ORDINANCE 1125ORDINANCE NO. 1125 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT (EA -171), AND APPROVING PRECISE PLAN 88 -2 AND SUBDIVISION 88 -6 /VESTING TENTATIVE TRACT MAP 46511, TO ALLOW 19 CONDOMINIUM UNITS AT 526 SIERRA STREET; PETITIONED BY NICK OLAR. WHEREAS, an application has been received from Nick Olar requesting approval of a Precise Plan and Subdivision to allow 19 townhouse condominium units on a 0.067 acre, triangular- shaped site located at 526 Sierra Street in the Residential -3 (R -3) zone; and WHEREAS, the Director of Planning has conducted an Environmental Assessment EA -171 on the proposed Precise Plan and Subdivision, and has circulated the draft Initial Study for interdepartmental comments; and WHEREAS, the Planning Commission has reviewed the Initial Study and supporting evidence in accordance with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines and the City of E1 Segundo Guidelines for the Implementation of the California Environmental Quality Act (Resolution No. 3517); and WHEREAS, at the duly scheduled meeting of the Planning Commission of the City of E1 Segundo on August 25, 1988 a duly advertised public hearing was held on such matter in the Council Chamber of the City Hall, 350 Main Street and opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -171, Precise Plan 88 -2 and Subdivision 88 -6 /Vesting Tentative Tract Map 46511; and WHEREAS, at said hearing the Planning Commission adopted Resolution No. 2222, recommending to City Council the approval of Environmental Assessment EA -171, Precise Plan 88 -2 and Subdivision 88 -6 /Vesting Tentative Tract Map 46511, subject to certain conditions; and WHEREAS, the City Council held, pursuant to law, a duly advertised public hearing on such matters in the Council Chamber of the City Hall, in the City of E1 Segundo on October 4, 1988, and notice of said hearing was given in the time, form and manner prescribed by law; and opportunity was given to all persons to present testimony or documentary evidence for or against the findings of Environmental Assessment EA -171, Precise Plan 88 -2 and Subdivision 88 -6 /Vesting Tentative Tract Map 46511; and WHEREAS, at said hearing the following facts and findings were established: Facts: 1. The existing 29,370 sq.ft. (0.67 acre) site is developed with 11 single story apartment units which would be demolished to accommodate 19 townhouse condominiums. 2. The site is zoned Residential -3 (R -3), which requires 1,500 sq.ft. of lot area per condominium unit. The proposed precise plan and subdivision would create 19 condominium units in conformance with the regulations of the R -3 zone. 3. The areas above the garage comprising the overage in lot coverage are landscaped areas and common walkways for use by the residents. -1- JOA:0- 110188.PL Findings: 1. The proposed project will not have a significant effect on the environment. 2. The proposed subdivision to create condominium ownership, and the design of the proposed precise plan improvements are consistent with the intended General Plan land use designation for multiple family residential use and with the adopted General Plan Citizen Advisory Committee Goals Report. 3. The site is physically suitable for residential townhouse development at the proposed density of one unit per 1,545 sq.ft. of lot area. 4. The design of the Subdivision and Precise Plan improvements adequately provide for public services and are not likely to cause any public health problems. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The City Council hereby approves Environmental Assessment EA -171, Precise Plan 88 -2, and Subdivision 88 -6/ Vesting Tentative Tract Map 46511, subject to the following conditions: 1. The project shall be constructed in substantial compliance with the Site Plan and elevations on file in the Planning Department. Any modification to the project as approved shall be referred to the Director of Planning for a determination regarding the need for Planning Commission review of the proposed modification. 2. Prior to issuance of a building permit, the applicant shall submit a soils report and grading plan for review and approval by the Director of Building Safety. 3. An encroachment permit shall be obtained from the Public Works Department for demolition haul off. The permit must be obtained at the same time the building permit for demolition is issued. An encroachment permit for grading is also required when importing or exporting 50 or more cubic yards of dirt. Demolition and grading may be combined on one encroachment permit. 4. All utility services shall be placed underground. 5. All work in the public right -of -way shall require a public works permit which shall be obtained prior to issuance of a building permit. Work shall be done in accordance with "Standard Specifications for Public Works Construction," latest edition, including any annual supplements thereto. 6. An encroachment permit is required from the Department of Public Works for storage of material in the public right -of -way and shall be allowed only with the approval of the Director of Public Works. 7. The area of construction shall be enclosed by a 6' high security fence, subject to approval by the Director of Public Works. No gates shall open onto the public right -of -way. Pedestrian walkway shall be maintained clear of construction debris at all times. -2- JOA:0- 110188.PL 8. All sewer laterals which are capped during demolition shall be re -used if feasible. Existing laterals which are used shall be in good condition, free of cracks, roots or other damage. All sewer laterals in the public right -of -way shall have a minimum inside diameter of 6" with 6" cleanouts brought to grade at property line with a secure cap with box and cover. 9. Storm water shall be collected and ducted into the storm drain catch basin in the Lomita Street cul -de -sac. 10. Street improvements across the front of property to the centerline of Sierra Street shall be constructed in accordance with the plans approved by the City Engineer. 11. Street signs shall be furnished and installed as required by the Street Maintenance Superintendent. 12. The hours of construction shall be 7:00 a.m. to 6:00 p.m. Monday through Saturday. Construction is prohibited on Sundays and Federal Holidays. 13. A trash receptacle enclosure shall be required. The trash receptacle enclosure shall not be located in any required yard or parking space, shall be fully accessible with adequate ingress and egress, shall be appropriately screened from the public view, and shall be conveniently located for use by all dwelling units. 14. A security lighting plan shall be submitted, reviewed, and approved by the Police Department prior to issuance of a building permit. Lighting fixtures shall be directional and shall not intrude onto adjacent properties. 15. A landscaping plan shall be submitted, reviewed, and approved by the Director of Parks and Recreation and landscaping shall be installed prior to the issuance of a Certificate of Occupancy. 16. All landscaped areas shall be provided with permanent automatic watering facilities. An irrigation plan shall be submitted, reviewed, and approved by the Director of Parks and Recreation and an irrigation system shall be installed prior to the issuance of a Certificate of Occupancy. 17. Standard safety features subject to the approval of the Police Department shall be installed prior to issuance of a Certificate of Occupancy to include dead bolt door locks and an exterior house numbering system in contrast to the exterior paint colors. 18. Prior to issuance of a Certificate of Occupancy, the applicant shall pay to the City of E1 Segundo a one -time police mitigation fee of 10.5 cents per gross square foot of floor area. 19. Prior to issuance of a Certificate of Occupancy, the applicant shall pay a one -time fire mitigation fee of 11 cents per square foot of gross building area to offset the increased demand upon fire protection services. 20. A fire and life safety system subject to the following requirements shall be designed and installed at the applicants expense and plans for said system shall be submitted with the architectural plans or no later than 60 days after a building permit is issued but not less than 30 days prior to starting the specified work. a. A supervised automatic fire sprinkler system for all portions of all structures on site shall be provided. The system shall have approved low temperatures, quick response heads in all -3- JOA:0- 110188.PL residential areas. Or the applicant shall provide full fire sprinklers in all parking, utility, trash, recreational, storage, and stair areas and an on -site fire lane complying with El Segundo Fire Department regulations A -1 -a and on -site fire hydrants off a looped fire service line. b. A supervised manual fire alarm system which will sound an alarm throughout the building dwelling units, garages, storage areas and recreation room shall be provided. 21. A minimum 65 cubic feet of private storage space shall be provided for each dwelling unit, in addition to the storage space provided within the dwelling unit itself. 22. All parking for the project shall be kept free of materials which may impede the use of the parking space for parking and be kept available for occupant use at all times and shall be so described in any legal documents for the unit. 23. Visitor parking spaces shall be designated and shall be physically separated from enclosed resident spaces in order to be readily available and accessible to project visitors. 24. Prior to issuance of a building permit, applicant shall submit a cash deposit in the amount of $11,000.00 acceptable to the Director of Public Works or equivalent bond to be retained by the City for one (1) year from date of completion and acceptance. This money to be used for latent street damage as a result of heavy equipment traffic during construction and demolition. All money not committed at the end of the one (1) year period shall be refunded. 25. Applicant shall submit a plan to the Director of Planning and the Fire Chief for property boundaries that shall be designed to meet concerns of child safety, adjacent property privacy and emergency fire access. Applicant shall meet with surrounding property owners prior to submittal of said wall plan. 26. The top of the finished floor level of the first floor directly above the parking structure shall be no higher than 117' when measured from the 120.8' finished first floor level of the existing adjacent single family residence to the north, in accordance with the overlay drawing signed by the architect and marked Exhibit B. 27. Applicant shall preserve the existing nature eucalyptus tree at the east end of the property and incorporate said tree into the landscape plan required in Condition 15 above. 28. Prior to issuance of a Certificate of Occupancy, applicant shall pay a one -time library mitigation fee of 3 cents per square foot of gross residential building area to offset the increased demand upon library services. 29. In addition to the street and sidewalk improvements required in Condition 10 above, applicant shall improve the west side of Sierra Street with curbing to City Engineer specifications, for a distance not to exceed 170 linear feet. 30. Applicant shall correct the tentative map to reflect the Hyperion Sewer District "and the Lomita Street catch basin" where appropriate subject to the approval of the City Engineer and prior to final map recordation. 31. Applicant shall eliminate the proposed pool from the plans and shall not build a pool or a spa /hot tub facility but shall instead construct, in the same location, and landscape a barbeque, sandbox and picnic lawn area as approved by the Director of Planning. -4- JOA:0- 110188.PL SECTION 2. This ordinance shall become effective at midnight on the thirtieth day from and after the final passage and adoption hereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
