ORDINANCE 1250ORDINANCE NO. 1250 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING ENVIRONMENTAL ASSESSMENT NO. EA -380 AND ZONE TEXT AMENDMENT NO. ZTA 96 -2, AMENDING THE EL SEGUNDO MUNICIPAL CODE BY AMENDING AND ADDING VARIOUS SECTIONS OF TITLE 20 (THE ZONING CODE), ALL OF WHICH ARE COVERED BY A PREVIOUSLY CERTIFIED ENVIRONMENTAL IMPACT REPORT. PETITIONED BY: HUGHES ELECTRONICS WHEREAS, on December 1, 1992, the City of El Segundo adopted a General Plan for the years 1992 -2011; and WHEREAS, on December 1, 1992, the City of El Segundo certified an Environmental Impact Report as a complete and adequate document in accordance with the authority and criteria contained in the California Environmental Quality Act and the City of El Segundo Guidelines for the implementation of the California Environmental Quality Act and adopted a Statement of Overriding Consideration; and WHEREAS, on February 12, 1996, Hughes Electronics submitted a Zone Text Amendment application requesting approval of provisions for high and medium bay labs and Transfer of Development Rights (TDR's); and WHEREAS, on February 22 and 29 and March 7 and 14, 1996, the Planning Commission did hold a public workshop and three public hearings, respectively, duly advertised pursuant to law, on the proposed Zone Text Amendments to allow provisions for TDR's, a new definition for high and medium bay labs and related Zone Text Amendments, and notice of the hearings was given in the time, form and manner prescribed by law; and WHEREAS, on March 14, 1996, the Planning Commission adopted Resolution No. 2376 recommending to the City Council approval of Environmental Assessment EA -380 and Zone Text Amendment ZTA 96 -2 amending and adding sections to the Zoning Code, with the exception of the provisions for the Transfer of Development Rights; and WHEREAS, on March 13, 1996, the City Council did hold, pursuant to law, a duly advertised public hearing on revisions to the Zoning Code, and notice was given in the time, form and manner prescribed by law and the public hearing was continued until March 18, 19, 21 and 22, 1996; and WHEREAS, opportunity was given to all persons to present testimony or documentary evidence for or against EA -380 and ZTA 96 -2, the revisions to the Zoning Code; and WHEREAS, at said hearings the following facts were established: 1. The proposed revisions for high and medium bay labs will allow the equitable expansion of square footage for the use which requires very large and tall buildings with minimal numbers of employees. NOW, THEREFORE, BE IT ORDAINED that after consideration of the above facts and study of proposed Environmental Assessment EA -380 and Zone Text Amendment ZTA 96 -2, the City Council finds as follows: 1 GENERAL PLAN 1. The provision for high and medium bay labs will allow the expansion of new high and medium bay labs without exceeding the traffic impacts analyzed and certified through the 1992 General Plan. ZONING CODE 1. The proposed revisions for high and medium bay labs will allow the equitable expansion of square footage for the use which requires very large and tall buildings with minimal numbers of employees. ENVIRONMENTAL FINDINGS 1. The City Council previously adopted EA -275 and Ordinance No. 1189 certifying a Final Environmental Impact Report on December 1, 1992 for the 1992 General Plan,finding that the Final EIR was a complete and adequate document properly identifying potential environmental impacts and potential mitigation measures to reduce the identified impacts. The proposed changes in the Zoning Code are not separate, independent land -use actions. They are changes contemplated merely to implement the General Plan. Therefore, the changes are not likely to create any environmental impacts not already considered by the General Plan Final EIR. 2. The City Council hereby determines that the project is covered by the previously certified Environmental Impact Report and the General Plan Program EIR adequately describes the proposed project for the purposes of complying with the California Environmental Quality Act (CEQA). 3. That when considering the whole record, there is no evidence that the project will have the potential for an adverse effect on wildlife resources or the habitat on which wildlife depends. 4. That within 10 days following the final adoption of the Zone Text Amendments by the City Council, the City shall file a De Minimus Finding with the County of Los Angeles Recorders Office, pursuant to AB 3158 and the California Code of Regulations and shall file a Notice of Exemption, pursuant to the California Environmental Quality Act. Until appropriate notices are filed with the County of Los Angeles, the project shall not be deemed to be vested and no permits may be issued. NOW, THEREFORE, BE IT FURTHER ORDAINED THAT the City Council hereby approves EA -380 and ZTA 96 -2, and adopts changes to the El Segundo Municipal Code as follows: SECTION 1. Section 20.08.415 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is amended to read as follows: 20.08.415 FLOOR AREA (GROSS). "Floor area (gross)" is the area included within the surrounding exterior walls of a building or portion thereof, exclusive of garages, vent shafts and courts. The floor area of a building, or portion thereof, not provided with surrounding exterior walls shall be the usable area under the horizontal projection of the roof or floor above. SECTION 2. Section 20.08.420 of Chapter 20.08, Title 20, of the El Segundo Municipal Code is amended to read as follows: 2 "Floor area (Net)" means the area of all floors or levels included within the exterior surrounding walls of a building or structure. The total space devoted to high or medium bay labs, in the M -1 Zone only, may be multiplied by a factor of 0.5 to determine the net floor area. Space devoted to the following shall not be included when determining the total net floor area within a building or structure: A. Elevator shafts; B. Stairwells; C. Courts or atriums uncovered and open to the sky; D. Rooms exclusively holding building operating equipment; E. Parking spaces at or above grade and access thereto, provided that in commercial and manufacturing zones: 1. Not less than the front 50% of the ground floor is devoted to commercial/manufacturing use; and, 2. At least one full level of parking below grade is provided. F. Structures devoted exclusively to parking. SECTION 3. Section 20.08.467 shall be added to Chapter 20.08, Title 20, of the El Segundo Municipal Code to read as follows: 20.08.467 HIGH AND MEDIUM BAY LABS. "High and medium bay labs" means any establishment, building or structure, or portion thereof, used for the assembly, packaging, fabrication, testing and processing of materials into large and bulky finished products, such as spacecraft. The process may also include the research and development and prototype production of a product. The interior of the building, or portion thereof used for high and medium bay labs, shall be a minimum of 20 feet in height as measured from the floor to the lowest projection. The number of employees per square foot of net floor area shall not exceed 1 per 1000. SECTION 4. Section 20.40.020 of Chapter 20.40, Title 20, of the El Segundo Municipal Code is amended to read as follows: 20.40.020 PERMITTED USES. The following uses are permitted in the M -1 Zone. A. Fiberglass products, continuous filament lamination of; B. General offices and establishments for research, professional and technical services; C. General storage, warehousing and mini - storage; D. High and medium bay labs; E. Light manufacturing uses and related offices; 3 F. Manufacturing and assembly of electrical appliances, electronic instruments and devices, radios and phonographs, including the manufacturing of small tools and parts such as coils, condensers, transformers, crystal holders, etc.; G. Manufacturing of cleaning agents, waxes and finishes; H. Manufacturing of cutlery, hardware, and hand tools and kitchen utensils; I. Manufacturing processing and packaging of pharmaceuticals, drugs, toiletries and cosmetics, except soap; J. Public facilities, including, but not limited to, fire and police facilities, post offices, and libraries; K. Public utilities, including, but not limited to, power substations and telephone exchanges; L. Recreation facilities (public and private); M. Restaurants, coffee shops and cafes; and, N. Other similar uses approved by the Director of Planning and Building Safety, as provided by Chapter 20.72, Administrative Determinations. SECTION 5. Section 20.40.060 F. of Chapter 20.40, Title 20, of the El Segundo Municipal Code is amended to read as follows: SECTION 6. Mayor Carl Jacobson and Councilman Michael Robbins did abstain from and did not participate in the deliberations and decision on these Zone Text Amendments. 4 SECTION 7. This ordinance shall become effective at midnight on the thirtieth (30) day from and after the final passage and adoption hereof. SECTION 8. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a note of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within 15 days after the passage or adoption thereof cause the same to be published or posted in accordance with the law.
