FOURTH AMENDMENT TO
AGREEMENT NO. 2934 BETWEEN
THE CITY OF EL SEGUNDO AND
MAXIMUS
THIS FOURTH AMENDMENT ( "Amendment ") is made and entered into this 25`x' day of January
2008, by and between the CITY OF EL SEGUNDO, a general law city and municipal corporation
existing under the laws of California ( "CITY "), and MAXIMUS, Inc., a Virginia corporation
( "CONSULTANT ").
Pursuant to Section 25 of Agreement No. 2934 ( "Agreement "), Section 2 is amended to
read as follow:
"2. TERM. The term of this Agreement will be from October 1, 2007 to September 30,
2009. Unless otherwise determined by written amendment between the parties, this
Agreement will terminate upon expiration of the term or as set forth in Section 11."
2. Pursuant to Section 25 of Agreement No. 2934 ( "Agreement "), Section 4 is amended to
read as follows:
"4. PAYMENTS. CITY will pay MAXIMUS for its services as follows:
A. State Mandated Cost Reimbursement Claims for claims arising during fiscal years
2007 -2008 and 2008 -2009, CITY will pay MAXIMUS a fixed fee of three thousand one
hundred dollars ($3,100) after MAXIMUS submits the claims to the State Controller.
MAXIMUS will render to the CITY invoice(s) for the fixed fee specified herein, with
payment due on or before July 31, 2008 and July 31, 2009 respectively. Invoices unpaid
sixty (60) days after July 31, 2008 or July 31, 2009, will bear interest at the rate of 1%
per month.
B. Other claims for claims other than Annual State Mandated Cost Reimbursement
Claims, CITY will pay MAXIMUS a fee equal to fifteen percent (15 %) for all new
claims filed to a maximum amount of two thousand five hundred dollars ($2,500).
C. All payments due to MAXIMUS are due within 30 days after CITY receives invoice
and after CITY receives reimbursement from the State of California."
3. This Amendment may be executed in any number or counterparts, each of which will be an
original, but all of which together constitutes one instrument executed on the same date.
4. Except as modified by this Amendment, all other terms and conditions of the Agreement
remain the same.
