S119CONVEYANCE of S tary Sewer Line and EASEMENT made this day of `�� ,�,Y.,�,�. , 19560 by SANTA FE LAND IMPROV T C014- PANY, a California corporation, hereinafter called "Land Company," to the CITY OF EL SEGUNDO, a California municipal corporation, hereinafter called "City." IN CONSIDERATION of the sun of One Dollar ($1.00) lawful money of the United States of America, receipt of which is hereby acknowledged, Land Company hereby gives to City three separate sanitary sewer lines, together with an easement over, under and across three parcels of real property for the maintenance, operation and reconstruction of said sewer lines. Said easements, each being a strip 10 feet in width, are situate in the City of E1 Segundo, County of Los Angeles, State of California, being portions of Parcels 2, 4 and 5 as said parcels are shown on Record of Survey Map of a portion of the North Half of Section 7, Township 3 South, Range 14 West, in the Rancho Sausal Redondo, which Map is filed in Book 66, page 5, Records of Surveys of said County, said strips of land lying 5.00 feet from an d on each side of the following described center lines: Parcel A: Beginning at the intersection of a line that is parallel with and distant westerly 280.00 feet at right angles from the easterly line of said Parcel 5, said easterly line being also the westerly line of land described in deed dated January 17, 1949, from Santa Fe Land Improvement Company to Nash- Kelvinator Corporation, recorded on March 1, 1949 as instrument No. 1435 in Book 29478, page 241, Official Records in the Office of the County Recorder of said County, with a line that is parallel with and distant southerly 190.28 feet at right angles from the northerly line of said Parcel 5; thence South 89° 59' 20" West along last said parallel line 275.00 feet to point of ending. Said strip contains an area of 0.06 of an acre, more or lefiL -1- 000k53041 racf 49 Parcel B: Beginning at the intersection of that certain southerly line of said Parcel No. 4 as shown on said Record of Survey Map as having a bear- ing of North 89° 591 2011 East and a length of 2352.16 feet with a line that is parallel with and distant easterly 485.00 feet at right angles from the westerly line of said Parcels No. 4 and No. 5; thence North 01 001 2011 West along said parallel line 350.00 feet; thence North 340 521 50" Vilest 228.13 feet to a point in a line that is parallel with and distant easterly 354.56 feet from the westerly line of said Parcel No. 5; thence North 0° 001 201, West along last said parallel line 155.74 feet to a point of ending in a line that is parallel with and distant northerly 382.22 feet at right angles from the southerly line of said Parcel No. 5. Said strip contains an area of 0.17 of an acre, more or less. Parcel C: Beginning at the intersection of that certain northerly line of said Parcel 2 as shown on said Record of Survey Map as having a bearing of North 89° 591 2011 .East and a length of 2352.16 feet with a line that is parallel with and distant easterly 419.89 feet at right angles from the westerly line of said Parc �M 2; thence South 00 001 20t1 East along said parallel line 545.00 feet to point of ending. Said strip contains an area of 0.13 of an acre, more or less. EXCEPTING and RESERVING the right, to be exercised by Land Company and by any others who have obtained or may obtain -2- B oMM earn 50 permission or authority from Land Company so to do, (a) to operate, main- tain, renew and/or relocate any and all existing railroad track or tracks, wires, pipes, other than said salitary sewer lines, and other facilities of like character upon, over or under the surface of the premises herein- above described and (b) from time to time to construct, operate, maintain, renew, and /or relocate upon, over or under the surface of said premises additional facilities of the character described in Clause (a) of this para- graph, without in any instance being required to obtain the consent of City. TO HVE AND TO HOLD the above - described easement unto City solely for sanitary sewer line purposes so long as said premises shall be so used, together with the right to enter upon and to pass and repass over and along said premises for the purpose of constructing, maintaining, operating, inspecting and repairing said sanitary sewer line, subject, however, to all valid and existing contracts, leases, licenses, easements )4- and encumbrances which may in any wise affect the said premises, and sub- ject also to the express conditions subsequent following: (a) That City will restore and replace the surface of, and improvements on, the aforesaid premises and will repair any and all damage to the property of Land Company upon or adjoining said premises which is injured or damaged in the construction, maintenance or perform- ante of other work on said santary sewer line. (b) That if the premises hereinabove described, or any portion thereof, shall cease to be used for the purposes above stated, or upon the -3- m53041 na 51 breach of any of the conditions herein set forth, then and in that event the easement hereby given shall cease and determine as to such portion or portions, in the case of non -user, and in its entirety in the case of breach of any other condition herein stated, and Land Company, its suc- cessors and assigns,nay re -enter thereon and resume possession thereof the same as though this easement had not been executed. In case of the eviction of City by any one owning or claiming title to or any interest in the premises hereinabove described, Land Company shall not be liable to City for any damage of any nature whatso- ever. Each of the foregoing conditions shall also be deemed to be covenants which the City by its acceptance hereof agrees to perform, and shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns.
