ORDINANCE 1248ORDINANCE NO. 1248 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 2, CHAPTER 29 OF THE EL SEGUNDO MUNICIPAL CODE BY ADDING SECTION 2.29.025 ENTITLED "POLITICAL ACTIVITY WHILE IN UNIFORM ", SECTION 2.29.055 ENTITLED "POLITICAL ACTIVITY WHILE IN UNIFORM - NONMERIT SYSTEM EMPLOYEES ", SECTION 2.29.060 ENTITLED "SOLICITATION OF POLITICAL CONTRIBUTIONS" AND SECTION 2.29.070 ENTITLED "SOLICITATIONS - ALL OFFICERS AND EMPLOYEES." THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. A new section 2.29.025 of Chapter 29 of Title 2 of the El Segundo Municipal Code is hereby added to read as follows: "2.29.025 POLITICAL ACTIVITY WHILE IN UNIFORM. No officer or employee of the city whose position is covered by the personnel merit system shall participate in political activities of any kind while in uniform." SECTION 2. A new section 2.29.055 of Chapter 29 of Title 2 of the El Segundo Municipal Code is hereby added to read as follows: "2.29.055 POLITICAL ACTIVITY WHILE IN UNIFORM - NONMERIT SYSTEM EMPLOYEES. No officer or employee of the city enumerated in Section 2.29.030 shall participate in political activities of any kind while in uniform." SECTION 3. A new section 2.29.060 of Chapter 29 of Title 2 of the El Segundo Municipal Code is hereby added to read as follows: "2.29.060 SOLICITATION OF POLITICAL CONTRIBUTIONS (a) An officer or employee or indirectly, solicit a officer or employee of the employment list of the city, from whom the contribution employee of the city. of the city shall not, directly )olitical contribution from an city, or from a person on an with knowledge that the person is solicited is an officer or (b) A candidate for elective office of the city shall not, directly or indirectly, solicit a political contribution from an officer or employee of the city, or from a person on an employment list of the city, with knowledge that the person from whom the contribution is solicited is an officer or employee of the city, or is a person on an employment list of the city. (c) This section shall not prohibit an officer or employee of the city, or a candidate for elective office in the city, from requesting political contributions from officers or employees of the city if the solicitation is part of a solicitation made to a significant segment of the public which may include officers or employees of the city. (d) Violation of this section is punishable as a misdemeanor. The district attorney shall have all authority to prosecute under this section. (e) For purposes of this section, the term "contribution" shall have the same meaning as defined in Section 82015 of the California Government Code, as may be amended from time to time." SECTION 4. A new section 2.29.070 of Chapter 29 of Title 2 of the El Segundo Municipal Code is hereby added to read as follows: "2.29.070 SOLICITATIONS - ALL OFFICERS AND EMPLOYEES The provisions of Section 2.29.060 shall apply to every officer and employee of the city who is compensated for a full -time or part -time basis whose position is permanent or temporary, includina elected officials, members of the planning commission, members of the recreation and parks commission and employees whose positions are covered by the personnel merit system and are regulated by Sections 2.29.010 and 2.29.020." SECTION 5. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance or any part thereof. SECTION 6. The City Clerk shall certify to the adoption of this Ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a notice of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within 15 days after the passage or adoption thereof cause the same to be published or posted as required by law.
