ORDINANCE 1144URGENCY ORDINANCE NO. 1144 AN URGENCY ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING THE 1988 EDITIONS OF THE UNIFORM BUILDING CODE, THE UNIFORM BUILDING CODE STANDARDS, UNIFORM PLUMBING CODE, THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE, THE UNIFORM MECHANICAL CODE, AND REPEALING SECTIONS 16.04.110, 16.04.120, 16.04.130 OF CHAPTER 16.04 AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: A. Chapter 16.04 of the E1 Segundo Municipal Code is hereby amended as follows: SECTION 1: Section 16.04.010 is hereby amended in lines 1, 2 and 4 to read "Uniform Building Code 1988 Edition" and "Uniform Building Code Standards 1988 Edition" in lieu of "Uniform Build- ing Code 1985 Edition" and "Uniform Building Code Standards 1985 Edition." SECTION 2: All other sections of Chapter 16.04 with the exceptions of 16.04.110, 16.04.120, 16.04.130 and 16.04.170 are hereby adopted in their entirety as amendments to the 1988 Edi- tions described in Section 1 above. SECTION 3: Chapter 16.04 is hereby amended by deleting therefrom Sections 16.04.110, 16.04.120 and 16.04.130 in their entirety. SECTION 4:Chapter 16.04 is hereby amended by renumbering Section 16.04.170 from "Section 3802 (h) (i) (j) (k)" to "Section 3802 (i) (j) (k) (1) . SECTION 5: (a) Chapter 16.04 is hereby amended by further amending the first paragraph of Section 306(a) of the Uniform Building Code to read as follows: 1116.04.115 Section 306(a) AMENDED - SPECIAL INSPECTOR - GENERAL. In addition to the inspections required by Section 305, the City shall employ one or more special inspectors at the owner's expense who shall provide inspections during construction on the following types of work: (b) This Section 5 shall not be effective or enforced until the City of E1 Segundo has received an opinion from the proper state authorities as to whether or not Section 306(a) of the Uniform Building Code as originally contained in the Uniform Building Code complies with the State Fair Political Practices Act, and the state opinion has been reviewed by the City Council as to implementation of Section 5 as amended." B. CHAPTER 16.12 of the E1 Segundo Municipal Code is hereby amended as follows: SECTION 1: Chapter 16.12.270 is hereby amended by, in lines 1 and 2 to read "The 1988 Edition of the Uniform Plumbing Code including Appendices A, B, C, D, H, I and the 1988 Edition of the Uniform Swimming Pool, Spa and Hot Tub Code" in lieu of "The Uniform Plumbing Code, 1973 Edition including Appendices A, B, C, D, E, F and G ". SECTION 2: All other sections of Chapter 16.12 are hereby adopted in their entirety as amendments of the 1988 Editions described in Section 1 above. C. CHAPTER 16.16 of the E1 Segundo Municipal Code is hereby amended as follows: SECTION 1: Chapter 16.16.010 is hereby amended by, in lines 1 and 2, to read "The Uniform Mechanical Code, 1988 Edition including Appendices A, B, C and D" in lieu of "The Uniform Mechanical Code, 1973 Edition, including Appendices A, B and C ". SECTION 8: All other sections of Chapter 16.16 are hereby adopted in their entirety as amendments to the 1988 Editions described in Section 1 above. D. All changes and modifications in the Uniform Building Code, 1988 Edition, as amended by this ordinance, are reasonably necessary because of local conditions. This finding is made necessary because of local conditions. This finding is made pursuant to Section 17958.5 of the Health and Safety Code of the State of California. E. This urgency ordinance shall become effective immediately upon second reading and adoption. The reason for the urgency are: State law mandates adoption of the 1988 codes by December 31, 1989. F. SECTION 11: The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once n the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose. G. The 1988 Editions of the secondary codes de- scribed in the title to this ordinance are hereby further amended to provide that the City Council may further amend the said codes to comply with existing law and to accommodate local conditions.
