 115, of Maps, in the office of the County Recorder of said County. PARCEL NO. 2• The North 5.00 feet of Lot 326, Block 123, of El Segundo, Sheet No. 8, as per Map recorded in Book 22, pages 106 and 107, of Maps, in the office of the County Recorder of said County, be and the same is hereby accepted for and on behalf of the City of E1 Segundo; and BE IT FURTHER RESOLVED, that the City Clerk be and she is hereby authorized and directed to cause said instrument to be filed for record in the office of the County Recorder of Los Angeles County, California.?? Easements for private roadways and the installation W of public utilities in and through the Easterly 25 r 20 feet of the real property described in Parcel No. 21 t's above, as reserved in deed executed by Pacific Southwest 21 Trust & Savings Bank, recorded October S. 1926 in Book 6092, page 77, of Official Records, in the office of the 22 County Recorder of the County of Los Angeles. 23 3. That certain unrecorded license for agricultural 24 purposes, affecting Parcel 2,above, as granted by Southern California Edison Company to Benjamin H. Pfluger, 25 by an instrument dated March 15, 1951; said license to expire March 14, 1953 unless revoked. 26 To be known as MARIPOSA AVENUE. 27 1. The aforesaid easement is granted subject to� -all other 28 easements, rights, leases, licenses and encumbrances of record af- 29 fectin the above described real g property, or any portion thereof. 30 2. The aforesaid easement is also granted subject to the 31 right of Grantor, its successors and assigns, to construct, inspect, 32 maintain, use, operate, alter, add to, repair, replace, reconstruct, -1- eL MX'10168 PAGE-165 1 relocate and remove electric transmission and distribution lines, 2 pipe lines, telephone lines, and supporting structures and appurte- 3 nances, for conveying electric energy for heat, light, power, gas, 4 oil and telephone purposes, in, on, along, across and over the 5 above - described real property, and conduits for any and all purposes 6 in, through and under said real property; provided, however., that 7 such right shall be so exercised as not to unduly interfere with 8 the use of said easement hereby granted to Grantee. Said easement 9 shall be so exercised as not to interfere with or endanger the pres- 10 ence, construction, inspection, maintenance, use, operation, altera- 11 tion, addition, repair, replacement, reconstruction, relocation or 12 removal of such electric transmission and distribution lines, pipe 13 lines, telephone lines, supporting structures and appurtenances, or 14 conduits; and Grantee, by the acceptance of this instrument, agrees 15 to hold harmless and indemnify Grantor, its successors and assigns, 16 from and against all claims, demands, actions, loss, damage, expense, 17 and liability, arising from or growing out of loss of or damage to 18 property, or injury to or death of persons, resulting in any manner 19 whatsoever, directly or indirectly, by reason of the exercise of 20 the rights herein granted; and Grantee hereby agrees to pay to 21 Grantor, its successors and assigns, upon demand, any and all costs 22 of protection, relocation and reconstruction of any such electric 23 transmission, distribution, pipe lines and telephone lines, sup- 24 porting structures and appurtenances, and conduits which may be or 25 become necessary by reason of the exercise of this easement. 26 3. Grantor reserves for itself, its successors and 27 assigns, the right to trim any tree or trees which may grow within 28 the easement herein granted and which shall, in the opinion of 29 Grantor, its successors or assigns, endanger or interfere with the 30 proper operation or maintenance of said electric transmission, 31 distribution and telephone lines, to the extent necessary to 32 prevent any such interference or danger. -2- 1 4. The above - described property is to be used only for 2 public street and highway purposes, and in the event said land is 3 not used for public street and highway purposes, or if the project 4 for the construction of public streets and highways is abandoned, 5 or in the event any portion of said land shall hereafter be 6 vacated as a public street or highway, it shall thereupon, 7 ipso facto, revert to and revest in Grantor, its successors or 8 assigns. 9 5. This easement is given pursuant to the authority 10 of, and upon and subject to, the conditions prescribed by 11 General Order No. 69 of the Public Utilities Commission of the 12 State of California, dated and effective November 1, 1923, which 13 said General Order No. 69 by this reference is hereby incorporated 14 in and made a part hereof. 15 6. The easement hereby granted is not necessary or 16 useful in the performance of the duties of said Southern 17 California Edison Company to the public. 18 7. All notices which Grantor is required or may desire 19 to give to Grantee under or in connection with this easement may 20 be given by addressing the same to Grantee as follows: City of 21 E1 Segundo, City Hall, 203 Richmond, E1 Segundo, California, or 22 at such other address in the State of California of which Grantee, 23 from time to time, gives Grantor written notice and by depositing 24 the same so addressed, postage prepaid, in the United States 25 mail or by delivering them, toll prepaid, to a telegraph company. 26 All notices which Grantee is required or may desire 27 to give to Grantor under or in connection with this easement 28 shall be given by addressing the same to Grantor as follows: 29 Southern California Edison Company, Post Office Box 351, 30 Los Angeles 53, California, or at such other address of which 31 Grantor, from time to time, gives Grantee written notice and by d 32 positing the same so addressed, postage prepaid, in the -3- 1 2 3 4 5 e 7 8 9 10 11 12 13 M 15 ME 17 18 19 20 21 22 23 euo><40168 PAGE167 United States mail, or by delivering them, toll prepaid, to a telegraph company.
