ORDINANCE 1153ORDINANCE NO. 1153 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING THE MUNICIPAL CODE OF THE CITY OF EL SEGUNDO TO ESTABLISH A RELOCATION APPEALS BOARD PURSUANT TO SECTION 33417.5 OF THE HEALTH AND SAFETY CODE; AND DECLARING THIS ORDINANCE TO BE OF NO.FURTHER FORCE AND EFFECT SIX MONTHS AFTER THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City of E1 Segundo is in the process of acquiring land to add to a municipal golf course facility; and WHEREAS, as a part of this acquisition of land which is the only acquisition of land presently contemplated by the City; and WHEREAS, state law requires the City of E1 Segundo to establish a Relocation Appeals Board to hear appeals, if any, on relocation issues in property acquisition matters; and WHEREAS, the City Council of the City of E1 Segundo desires the Relocation Appeals Board be abolished upon completion of the golf course acquisition, which should take place within a period of six months of the effective date of this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of E1 Segundo does hereby find, determine and declare that: A. That Sections 33410 et. sea. of the California Health and Safety Code provide that a city may establish a relocation appeals board; and B. That the City has been involved in limited eminent domain activities which may displace persons who may require relocation assistance; and C. That in order to provide any persons displaced due to eminent domain an opportunity to present their claims and concerns to the City, the City has determined that a Relocation Appeals Board should be established; and D. That the public interest, convenience, and necessity demonstrate that a Relocation Appeals Board should be created. SECTION 2. That Chapter 2.14 be, and hereby is, added to the E1 Segundo Municipal Code as follows: -1- 0- 070390.CA CHAPTER 2.14 RELOCATION APPEALS BOARD 2.14.010 RELOCATION APPEALS BOARD CREATED. Pursuant to Section 33417.5 of the California Health and Safety Code, a Relocation Appeals Board is hereby created. 2.14.020 MEMBERSHIP. The Relocation Appeals Board of this City shall consist of the five (5) members of the City Council. 2.14.030 DUTIES. The Relocation Appeals Board shall hear all disputes relating to relocation activities brought by displaced persons, defined in Section 7260 et seq. of the Government Code. 2.14.040 ORGANIZATION. The Relocation Appeals Board shall elect one of its members as Chairman and one of its members as Vice - Chairman, each of whom shall serve for a term of one year. The Board shall adopt rules for the transaction of its business and shall keep a record of its proceedings, which shall be open for inspection by any member of the public. 2.14.050 MEETINGS. The Relocation Appeals Board shall meet at the same time as the City Council. All such meetings shall be conducted in accordance with the Ralph M. Brown Act. 2.14.060 COMPENSATION. Each member of the Relocation Appeals Board shall be entitled to compensation and expense reimbursement as may be set by the City Council from time to time. 2.14.070 NOTICE AND HEARING. The Relocation Appeals Board shall conduct its hearings and shall carry out its relocation activities in accordance with applicable law. SECTION 3. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 4. This ordinance shall become void, and be of no further force or effect six months after the effective date of this ordinance. SECTION S. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall -2- 0- 070390.CA make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
