S059GRANT OF EASEMENT FOR SANITARY AND /OR STORM SEWER PURPOSES. THIS INDENTURE made this 29th day of January, A. D., 1927, by and between Emanuel Collins, Clara Collins, his wife, and Edith D. Collins, sometimes also known as Edith D. Keenahan, a married woman, but dealing herewith as her separate property, all of Huntington Park, Cali- fornia, the parties of the first part, and THE CITY OF EL SEGUNDO, a municipal corporation of the County of Los Angeles, State of California, party of the second part, - W I T N E S S E T H: That the said parties of the first part, for and in consideration of the sum of One Dollar ($1.00), lawful money of the United States of America, to them in hand paid by the said party of the second part, the receipt of which is hereby acknowledged, do by these presents grant and con- vey unto the said party of the second part, a perpetual easement and /or right of way for the construction, re- construction, inspection, maintenarc e, operation and repair of a sanitary and /or storm sewer or sewers or instramen- talities providing for the control, flow and disposal of sewage and /or storm and surface waters, together With the necessary outlets, manholes, ditches, drains, conduits, tunnels, channels or other appurtenances, in, over, across and /or alongthose certain pieces or paree]oof land situated, lying and being in the •City of E1 Segundo, County of Los Angeles, State of California, and particularly described as follows, to -wit: 1- All of that portion of Lot 12, Block 65, as said lot and block are shown upon that certain map of E1 Segundo Sheet No. 7, recorded in Book 22, Pages 54 -55 of Maps, records of Los Angeles County, California; and on file in the office of the County Recorder of said county; lying within the following described boundary line, to -wit: Beginning at a point on the northerly line and 22 feet easterly of the northwesterly corner of said lot; thence westerly along the north- erly line to the said northwesterly corner; thence southwesterly along the westerly line of said lot to the southwesterly corner thereof; thence easterly along the southerly line of said lot a distance of 16 feet to a point; thence northeasterly in a straight line to the point of beginning. All of that portion of Lot 13, Block 65 as said lot and block are shown upon that certain map of E1 Segundo Sheet No. 7, recorded in Book 22, pages 54 -55 of Maps, records of Los Angeles County, California; and on file in the office of the County Recorder of said county; lying within the following described boundary line, to -wit: Beginning at a point on the northerly line and 25 feet easterly of the northwesterly corner of said lot; thence westerly along the northerly line to the said northwesterly corner thereof; thence southwesterly along the westerly line of said lot to the southwesterly corner thereof; thence easterly along the southerly line of said lot a distance of 22 feet to a point; thence northeasterly in a straight line to the point of beginning. All of that portion of Lot 14., Block 65 as said lot and block are shown upon that certain map of E1 Segundo Sheet No.'7,, recorded in Book 22, pages 54 -55 of Maps, Records of Los Angeles County, California; and on file in the office of the County Recorder of said county; lying within the following described, boundary line, to -wit: Beginning at a point on the northerly line mid 1S feet easterly of the northwesterly co mer of said lot; thence westerly along the north- erly line -to the said northwesterly, corner thereof; thence southwesterly. along the west- erly line of said lot to the southwesterly corner thereof; thence easterly along the 2- southerly line of said lot a distance of 25 feet to a point; thence northeasterly in a straight line to the point of beginning, together with the right, which is hereby granted, to said party of the second part, its officers, agents and em- ployees and to persons under contract with it and their employees, to enter in and upon and to pass and repass in, over, upon, across and /or along said parcels or strips of land, and to deposit tools, implements, equipment and supplies, excavated earth and /or other material thereon, whenever and wherever necessary, and as often as occasion may require, for the purpose of constructing, re- constructing, inspecting, maintaining, operating and repairing a sanitary and /or storm sewer or sewers or instrumentalities providing for the control, flow and disposal of sewage and /or storm and surface waters, together with the necessary outlets, manholes, ditches, drains, conduits, tunnels, channels and other appurtenances, or any of them above mentioned. The said parties of the first part further agree that during the life of this easement, said parties of the firs part, will not, nor will their or any of their heirs, executors, administrators, successors or assigns, construct in or upon the premises covered by this easement, any building or structure which will unreasonably interfere with the exer- cise of any of the rights and privileges granted in this easement. In consideration of the foregoing grant, the party of the second part, hereby agrees that it will use its best efforts to see that all construction work done pursuant to the rights granted under this easement, will be done in a good and workmanlike manner, and that upon the " 3- completion of any excavations which may be made, that so far as possible such excavations will be refilled and the surface of the land restored as nearly as reasonably possible to the same condition in which it existed prior to the making of such excavation; provided neither party hereto shall be required to construct any retaining wall. TO HAVE AND TO HOLD all and singular, the said premises unto the said second party, its officers, agents and employees, and persons under contract with it and their employees, for the uses and purposes hereinabove recited.
