AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO, CALIFORNIA TO AMEND SECTION
9.04 OF THE CITY OF EL SEGUNDO MUNICIPAL CODE
TO PROVIDE FOR USE OF COUNTY TAX BILLS TO
COLLECT UNPAID NUISANCES ABATEMENT COSTS.
WHEREAS, Municipal Code Section 9.04 presently provides
that for the City to collect any unpaid bills for City costs of
abating nuisances that the City must record a lien against the
property for which the abatement costs occurred and the City
Attorney must then file a foreclosure action to collect the bill.
WHEREAS, State of California Government Code Section
39500 et. seq. provides that Cities may use the County Annual
Property Tax Bill to collect such abatement charges.
WHEREAS, the use of said Government Code Section 39500
et. seq. appears to require less administrative and litigation
effort and resultant costs to the City.
NOW, THEREFORE, the City Council of the City of El
Segundo does ordain as follows:
SECTION 1. Adopt this Ordinance to amend Section
9.04.190 to the City of E1 Segundo Municipal Code to read as
follows:
9.04.190 FAILURE TO ABATE - LIEN. If after
the expiration of the time allowed, after the
hearing on the order to show cause the
nuisance has been abated, the City Council
may order the necessary work to be done to
correct the objectionable condition
complained of and the cost of the work,
including material, labor and incidental
expenses shall constitute a lien against the
property on which the nuisance is located or
was located prior to abatement by the City.
The City may elect to either:
a. Direct the City Attorney to prepare
and record in the office of the
County Recorder or other proper
public office an instrument
claiming such lien on behalf of the
City, the lien to be foreclosed and
the amount thereof collected in the
same manner and under the same
procedure as provided for the
foreclosure of mortgages on real
property under the provisions of
the Code of Civil Procedure of the
State. (Ord. 440).
b. Direct the Director of Finance to
prepare and submit to the County of
Los Angeles Department of Auditor -
Controller a bill amount to be
added to the County of Los Angeles
Tax Bill as allowed by State
Government Code Section 39500 et
seq.

SECTION 2. The City Clerk shall certify to the passage
and adoption of this Ordinance; shall cause the same to be
entered in the book of original Ordinances of the City; shall
make a minute of the passage and adoption thereof in the records
of the meeting of the City Council at which the same is passed
and adopted; and shall publish the same in the time and manner
provided by law.
