WHEREAS, the Government is the owner in fee simple of a parcel of land situate at the U.S. Naval Industrial Reserve Aircraft Plant, E1 Segundo, California, hereinafter referred to as the Facility; and WHEREAS, the Grantee has requested the conveyance of an easement for the construction, installation, maintenance, operation and repair of a 12 -inch sewer pipe line through and under the aforesaid Government -owned parcel of land, as delineated on the plan annexed hereto; and WHEREAS, the Secretary of the Navy has found that the grant of an easement on the terms and conditions hereinafter stated will be in the public interest and will not substantially injure the interest of the Government in the property affected. NOW, this Indenture witnesseth that, in consideration of this grant and of the mutual benefits and advantages to be derived therefrom, the Government, pursuant to the authority of Title 10, U. S. Code, Section 2669, hereby grants unto the said City of E1 "Segundo, California, its successors and assigns, for a period of fifty (50) years from the date hereof, an easement for the construction, installation, maintenance, operation and repair of a 12 -inch sewer pipe line, hereinafter referred to as the Line, such easement to be confined through and under the following described land, hereinafter referred to as the Premises: RICOn ••. �� t. aT:C rte,.` RECORDED IN OFFICIAL RECORDS OF LOS ANGELES COUNTY, CALIF. 55 Past 9 A•M. LEE, County Recorder BOOK D416 rAC M That portion of the East Half of Section 7, Township 3 South, Range 14 West, San Bernardino Base and Meridian, in the Rancho Sausal Redondo, in the City of El Segundo, County of Los Angeles, State of California, as shown on map filed in Case No. 11629 of the Superior Court of the State of California, in and for the County of Los Angeles, being a strip of land 10 feet in width, the Westerly side line of which is described as follows: Beginning at a point of intersection of the Northerly line of El Segundo Boulevard and the Easterly line of said Section 7; thence Westerly along said Northerly line of El Segundo Boulevard, a distance of 1415.20 feet, to its intersection with the Southerly prolongation of the Westerly line of Douglas Street, 150 feet in width (formerly Northrop Street), said intersection being the TRUE POINT OF BEGINNING of this right of way- thence Northerly along said Southerly prolongation of the Westerly line of Douglas Street, to the Southerly line of the Northeast (quarter of said Section 7 and the end of this right of way. The Easterly side line of the above described right of way shall be prolonged or shortened so as to terminate in the Northerly and Southerly boundaries of grantor's property. Containing 0.60 acre, more or less. THIS EASEMENT is granted subject to the following terms and conditions: 1. That all work in connection with the construction, installation, operation, maintenance and repair of the Line shall be done without cost or expense to the Department of the Navy and in accordance with plans previously approved by the District Public Works Officer, Eleventh Naval District, hereinafter referred to as the District Public Works Officer. 2. That the Grantee shall maintain the Line in good condition and shall promptly make all repairs thereto which may be necessary for the operation and the maintenance of said Line. 2 u Bou X416 w-E350 3. That the Government may use the Line for the discharge of sewage to the extent required by future operations at the Facility. 4. That the Grantees rights hereunder shall be subject to such rules and regulations as may be promulgated by the Government to insure that the exercise of such rights shall not interfere with the Facility. 5. That upon termination of the easement granted herein, if desired by the Government, the Grantees at its expense, shall remove any and all improvements installed or constructed hereunder and restore the Premises to the same or as good condition as that which existed prior to the exercise by the Grantee of its rights hereunder, such restoration to be effected to the satisfaction of the District Public Works Officer. 6. That if at any future time it is determined by the Government that the easement herein granted interferes with Government activities, the Grantee shall relocate any con- struction or installations at its expense; if the Government determines such relocation is not feasible, the Government shall have the right to terminate the easement herein. 7. That all or any part of the easement herein granted may be terminated for failure on the part of the Grantee to comply with any of the terms and conditions of this grant. This easement shall terminate upon abandonment of the rights granted herein or upon nonuse of such rights for a period of two consecutive years. 3 B9oK 8416 PACE351 8. That the Government may use the Premises which are the subject of this easement for any purpose which does not create an unreasonable interference with the use and enjoyment of the Grantee of the easement rights granted herein.
