AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
• OF EL SEGUNDO AMENDING THE EL SEGUNDO MUNICI-
PAL CODE BY ADDING THERETO A NEW CHAPTER
12.10 DECLARING THE CITY'S INTENT TO PROVIDE
FOR THE SWEEPING OF CITY STREETS AND PROVID-
ING FOR THE IMPOSITION OF FEES FOR SUCH
SWEEPING.
WHEREAS, the health and welfare of the citizens of the City
of E1 Segundo require the regular sweeping of streets within the
City; and
WHEREAS, meeting the City's National Pollution Discharge
Elimination System (NPDES) permit requires measures such as
street sweeping to ensure that the discharge of storm water from
El Segundo into the Santa Monica Bay is within established
standards for water quality; and
WHEREAS, after studying the situation and various alterna-
tives, the City Council has determined to require sweeping of all
streets of the City; and
WHEREAS, the City Council has determined that it is essen-
tial to allow for the levy of fees to ensure the continued
provision of the vital service of street sweeping in E1 Segundo;
and
WHEREAS, upon reviewing existing taxes and fees levied by
the City of E1 Segundo, the City Council has determined that
street sweeping fees should not be levied on non - residential
properties because these properties and their tenants already pay
indirectly for the service through business license and utility
user taxes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO
DOES ORDAIN AS FOLLOWS:
SECTION 1. Chapter 12.10 is hereby added to Title 12, of
the El Segundo Municipal Code to read as follows:

Chapter 12.10
12.10.010 INTENT TO SWEEP CITY STREETS
It is the City's intent to sweep all streets of the City at
least once per week, provided that such street is clear of
vehicles or other obstructions to sweeping in accordance with the
provisions of this chapter and of subsequent resolutions that may
be adopted from time to time by the City Council.
12.10.020 REQUIRED USE OF CITY PROVIDED SWEEPING SERVICE
All properties of the City shall be required to use the
street sweeping service provided by the City.
12.10.030 FEES TO BE CHARGED TO ALL RESIDENTIAL PROPERTIES
IN CITY
• Inasmuch as fees are to be charged for the sweeping of
streets, it is necessary that such fees be charged to the occu-
pants or owners of each residential property.
12.10.040 APPLICATION FOR WAIVER
Notwithstanding paragraphs 1, 2, and 3, an occupant or owner
of a property may apply for a waiver of the requirements of this
section by presenting in writing the reasons therefor to the City
Director of Finance. The Director of Finance shall respond in
writing to such request within a reasonable period after its
receipt, granting or denying the waiver. His decision shall be
final.
12.10.050 RATES TO BE ESTABLISHED BY RESOLUTION OF CITY
COUNCIL
The City Council may establish rates for street sweeping
fees to be imposed by a resolution of its body and may change or
adjust these rates from time to time by resolution.
12.10.060 Lifeline Rates - Senior Citizens and Handicapped
A senior citizen and handicapped lifeline rate of 50% of the
rate established by City Council resolution shall apply to those
households meeting the criteria established for eligibility for
the City's water lifeline rate.
SECTION 2. This ordinance shall become effective immediate-
ly upon final passage and adoption hereof.
SECTION 3. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in
the book of original ordinances of said city; shall make a minute
of the passage and adoption thereof in the records of the meeting
at which the same is passed and adopted; and shall post the same
in the time and manner provided by law.

Councilman Switz.
