ORDINANCE 1131ORDINANCE NO. 1131 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADDING SECTION 9.06.120 TO CHAPTER 9.06, TITLE 9 OF THE EL SEGUNDO MUNICIPAL CODE, RELATING TO THE USE OF MULTIPLE POLICE RESPONSES TO LARGE GATHERINGS. WHEREAS, City Council is desirous of addressing the problem of multiple police responses to large disorderly crowds at parties; and WHEREAS, multiple police responses deplete the City's ability to handle more pressing calls for service and become an unnecessary burden on the general taxpayers; and WHEREAS, City Council is desirous of having those persons responsible for such events take precautions to prevent such events from occurring, react more quickly to remedy problems when they do occur, and cooperate more readily with police personnel charged with handling these disturbances in order to decrease the necessity for second responses, and be financially responsible for resultant costs and damages. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 9.06.120, Chapter 9.06, Title 9, shall be added to the E1 Segundo Municipal Code to read as follows: "USE OF POLICEMEN AT LARGE PARTIES OR GATHERINGS REQUIRING A SECOND RESPONSE. When a large party or gathering occurs at a premises and a police officer at the scene determines that there is a threat to the public peace, health, safety or general welfare, the person in charge of the premises and the person responsible for the event, or if either of those persons is a minor, then the parents or guardians of that minor, will be held jointly and severally liable for the cost of providing police personnel on special security assignment over and above the services normally provided by the department. The police personnel utilized during a second response after the first warning, to control the threat to the public peace, health, safety or general welfare, shall be deemed to be on special security assignment over and above the services normally provided. The costs of such special security assignment may include minor damages to City property and /or injuries to -1- JOA•O- 010389.PD City personnel. A fee charged will not be in excess of $500 for a single incident. The City reserves its legal options to elect any other legal remedies when said costs or damage exceed $500.11 SECTION 2. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 3. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
