SD001a GRANT OF EASEMENT FOR STORM DRAIN PURPOSES THIS INDENTURE, made this V-' day of June, 1944, between ELDON P. DARLEY and lyikp - h_ DARLEY, his wife; JOHN A. BRENNAN and HARRIETT G. BRENNAN, his wife; and JOHN CATALANO and ADELINE W. CATALANO, his wife, all of E1 Segundo, California, parties of the first part, hereinafter called the Grantors, and the CITY OF EL SEGUNDO, a municipal corporation of the sixth class, situated in the County of Los Angeles, State of California, the party of the second part, hereinafter called the Grantee, - W I T N E S S E T H: That the said parties of the first part, Grantors, for and in consideration of the sum of $1.00, lawful money of the United States of America, to them in hand paid by said party of the second part, Grantee, and other valuable considerations pass- ing from said Grantee to said Grantors, the receipt of all of which is hereby acknowledged, do by these presents grant unto the said party of the second part, Grantee, a perpetual easement and right of way for the construction, re- construction, inspection, maintenance, operation and repair of a storm and surface water drain or storm and surface water sewer, in, under, upon and along those certain parcels of land situated in the City of E1 Segundo, County of Los Angeles, State of California, described as follows, to -wit: The Easterly Ffeet of the Southerly 125 feet of Lot 4, Block 92, El Segundo Sheet Not 4, as per map recorded in Book 20, at page 24 of Maps, Records on file in the office of the County Recorder of the County of Los Angeles, State of California; .. 1- together with the right to said party of the second part, Grantee, its agents, servants and employees, and persons under contract with it, to enter upon and to pass and re -pass over, upon and along said strip of land, and to deposit tools, Implements and other materials thereon, whenever and wherever necessary for the purpose or purposes of constructing, re- constructing, inspecting, maintaining, operating or repairing such storm and surface water drain or storm and surface water sewer. Said grantors do hereby also grant and convey to said Grantee, all of their and each of their right, title and interest in the 6 inch vitrified clay pipe, storm and surface water drain now in place in said easement. Each of the undersigned, Grantors, in executing and delivering this grant of easement, conveys to said Grantee, the easement above referred to, only in the portion of the above described property of which such Grantor is the Owner, or in which he or she is legally or equitably interested. In consideration of the foregoing grant, the said party of the second part, Grantee, hereby agrees that any storm and surface water sewer or drain in said strip of land shall be constructed in a good and workmanlike manner; that all excavations and work upon said easement permitted here.• under will be prosecuted diligently and that the surface of any land disturbed will be restored as nearly as reasonably possible to the same condition in which it existed immediately prior to the disturbance thereof. The Grantors, however, reserve the right to the surface use of the land covered by the easement herein granted for any lawful purpose, but do 2- agree with the Grantee that any such use will not unreason. ably interfere with the installation, maintenance or repair of any such drain or sewer. TO HAVE AND TO HOLD the said easement and right of way unto the said Grantee, its successors and assigns, for the purposes and uses hereinabove set forth.
