AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA AMENDING CHAPTER
3.12 OF THE EL SEGUNDO MUNICIPAL CODE TO ADD
A NEW SECTION 3.12.160 AUTHORIZING TAX CREDIT
AGREEMENTS.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DOES ORDAIN AS
FOLLOWS:
SECTION 1. The City Council of the City of El Segundo does
hereby determine and find as follows:
A. It is in the best interests of the City to encourage
development of commercial hotel, particularly "all suites"
hotels, which have higher daily rates, longer term occupancies,
and generate a higher level of transient occupancy tax to be used
for the benefit of the general fund of the City; and
B. It is in the public interest and to the benefit of the
general public to encourage the development of "all suites"
hotels and for the City to provide incentives for the development
of such hotels in circumstances where they would not otherwise
locate within city boundaries.
SECTION 2. The City Council does hereby add a new Section
3.12.160 of Chapter 3.12 of the E1 Segundo Municipal Code to read
as follows:
113.12.160 TAX CREDIT AGREEMENTS.
(a) The City Council is hereby authorized to enter
into tax credit agreements to facilitate development of an "all
suites hotel" or other unique hotel which is not in significant
direct competition with hotels already located within city
boundaries and would not locate in the City of E1 Segundo in the
absence of a tax credit or other incentive. No credit granted
under this section shall be granted in excess of five (5) years
nor shall any credit be granted in excess of 100% of the total
transient occupancy tax assessed.
(b) The tax credit agreements authorized hereunder may only
be entered into with proposed hotels which are not in significant
direct competition with existing or approved hotels as determined
by the City Council and as limited by any agreement allowing for
such tax credit. The tax credit agreement may only be entered
into with a proposed development if it is clear to the City
Council that in the absence of the tax credit agreement the
project would not otherwise be built in E1 Segundo.
(c) The term "all suites hotel" shall mean a hotel which
has separate sitting rooms and bathrooms with the smallest unit
being no less than 500 square feet and full kitchens which
include refrigerator, range and oven other than microwave ovens.
SECTION 3. The City Clerk shall publish or post the ordi-
nance according to law. This ordinance shall go into effect
immediately.

hereby certify that the foregoing Ordinance No. 1215 was regu-
larly introduced and placed upon its first reading at a regular
meeting of the City Council on the 21st day of December, 1993.
That thereafter, said Ordinance was duly adopted and passed at a
regular meeting of the City Council on the 4th day of January,
1994, by the following vote, to wit:
