AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO, CALIFORNIA, APPROVING ENVIRONMENTAL
ASSESSMENT NO. EA -376 AND ZONE TEXT AMENDMENT 96 -1
AMENDING THE EL SEGUNDO MUNICIPAL CODE BY
AMENDING VARIOUS SECTIONS OF TITLE 20 (THE ZONING
CODE), AND THE SMOKY HOLLOW SPECIFIC PLAN, ALL OF
WHICH ARE COVERED BY A PREVIOUSLY CERTIFIED
ENVIRONMENTAL IMPACT REPORT. PETITIONED BY THE
CITY OF EL SEGUNDO.
WHEREAS, on December 1, 1992, the City of El Segundo adopted a General Plan for the years
1992 -2010; and
WHEREAS, on December 1, 1992, the City of El Segundo certified an Environmental Impact
Report as a complete and adequate document in accordance with the authority and criteria contained
in the California Environmental Quality Act and the City of El Segundo Guidelines for the
implementation of the California Environmental Quality Act and adopted a Statement of Overriding
Consideration; and
WHEREAS, on November 16, 1993, the City Council did, pursuant to law, adopt a Negative
Declaration of Environmental Impacts for the amendments to Title 19 (Subdivisions) and Title 20 (The
Zoning Code) and a new Zoning Map, finding that there were no environmental impacts associated with
the amendments that were not analyzed in the Master Environmental Impact Report certified by the
City Council for the General Plan on December 1, 1992; and
WHEREAS, on November 16, 1993 the City Council did, pursuant to law, adopt Ordinance No.
1212 adopting a new Title 19 (Subdivisions) and Title 20 (The Zoning Code) and a new Zoning Map; and
WHEREAS, on February 6, 1996 the City Council did, pursuant to law, adopt Ordinance No.
1245 adopting revisions to Title 19 (Subdivisions) and Title 20 (The Zoning Code) and modifications to
the Zoning Map; and
WHEREAS, on January 25, 1996, the Planning Commission did hold, pursuant to law, a public
workshop to review revisions to the Zoning Code, related to landscaping; and
WHEREAS, on February 8, 15, 22, and 29, 1996, the Planning Commission did conduct,
pursuant to law, duly advertised public hearings on revisions to the Zoning Code and the Smoky Hollow
Specific Plan, and notice was given in the time, form and manner prescribed by law; and
WHEREAS, on February 29, 1996, the Planning Commission adopted Resolution No. 2375
recommending to the City Council approval of Environmental Assessment EA -376 and Zone Text
Amendment ZTA 96 -1 regarding amendments to the Zoning Code and Smoky Hollow Specific Plan; and
WHEREAS, on March 6, 1996, the City Council did hold, pursuant to law, a duly advertised
public hearing on revisions to the Zoning Codes and the Smoky Hollow Specific Plan, and notice was

given in the time, form and manner prescribed by law and the public hearing was continued until March
18, 22, April 2, May 21, and June 11, 1996; and
WHEREAS, opportunity was given to all persons to present testimony or documentary evidence
for or against EA -376 and ZTA 96 -1, the revisions to the Zoning Code and Smoky Hollow Specific Plan;
and
WHEREAS, at said hearings the following facts were established:
The purpose of the revisions to the Zoning Code and Smoky Hollow Specific Plans is to refine and
make appropriate adjustments to the development standards and other zoning requirements in
order to address concerns raised by the community about the future development of the City.
NOW, THEREFORE, BE IT ORDAINED that after consideration of the above facts and study of
proposed Environmental Assessment EA -376 and ZTA 96 -1 the City Council finds as follows:

The proposed Zoning Code and Smoky Hollow Specific Plan amendments are consistent with the
1992 General Plan.
ENVIRONMENTAL FINDINGS
1. The City Council previously adopted EA -275 and Ordinance No. 1189 certifying a Final
Environmental Impact Report on December 1, 1992, for the 1992 General Plan; finding that the
Final EIR was a complete and adequate document, properly identifying potential environmental
impacts and potential mitigation measures to reduce the identified impacts. The proposed
changes in the Zoning Code are not separate and independent land -use actions. They are
changes contemplated merely to implement the General Plan. There are no changes in the land -
use designations and no changes to floor area ratios. Pursuant to 15168 of the California
Environmental Quality Act (CEQA), they are not likely to create any environmental impacts not
already considered by the General Plan Final EIR.
2. The City Council hereby determines that the project is covered by the previously certified
Environmental Impact Report and the General Plan Program EIR adequately describes the
proposed project for the purposes of complying with the California Environmental Quality Act
(CEQA).
3. That when considering the whole record, there is no evidence that the project will have the
potential for an adverse effect on wildlife resources or on the habitat on which wildlife depends.
4. That within 10 days following the final adoption of the Zone Text Amendments by the City
Council, the City shall file a De Minimus Finding with the County of Los Angeles Recorders
Office, pursuant to AB 3158 and the California Code of Regulations and shall file a Notice of
Exemption, pursuant to the California Environmental Quality Act. Until appropriate notices are
filed with the County of Los Angeles, the project shall not be deemed to be vested and no permits
may be issued.

NOW, THEREFORE, BE IT FURTHER ORDAINED THAT the City Council approves EA -376 and
ZTA 96 -1, and adopts changes to the El Segundo Municipal Code as follows:
SECTION 1. Section 20.08.147 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is
amended to read as follows:
20.08.147 ARCHITECTURAL BUILDING FEATURE.
"Architectural building feature" means a balcony, column, door, eave, roof, soffit,
window or window trim, shutters or other similar three - dimensional permanent exterior
element of a building or structure that may not create interior floor area, that provides
relief from large flat wall planes, breaks up building wall mass, and lends to the overall
form, context and appearance of the building or structure.
SECTION 2. Section 20.08.167 shall be added to Chapter 20.08, Title 20, of the El Segundo
Municipal Code to read as follows:
20.08.167 BED AND BREAKFAST INN.
"Bed and breakfast inn" means any building containing five or fewer guest rooms
intended or designed to be used, or which are used or rented or which are occupied for
sleeping purposes by guests. Said use shall not contain ancillary facilities for conferences
or personal services, but may provide meals. Guest stays shall be limited to 14
consecutive days. One dwelling unit, on any floor level, in conformance with the
requirements of Section 20.32.020 D., shall be allowed for the use of the proprietor of the
bed and breakfast inn.
SECTION 3. Section 20.08.335 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is
amended to read as follows:
20.08.335 DRIVE -THRU RESTAURANT.
"Drive -thru restaurant" means any business establishment, building, or structure
where food or drink are prepared and served for consumption either on or off the premises
by order from or service to persons at an automobile service window, and which may also
include as accessory uses, service to persons over an interior counter, outside the
structure, or from an outdoor service window.
SECTION 4. Section 20.08.440 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is
amended to read as follows:
20.08.440 GREENHOUSE WINDOW.
"Greenhouse window" means a window projecting out from a building wall, typically
with glass on four sides, which does not provide additional floor area.

SECTION 5. Section 20.08.445 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is
amended to read as follows:
20.08.445 GROUP R BUILDINGS.
"Group R Buildings" means all dwelling units, apartments, congregate residences and
hotels and motels, as defined in the Uniform Building Code.
SECTION 6. Section 20.08.683 shall be added to Chapter 20.08, Title 20, of the El Segundo
Municipal Code to read as follows:
20.08.683 RESTAURANT.
"Restaurant" means any business establishment, building, or structure where food or
drink are prepared and served for consumption either on or off the premises, which may
also include as accessory uses, service to persons over an interior counter, outside the
structure, or from an outdoor service window. Any restaurant with an automobile service
window shall be considered a drive -thru restaurant. Any restaurant which is strictly take-
out shall be considered a food -to -go establishment.
SECTION 7. Section 20.12.170 shall be added to Chapter 20.12, Title 20, of the El Segundo
Municipal Code to read as follows:
20.12.170 LANDSCAPING.
A. The goal of this section is to ensure that adequate landscape areas and permanent
irrigation facilities are provided for all new development. The area extending
between a building(s) and property lines shall contain both soft (plantings) and
hard (rock, brick, concrete) landscape materials, except for those portions devoted
to vehicular parking and loading. The purpose of these landscape areas are:
1. To reduce the emphasis of visual impact by careful placement of roads,
parking lots, and truck loading areas, and by screening these from view,
while maintaining visual security around properties;
2. To emphasize pedestrian and bicycle access and circulation, especially
between and around roads and buildings and ensure conformance with
corner and driveway clearances in Chapter 20.12, General Provisions;
3. To accommodate walkways with treatments such as rest areas, landscape
buffers, courts, and canopies accented with street furnishings and
pedestrian -scale lighting;
4. To repeat certain details, with variation, to link buildings into a cohesive
design; and,
5. To reduce the heat gain of parking lots by providing shaded parking.
B. To achieve these purposes, the landscape criteria is divided into three separate
components: Those areas related to Vehicular Use Areas; areas related to
Building Perimeter; and those areas related to the Property Perimeter.

1. Vehicular Use Areas
All surface vehicular use areas (VUA) shall provide landscape areas
including shade trees and permanent irrigation systems, to cover 5% of
the VUA. Landscaping shall be distributed uniformly throughout the
VUA, and shall be in addition to the required property perimeter and
building perimeter landscaping. There shall be 1 tree for every 3,000
square feet of VUA. These trees shall be evenly distributed throughout the
automobile parking area to provide shade and provided around the
perimeter of truck loading /waiting areas to provide screening. Individual
tree and planter areas shall not be less than 3 feet in width, excluding
curbs.
2. Building Perimeter
In those instances where setbacks are provided, all buildings, including
parking structures, shall have landscape areas and permanent irrigation
systems around their perimeter. A minimum horizontal depth of 5 feet of
landscape materials, excluding curbs, shall be provided around the
buildings, except additions to buildings in the rear one -third of a lot, which
do not abut residential property, where landscaping would not be visible
from the public right -of -way need not provide building perimeter
landscaping in the rear. A combination of soft and hard landscape
materials may be installed, provided the use of such materials form a
cohesive, attractive and functional design.
3. Property Perimeter
All required setback areas shall be fully landscaped including permanent
irrigation systems. The landscaping shall incorporate the theme utilized
for the public rights -of -way and one shade tree shall be provided for every
25 feet of street frontage. Parking may encroach into the landscaped
setback up to a maximum of 50% of the required setback area provided a
minimum landscaped setback of 5 feet is maintained. A combination of soft
and hard landscape materials may be installed, provided the use of such
materials will form a cohesive, attractive and functional design. Such
design is to be integrated with and, if appropriate, physically connected to
that provided for the Building and VUA areas.
SECTION 8. Section 20.18.060 of Chapter 20.18, Title 20, of the El Segundo Municipal Code is
amended to read as follows:
20.18.060 SITE DEVELOPMENT STANDARDS.
All uses within the O -S Zone shall comply with the Development Standards contained in
this section.
A. General Provisions
As provided by Chapter 20.12, General Provisions.
B. Lot Area
No minimum requirements.

C. Height
Buildings and structures shall not exceed a height of 26 feet.
D. Setbacks
1. Front yard: The front yard setback shall be not less than the average front
yard setback requirements of abutting properties that have the same street
frontage.
2. Side yard: The side yard shall not be less than the average side yard
setback requirements for those properties which abut the side yard of the
subject property.
3. Rear yard: The rear yard shall not be less than the average rear yard
setback requirements for those properties which abut the rear yard of the
subject property.
E. Lot Frontage
No minimum requirements.
F. Building Area
No maximum floor area ratio requirements.
G. Walls /Fences
Walls and fences shall be located in compliance with the requirements of Chapter
20.12, General Provisions.
H. Lot Coverage
Buildings shall not exceed 40% of the lot area.
SECTION 9. Section 20.20.060 I. of Chapter 20.20, Title 20, of the El Segundo Municipal Code
is amended to read as follows:
I. Building Wall Modulation
Architectural building features, in conformance with Section 20.08.147, must be
included to modulate the building walls subject to the approval of the Director of
Planning and Building Safety.
SECTION 10. Section 20.20.100 shall be added to Chapter 20.20, Title 20, of the El Segundo
Municipal Code to read as follows:
20.20.100 VEHICULAR ACCESS.
Where an R -1 lot abuts an alley, vehicular access to the lot shall be from the alley, except
when 80% or more of the properties on the block have existing vehicular access from the
street. For the purposes of this section, the block is defined as the properties on the same
side of the street between the nearest intersecting streets. Curb cuts and driveways shall
be installed in conformance with Section 20.20.080 and 20.54.050 F., Entrances and
Exits.

SECTION 11. Section 20.22.060 C. of Chapter 20.22, Title 20, of the El Segundo Municipal Code
is amended to read as follows:
C. Lot Area
A minimum of 7,000 square feet. Lots less than 4,000 square feet in area shall be
occupied by only 1 dwelling unit, provided all other requirements of this title are
met.
SECTION 12. Section 20.22.060 D.2. of Chapter 20.22, Title 20, of the El Segundo Municipal
Code is amended to read as follows:
2. Side : Structures shall maintain a minimum setback of 5 feet. Any detached
accessory structures, and attached garages on 25 foot wide lots only, located on the
rear one -third of the lot, are allowed zero setback on one interior side lot line.
SECTION 13. Section 20.22.060 H. of Chapter 20.22, Title 20, of the El Segundo Municipal Code
is amended to read as follows:
H. Building Wall Modulation
1. Lots greater than 4.000 square feet in area: No plane of a building wall
facing a property line shall exceed 24 feet in height or length without at
least a 2 -foot offset for a minimum length of 6 feet in the wall plane. When
expanding or adding onto the height or length of an existing building wall,
only the expansion or addition shall not exceed 24 feet without wall
modulation. Below is an example of wall modulation for walls up to 30 feet:

SECTION 14. Section 20.22.100 shall be added to Chapter 20.22, Title 20, of the El Segundo
Municipal Code to read as follows:

No plane of a building wall facing a property line shall exceed 24 feet in height or
length without at least a 2 -foot offset for a minimum length of 6 feet in the wall
plane. When expanding or adding onto the height or length of an existing building
wall, only the expansion or addition shall not exceed 24 feet without wall

is amended to read as follows:

SECTION 34. Section 20.36.040 of Chapter 20.36, Title 20, of the El Segundo Municipal Code
is amended to read as follows:

The following uses shall be allowed subject to obtaining a conditional use permit, as

A. Catering services and flight kitchens;
B. Drive -thru restaurants;
C. Freight forwarding;
D. Helicopter landing facilities subject to the provisions of Section 20.12.160;

F. On -site sale and consumption of alcohol at bars;
G. Parking facilities, including park and ride lots;
H. Recreational facilities (public and commercial);
I. Service stations;
J. Sexually oriented business, provided it is not located within 500 feet of another
sexually oriented business; and,
K. Other similar uses approved by the Director of Planning and Building Safety, as
provided by Chapter 20.72, Administrative Determinations.
SECTION 35. Section 20.36.070 of Chapter 20.36, Title 20, of the El Segundo Municipal Code
is amended to read as follows:

A. Any use permitted in the MU, CO, C -3, C -2 and C -RS Zones, except residential
uses and sexually oriented businesses;
B. Drive -thru restaurants;

The Planning Commission may reduce the required amount of parking in the SB, MM,
Grand Avenue Commercial and Medium Density Residential Zones up to 10 %.
The Planning Commission may modify the required number of parking spaces based on
the submittal of a parking demand study. Additionally, for any use for which the number
of parking spaces is not listed, the Director of Planning and Building Safety or Planning
Commission shall specify the required number of spaces based on a parking demand
study.
