ORDINANCE 1186ORDINANCE NO. 1186 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING THE UNIFORM FIRE CODE, 1991 EDITION, INCLUDING APPENDICES I -A, I- C, II -B, III -A, III -B, III -C, III -D, IV -B, V -A, VI -A, AND VI -B, ADOPTING NATIONAL FIRE CODES, VOLUMES i THROUGH 11, 1991 EDITION, REPEALING EXISTING CHAPTER 17.04 IN ITS ENTIRETY, AND ADOPTING A NEW CHAPTER 17.04 WHICH CHAPTER RELATES TO THE FIRE CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 17.04 of the El Segundo Municipal Code is repealed. SECTION 2. Adoption of Uniform Fire Code. For the purpose of prescribing regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, the City Council of the City of El Segundo hereby adopts by reference, pursuant to Government Code Section 50020 et seq., the Uniform Fire Code, 1991 Edition, including Appendices I -A, I -C, II -B, III -A, III -B, III -C, III -D, IV -B, V -A, VI -A and VI -B promulgated and published by the Western Fi:•e Chiefs Association and the International Conference of Building Officials. Said Uniform Fire Code is adopted and incorporated with the same force and effect as through set out herein in full, subject to the modifications, deletions and additions set forth in Sections 3 and 4 of this Ordinance. as follows: SECTION 3. Chapter 17.04 is added to the El Segundo Municipal Code to read "CHAPTER 17.04 FIRE CODE 17.04.010. ESTABLISHED. The Uniform Fire Code, 1991 Edition, including Appendices I -A, I -C, II -B, III -A, III -B, III -C, III -D, IV -B, V -A, VI -A, and VI -B, promulgated and published by the Western Fire Chiefs Association and the International Conference of Building Officials, of which Code one copy has been filed in the office of the City Clerk, is hereby adopted with the same force and effect as though set out herein in full. 17.04.020. AMENDMENTS AND ADDITIONS TO THE CODE. The Uniform Fire Code is amended by amending, adding and deleting the articles, sections and portion of sections designated in Sections 17.04.030 through 17.04.490. 17.04.030. Section 2.105. AMENDED. Section 2.105 of said Uniform Fire Code is amended to read as follows: "Authority of Fire Personnel to Exercise Powers of Peace Officers. Section 2.105(a). The Chief and his designated representatives shall have powers of peace officers in performing their duties with respect to the prevention, suppression and investigation of fires or hazardous material incidents and the protection and preservation of life and property, against the hazards of fire and hazardous materials, and in enforcing all the related codes of the City of El Segundo. (b) The Chief, or his designated representatives, may issue citations for violations of this Code, of the Regulations authorized by this Code and of the Standards as set forth in Section 2.304 and Appendix V -A of this Code." 17.04.40 Section 2.203. AMENDED. Section 2.203 of said Uniform Fire Code is amended to read as follows: "Investigations. Section 2.203. The fire department is authorized to investigate promptly the cause, origin and circumstances of each and every fire occurring in the jurisdiction involving loss of life or injury to person or destruction or damage to property and, if it appears to the bureau of investigation that such fire is of suspicious origin, they are authorized to take immediate charge of all physical evidence relating to the cause of the fire and are authorized to pursue the investigation to its conclusion. Section 2.203(a). When there is a hazardous materials incident or other The National Fire Codes, Volumes 1 through 11, 1991 Edition, published by the National Fire Protection Association, a national authority and technical and scientific organization, which Volumes, are adopted by reference as part of this Code and may be applied with the same force and effect as though set out herein in full. Where conflict exists between the Uniform Fire Code, Uniform Building Code, Uniform Fire Code Standards or Uniform Building Code Standards and the National Fire Codes, the applicable Uniform Code section will take precedence over the National Fire Code. In no case shall a less restrictive requirement of the National Fire Code apply if there is a specific requirement in a Uniform Code or Codes. The following Standards and those in Appendix V -A, other than the National Fire Code, are intended for use as a guide in the design, fabrication, testing and use of equipment regulated by this Code. The Standards listed in Section 2.304(b) of said Uniform Fire Code are adopted as written." 17.04.80 Section 3.105. ADDITION. Section 3.105 is added to Article 3 of said Uniform Fire Code to read as follows: "Responsibility. Section 3.105. Any person who personally or through another willfully, negligently, or in violation of law sets a fire, allows a fire to be set, or allows a fire kindled or attended by him to escape from his control, allows any hazardous material to be handled, stored or transported in a manner not in accordance with this Code or nationally recognized Standards, allows any hazardous material to escape from his control, neglects to properly comply with any written notice of the Chief, or willfully or negligently allows the continuation of a violation of this Code and amendments thereto is liable for the expense of fighting the fire or for the expenses incurred during a hazardous materials incident, and such expense shall be a charge against that person." 17.04.90 Section 4.108. ADDITIONS. Subsection f.3, L4 and L5 of Section 4.108 of said Uniform Fire Code are renumbered Subsection L4, L5 and L6 respectively and new Subsections L3 and h.4 are added to Section 4.108 to read as follows: "L3. Fire Sprinkler Supervision. When supervision is required by Section 10.508 a permit shall be required for one of the following: A. Central Station- Provider shall have a Fire Department permit to monitor systems in the City. B. Proprietary -Owner shall have a Fire Department permit for all systems under his ownership." "h.4. Helistop. To operate a helistop." 17.04.100 Section 4.108. AMENDED. Subsections h.3, 1.1 and m.1 of Section 4.108 of said Uniform Fire Code are amended to read as follows: "h.3. High -Piled Combustible Storage. To use any building or portion thereof exceeding 2,500 square feet for the storage of high -piled combustible materials. A letter describing the type and amount of material to be stored and the method of storage, the fire protection proposed plus a floor plan showing the dimension and location of the stock piles and aisles shall be submitted with applications for such permits. See Article 81." "1.1. Liquified Petroleum (lases. Except for portable containers of less than 59 gallon aggregate water capacity, to store, handle, transport on site, or use liquified petroleum gases in containers or tanks, to install or maintain any LP -gas. The installer or operator shall submit plans for such permits. See Article 81. A permit is required to dispense or to fill portable containers with liquified petroleum gases. No permit shall be required for any tank which is an integral part of a motor home or other vehicle and has been installed in accordance with national standards." "m. 1. Magnesium. To melt, cast, heat treat, machine or grind more than 10 pounds per working day or to store in excess of 100 pounds of chips, turnings or other fines, or more than 100 cubic feet of larger pieces or scraps. See Article 48." 17.04.110 Section 4.109. ADDITION. Section 4.109 is added to Article 4 of 3 said Uniform Fire Code to read as follows: "New Permits Required. Section 4.109. The City Manager, the Chief of the Fire Department and the Fire Marshal shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any materials, processes or occupancies, which shall require fire permits, in addition to those now enumerated in the Code. The Fire Marshal shall maintain a list in his office, and distribute copies thereof to interested persons." 17.04.120 Section 9.108. ADDITION. A definition of "FUMIGATOR" is added to Section 9.108 of said Uniform Fire Code to read as follows: "FUMIGATOR shall mean any person licensed by the Structural Pest Control Act as an Operator, or as a Structural Pest Control Field Representative, who shall have been qualified by the State of California Structural Pest Control Board in the group or groups of Pest Control to be utilized." 17.04.130 Section 10.301. AMENDED. Subsection (a) of Section 10.301 of said Uniform Fire Code is amended to read as follows: "Premises Identification. Section 10.301(a). General. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background. Buildings set back over 100 feet from the street shall have their addresses posted at the street with an arrow indicating access as well as the address posted on or next to the building. Large buildings and complexes require a directory map at a location determined by the Chief. Plans for such shall be approved by the Fire Department prior to installation ". 17.04.140 Section 10.403. AMENDED. Section 10.403 of said Uniform Fire Code is amended to read as follows: "Fire Hydrants. Section 10.403. The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises or both to be protected as required and approved by the Chief. Fire hydrants shall be accessible to the fire department apparatus by roads meeting the requirements of Division II. No more than one on -site fire hydrant shall be installed on a dead end main. Where fire sprinklers are not otherwise required, the Chief may accept or require fire sprinkler protection in lieu of the above on -site hydrants and mains. For fire safety during construction, alteration or demolition of a building, see Section 87.103(c)." 17.04.150 Section 10.501. AMENDED. Subsection (b) of Section 10.501 of said Uniform Fire Code is amended to read as follows: "(b) Special Hazards. For occupancies of an especially hazardous nature or where special hazards exist in addition to the normal hazard of the occupancy, or where access for fire apparatus is unduly difficult, or where hazardous obstructions to building access such as sharp metal ribbon exist, the Chief is authorized to require additional safeguards consisting of additional fire appliance units, more than one type of appliance, on -site fire hydrants and fire flows or special systems suitable for the protection of the hazard involved. Such devices or appliances may consist of automatic fire alarm systems, automatic sprinkler or water spray systems, standpipe and hose, fixed or portable fire extinguishers, suitable fire retardant type blankets, breathing apparatus, manual or automatic covers, or carbon dioxide, foam or dry chemical or other special fire extinguishing systems. Halon extinguishing systems shall not be used to fulfill this requirement. Where such systems are provided, they shall be designed and installed in 4 accordance with the applicable Uniform Fire Code Standards, the rules and regulations of the California State Fire Marshal, and/or the standards of the National Fire Protection Association." 17.04.160 Section 10.508. AMENDED. Section 10.508 of said Uniform Fire Code is amended to read as follows: "Section 10.508(a). All valves controlling the water supply for automatic sprinkler systems and water -flow switches on all sprinkler systems shall be electrically supervised when the number of sprinklers are: (1) Twenty or more in Croup I, Division i Occupancies. (2) One hundred or more in all other occupancies. (b) Valve supervision and water -flow alarm and trouble signals shall be distinctly different and shall be automatically transmitted to an approved central station, remote station or proprietary supervising station as defined by national standards, or, when approved in writing by the building official with the written concurrence of the Chief, sound an audible signal at a constantly attended location. EXCEPTION: Underground key or hub valves in roadway boxes provided by the municipality or public utility need not be supervised. (c) Where buildings are required to be equipped throughout with a sprinkler system and an alarm system, they shall be interconnected so that a water flow signal will activate the alarm system. (d) For permits required for central station and proprietary systems, see Section 4.108 L3." 17.04.170 Section 10.509. AMENDED. Subsection (e) of Section 10.509 of said Uniform Fire Code is amended to read as follows: "(e) The Chief may approve the installation of other approved automatic fire - extinguishing systems to protect special hazards or occupancies in lieu of automatic sprinklers. Whenever sprinklers are omitted in a room or area of a building required to be equipped throughout with such system, other approved automatic fire- extinguishing systems shall be installed in that room or area." 17.04.180 Section 10.510. ADDITION. Subsection (c) of Section 10.510 of said Uniform Fire Code is amended to read as follows: Section 10.510 (c) Location of Class I Standpipes. There shall 17.04.190 Section 11.104. ADDITION. Section 11.104 is added to Article 11, Division I, of said Uniform Fire Code to read as follows: "Fire Safety Officers. Section 11.104. When, in the opinion of the Chief, it is necessary for the preservation of life or property, due to the hazardous nature of an event, production, operation or function, he shall require the owner, agent, or lessee to employ or cause the employment of one or more fire safety officers, to be on duty at such place during the hazardous activity. See also Section 25.117." 17.04.200 Section 13.202. AMENDED. Section 13.202 of said Uniform Fire Code is amended to read as follows: "Section 13.202. In the event a fire occurs or the discovery of a fire, smoke or unauthorized release of flammable or hazardous materials on any property occurs, the owner or occupant shall immediately report such condition to the El Segundo Fire Department." 17.04.2 10 Section 14.103. AMENDED. Subsection (e) of Section 14.103 of said Uniform Fire Code is amended to read as follows: "Section 14.103(e). Certification. The permittee shall provide written certification to the Chief that the system has been installed, such certification shall be submitted prior to or at the beginning of the acceptance test. There will be no test without the certification." 17.04.220 Section 14.104. AMENDED. Subsection 3 and Subsection 6 of Section 14.104(8) of said Uniform Fire Code are amended to read as follows: "3. Smoke Detectors. Fire alarm system type smoke detectors shall be provided in all common areas and interior corridors serving as a required exit for an occupant load of 10 or more." "6. Single- station detectors. Approved single- station smoke detectors shall be installed in dwelling units and hotel or lodging house guest rooms in accordance with the Building Code. Such detectors shall not be connected to the fire alarm system. All detectors in guest rooms shall be annunciated at the reception desk or as approved by the Chief. The requirement in this Subsection is applicable to new hotels and motels." 17.04.230 Section 14.105. AMENDED. Section 14.105 of said Uniform Fire Code is amended to read as follows: "Section 14.105. When required by the chief, fire alarm systems shall be supervised by an approved central, proprietary or remote station service, or a local alarm which will give audible and visual signals at a constantly attended location. All fire alarm monitoring equipment shall be State Fire Marshal listed or equivalent." 17.04.240 Section 24.306. ADDITION. Section 24.306 is added to Article 24, Division III of said Uniform Fire Code to read as follows: "Section 24.306. All high -rise buildings on which construction begins after the date of adoption of this Code shall have an approved emergency helistop on the roof or top floor, unless a written exception request is approved by the Chief." 17.04.250 Section 25.102. AMENDED. Subsection (a) of Section 25.102 of said Uniform Fire Code is amended to read as follows: "25.102(a). Supervision. Places of assembly shall be under the constant supervision of a competent adult on the premises during the time that the premises are open to the public. A sufficient number of employees shall be trained to provide this supervision. If the primary supervisor is absent, an alternate person capable of providing the supervision of the operation shall be present. All employees shall be trained to assist the supervisor to provide assistance for the public to exit from the building in an emergency. Their duties shall include keeping exits clear at all times, and promptly notifying the appropriate public agency of an emergency. New employees shall be provided with this training within 15 days after employment. " 6 17.04.260 Section 29.101. AMENDED. Section 29.101 of said Uniform Fire Code is amended to read as follows: "Section 29.101. Garages used for service or repair of motor vehicles classified as Group B, Division 1, or Group H, Division 4 occupancies shall be in accordance with this article." 17.04.270 Section 29.103. AMENDED. Section 29.103 of said Uniform Fire Code is amended to read as follows: "Flammable and Combustible Liquids. Section 29.103. Flammable and Combustible Liquids. Cleaning, storage, use, and handling of flammable or combustible liquids shall be in accordance with Article 79, Divisions I through IX." 17.04.280 Section 29.104. ADDITION. Subsections (d) and (e) are added to Section 29.104 of said Uniform Fire Code to read as follows: "(d) Open flames. Smoking and open flames shall be prohibited in areas used for servicing internal combustion engines." "(e) Welding. Welding operation shall only be in accordance with Article 49." 17.04.290 Section 35.104. ADDITION. Subsection (h) is added to Section 35.104 of said Uniform Fire Code to read as follows: "(h) UNOCCUPIED TENANT SPACES. Unoccupied tenant spaces shall have automatic fire sprinkler protection as required for occupied spaces." 17.04.300 Section 45.203. AMENDED. Subsection (e) of Section 45.203 of said Uniform Fire Code is amended to read as follows: "Section 45.203(e). Baffles or filters. All booths that are used to apply flammable or combustible materials by spray application shall be equipped with dry filters or baffle plates, constructed of a noncombustible material readily removable or accessible to facilitate cleaning and designed to provide an even flow of air through the booth and to prevent the deposit of overspray before it enters the exhaust duct (see also Section 45.204). Baffle plates or filters shall not be installed in the exhaust ducts. EXCEPTION: Spray booths equipped with a water wash system." 17.04.310 Section 47.112. ADDITION. Section 47.112 is added to Article 47 of said Uniform Fire Code to read as follows: "Storage. Section 47.112. Storage of fumigants and insecticides shall be in accordance with Article 79, if applicable, and Article 80." 17.04.320 Section 79.116. AMENDED. Subsection (f) of Section 79.116 of said Uniform Fire Code is amended to read as follows: "(f) Reinstallation of tanks. Tanks which are to be reinstalled for flammable or combustible liquid service shall be recertified and relabeled by the original listing agency and shall comply with all of the provisions of this article. See Division VI of this article." 17.04.330 Section 79.510. AMENDED. Subsection (c) of Section 79.510 of said Uniform Fire Code is amended to read as follows: "(c). Foam fire protection. Where foam fire protection is required, installation shall be in accordance with U.F.C. Standard No 79 -1." 17.04.340 Section 79.808. AMENDED. Subsection 2 of Section 79.808(a) of said Uniform Fire Code is amended to read as follows: "2. Location. Tank vehicle loading racks dispensing Class I, II, or IIIA 7 liquids shall be separated from tanks, warehouses or other plant buildings, any source of ignition or adjoining property line of a property that can be built upon by a clear distance of 100 feet, measured from the nearest position of any fill stem. This distance may be reduced to 25 feet if loading racks are provided with a fixed fire protection system or are not used for dispensing of Class I or II liquids. Buildings for pumps or for shelter of loading personnel may be part of the loading rack." 17.04.350 Section 79.1006. AMENDED. Subsections (e) and (g) of Section 79.1006 of said Uniform Fire Code are deleted and Subsection (f) of Section 79.1006 is renumbered Section (e). "(e) SPILL CONTROL, DRAINAGE CONTROL AND DIKING. Indoor storage and dispensing areas shall be provided with spill control and drainage control as set forth in Section 79.115. Outdoor storage areas shall be provided with drainage control or diking as set forth in Section 79.507. 17.04.360 Section 80.103. AMENDED. Subsections (b) and (c) of Section 80.103 of said Uniform Fire Code are amended and Subsection (d) is added to Section 80.103 to read as follows: "(b) Hazardous Materials Management Plan. When required by the Chief, each application for a permit shall include all El Segundo Fire Department forms for a Hazardous Materials Management Plan (HMMP)." "(c) Hazardous Materials Inventory Statement. When required by the Chief, each application for a permit shall include all El Segundo Fire Department forms for a Hazardous Materials Inventory Statement (HMIS)." "(d) Emergency Information. Hazardous Materials Business Plans, Risk Management and Prevention Program (when required) and Inventory statements shall be provided in an approved location and immediately available to emergency responders. The Chief may require the information be placed near or at the entrance to the occupancy or property." 17.04.370 Section 80.110. AMENDED. Section 80.110 of said Uniform Fire Code is amended to read as follows: "Section 80.110. The permit holder or applicant shall submit a plan to the fire department to terminate storage, dispensing, handling or use of hazardous materials at least 30 days prior to facility closure. The plan shall demonstrate that hazardous materials which were stored, dispensed, handled or used in the facility have been transported, disposed of or reused in a manner that eliminates the need for further maintenance and any threat to public health and safety. When required by the Chief, the plan shall also include a soils analysis and documentation concerning potential contamination beneath the facility. Such plan shall be submitted in accordance with Section 80.103." 17.04.380 Section 80.301. ADDITION. Subsection (bb) is added to Section 80.301 of said Uniform Fire Code to read as follows: "(bb) Tank Vehicles and Railroad Tank Cars. Tank vehicles and railroad tank cars shall not be used as storage tanks. Loading and unloading operations shall be in accordance with 79.808 and 79.809, unless specifically exempted by the Chief." 17.04.390 Section 81.103. AMENDED. Section 8 1. 103 of said Uniform Fire Code is amended to read as follows: "Section 81.103(a). General. For permits to use buildings for high -piled combustible storage, see Section 4.108. (b) Rack(s). Before they are installed in occupancies regulated by this article, the rack design and calculations must be approved by the building official for loading, structural stability and seismic requirements. An approved fire permit and plot plan must be kept on the premises, and be available for inspection at all times. (c) Owners Statement. When application for above permit is submitted, a statement from the owner must accompany the application giving the information 8 necessary to determine if the building complies with the requirements of this article and the appropriate regulation." 17.04.400 Section 82.102(c). ADDITION. Subsection (e) is added to Section 82.102 of said Uniform Fire Code to read as follows: "(c) Plans shall be submitted prior to the issuance of permits for all stationary tank installations." 17.04.410 Section 82.103(b). AMENDED. Subsection (b) of Section 82.103 of said Uniform Fire Code is amended to read as follows: "(b) Use of LP -gas Containers in Buildings. 1. Portable containers. A. General. Portable LP -gas containers, as defined in U.F.C. Standard No. 82 -1, shall not be used in buildings except as specified in U.F.C. Standard No. 82 -1 and this Subsection. Use of portable cylinders of LPG in buildings is limited to those having a water capacity of 2'A pounds and to fuel tanks as specified herein. EXCEPTION: Cylinders not exceeding 200 pounds aggregate capacity in a room separated from the rest of the building by a one -hour fire separation, having no source of ignition, and having ventilation within 6" of the floor. LPG fuel tanks on motorized equipment are limited to two per vehicle with a combined capacity not to exceed 50 pounds. Refilling shall not be permitted within the building. Exchange of tanks shall be permitted only in an approved location. Approved LPG fired fixed appliances may be used in buildings in accordance with UFC Standard No. 82 -1 and this Article when the storage of the LPG is outside the building." 17.04.420 Section 82.104. ADDITION. Subsection (c) of Section 82.104 of said Uniform Fire Code is amended and Subsections (e) and (f) are added to Section 82.104 to read as follows: "(c) Container Location. Containers shall be located with respect to buildings, public ways, and lines of adjoining property which can be built upon, in accordance with Table No 82.104 -A. At multi- container installations, the aggregate capacity of the containers shall be used to determine minimum distances to buildings or line of adjoining property." "(e) Tank car and tank vehicle bulk loading and unloading stations shall be located not less than one hundred feet from buildings, source of ignition, or line of adjoining property that may be built upon." "(f) Unless special protection is provided and approved by the Chief, containers of liquid petroleum gas shall be oriented so that their longitudinal axis does not point toward other liquid petroleum containers, vital process equipment, control rooms, loading stations or flammable liquid storage tanks." 17.04.430 Section 82.110. ADDITION. Section 82.110 of said Uniform Fire Code is amended to read as follows: "Section 82.110. When exposed to probable vehicular damage due to proximity to alleys, driveways or parking areas, LP -gas containers, regulators and piping shall be suitably protected by crash posts in accordance with Section 80.302(w)." 17.04.440 Appendix IIIC. AMENDED. Subsection (b) of Section 1 of Appendix IIIC of said Uniform Fire Code is amended and Subsection (g) of Section i is added to Appendix IIIC to read as follows: "(b) Testing Personnel. The tests established by this regulation shall be conducted by a qualified person who has been licensed by the State Fire Marshal, to perform the full testing procedure for the particular system or device being tested." "(g) The Chief may waive or modify test procedures described herein when there are conflicts with the requirements of Title 19, Subehapter S of the California Code of Regulations." 17.04.450 Appendix IV -B. CHRISTMAS TREES AMENDED. Section 2 and 4 of Appendix IV -B of said Uniform Fire Code are amended to read as follows: "2. PERMITS. 9 A permit is required for christmas tree sales lots." "4. TAGS. Trees shall bear a tag complying with the California State Fire Marshal requirements, and stating date of placement in the public building, type of flame - retardant treatment used, name of the person who applied the flame retardant and the name of the person affixing the tag." 17.04.460. Establishment of limits of districts in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited. (a) The limits referred to in Section 79.501 and 79.1001 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited, are hereby established as follows: In all land use zones as described in Title 20 (The Comprehensive Zoning Ordinance) of the "El Segundo Municipal Code" except M -2 zoned areas. EXCEPTION: The Fire Chief may approve storage in C -M or M -1 zoned areas. (b) The limits of districts within the City in which new bulk plants for flammable or combustible liquids are prohibited, are hereby established as follows: All of the City. 17.04.470. Establishment of limits of districts in which storage of liquified petroleum gases is to be restricted. The limits referred to in Section 82.104 of the Uniform Fire Code, in which bulk storage of liquified petroleum gas is restricted, are hereby established as follows: In all land use zones within the City as described in Title 20 (The Comprehensive Zoning Ordinance) of the "El Segundo Municipal Code" except M -2 zoned areas. 17.04.480. Establishment of limits of districts in which storage of explosives and blasting agents is to be prohibited. The limits referred to in Section 77.107 of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are hereby established as follows: In all land use zones within the City as described in Title 20 (The Comprehensive Zoning Ordinance) of the "El Segundo Municipal Code" except by special permit granted by the Fire Chief. SECTION 4. Section 17.04.490 is added to Chapter 17.04 of the El Segundo Municipal Code to read as follows: "17.04.490. Penalties. Any person who violates or fails to comply with any of the provisions of this Code hereby adopted, or who violates or fails to comply with any order made thereunder, or who builds in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder and from which no appeal has been taken, or who fails to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, within the time fixed therein, shall for each and every violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine not exceeding five hundred dollars or imprisonment for a term not exceeding six months, or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue. The person or persons responsible shall be required to correct or remedy the violation or defects within a reasonable time. When not otherwise specified, each and every day that prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal or abatement of prohibited conditions." SECTION 5. All changes and modifications in the Uniform Fire Code, 1991 Edition, as amended by this Ordinance, are reasonably necessary because of local conditions. This finding is made pursuant to Section 17958.5 of the Health and Safety Code of the State of California. 10 SECTION 6. The City Council of the City of El Segundo hereby declares that should any Section, Paragraph, Sentence, or Word of the Ordinance or of the said Uniform Fire Code adopted hereby be declared invalid, it is the intent of the Council that it would have passed all other portions of this Ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 7. This Ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION S. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a minute of the Passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of El Segundo and which is hereby designated for that purpose.
