ORDINANCE 1199ORDINANCE NO. 1199 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA AMENDING ORDINANCE NO. 758 GRANTING TO SHELL OIL COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE OF THE RIGHT FOR A PERIOD NOT TO EXCEED TWENTY -FIVE: YEARS FROM THE GRANTING THEREOF TO LAY, CONSTRUCT, INSTALL, OPERATE, MAINTAIN, RENEW, REPLACE, ABANDON IN PLACE, ONE EXISTING SIX (6) INCH PIPELINE FOR THE TRANSPORTATION OF OIL, GAS, GASOLINE, PETROLEUM, WET GAS, LIQUID HYDROCARBON PRODUCTS, WATER, WASTE WATER, MUD, AND /OR STEAM, WITHIN CERTAIN PUBLIC STREETS, HIGHWAYS, ALLEYS, AND OTHER PUBLIC WAYS IN SAID CITY. WHEREAS, on March 22, 1971 the City of El Segundo City Council (City) approved Ordinance No. 758 to grant to Shell Oil Company (Shell Oil) a franchise for twenty -five (25) years to operate a pipeline in the City streets; and WHEREAS, Ordinance No. 758 requires that Shell Oil shall not sell, transfer or assign this franchise without the consent of the City Council; and WHEREAS, Shell Oil has requested City Council approval for selling its Ventura Products Pipeline which is the subject of Ordinance No. 758 to Shell Oil's affiliate Shell California Pipeline Company (Shell California), a State of California Public Utility; and WHEREAS, Shell Oil has requested City Council approval for assigning its rights and privileges to Shell California; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. The request by Shell Oil to sell its pipelines and assign its rights and privileges granted under Ordinance No. 758 to Shell California is hereby approved. SECTION 2. The word "Grantee" used in Ordinance No. 758 shall be deemed to mean Shell California Pipeline Company. SECTION 3. Shell Oil shall pay a one -time franchise transfer fee of $2,500 within thirty (30) days from the effective date of this Ordinance. SECTION 4. All provisions of Ordinance No. 758 which are not inconsistent with the provisions of this Ordinance shall continue in full force and effect. SECTION 5. The Mayor shall sign this Ordinance. The City Clerk shall certify to the passage and adoption of this Ordinance; shall cause the same to be entered in the book of original Ordinances of the City; shall make a minute of the passage and adoption thereof in the records of the meeting of the City Council at which the same is passed and adopted; and shall post the same in the time and manner provided by law. This Ordinance shall become effective thirty (30) days after its adoption. PASSED AND APPROVED this 6th day of 1 1993.
