AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING SECTIONS 2.52.060,
2.52.070 AND 2.52.090 OF CHAPTER 2.52, OF THE
EL SEGUNDO MUNICIPAL CODE, WHICH SECTIONS
RELATE TO CONTRACT AND OPEN MARKET BID
PROCEDURES FOR PURCHASES AND SUPPLIES.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. Sections 2.52.060, 2.52.070 and 2.52.090 of
Chapter 2.52, "Purchases and Supplies," of the E1 Segundo
Municipal Code are hereby amended to read as follows:
112.52.060 CONTRACT PROCEDURE. Except as otherwise
provided herein, purchases and contracts for supplies
and equipment of estimated value greater than TEN
THOUSAND DOLLARS ($10,000) shall be by purchase order
or written contract with the lowest responsible bidder,
pursuant to the procedure prescribed herein.
(1) Notice Inviting Bids. Notices inviting bids shall
include a general description of the articles to be
purchased, shall state where bid blanks and specification
may be secured, the dead line time and place for receiving
bids and the time and place for publicly opening bids.
(2) Circulation of Notice. Notice inviting bids shall be
mailed or delivered to not less than three individuals,
firms or corporations dealing in the services, commodities
or supplies described in the notice.
(3) Bidder's Security. When deemed necessary by the
purchasing officer, bidder's security may be prescribed in
the notices inviting bids.
(4) Bid Opening Procedure. Sealed bids shall be submitted
to the purchasing officer and shall be identified as bids on
the envelope. Bids shall be opened in public at the time
and place stated in the notice. A tabulation of all bids
received shall be open for public inspection during regular
business hours for a period of not less than thirty (30)
calendar days after the bid opening.
(5) Rejection of Bids. In its discretion, the city council
may reject any and all bids presented, and after such
rejection may at its discretion request new bids or purchase
on the open market.
(6) Performance Bonds. The city council shall have
authority to require a performance bond and labor and
materials bond before entering into a contract in such
amounts as it shall find reasonably necessary to protect the
best interest of the city. If the city council requires
bonds, the form and amount of the bonds shall be described
in the notice inviting bids.
2.52.070 OPEN MARKET PROCEDURE. Purchases of supplies and
equipment of an estimated value in the amount of TEN
THOUSAND DOLLARS ($10,000) or less may be made by the
purchasing officer in the open market without observing the
procedure prescribed by Section 2.52.060.

(1) Minimum Number of Bids. Open market purchases shall,
wherever possible, be based on at least three bids, and
shall be awarded to the lowest responsible bidder.
(2) Notice Inviting Bids. The purchasing officer shall
solicit bids by written requests to prospective vendors or
by telephone, if more expedient.
(3) Written Bids. Sealed written bids shall be submitted
to the purchasing officer who shall keep a record of all
open market orders and bids for a period of one year after
the submission of bids or the placing of orders. This
record, while so kept, shall be open to public inspection.
2.52.090 PURCHASES UNDER SEVENTY -FIVE HUNDRED DOLLARS.
Purchases of supplies and equipment of an estimated value of
SEVENTY -FIVE HUNDRED DOLLARS ($7500) or less may be made by
the purchasing officer in the open market and without
observing the procedures described in Sections 2.52.060 and
2.52.070."
SECTION 2. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in
the book of original ordinances of said city; shall make a minute
of the passage and adoption thereof in the records of the meeting
at which the same is passed and adopted; and shall within fifteen
days after the passage and adoption thereof, cause the same to be
published once in the E1 Segundo Herald, a weekly newspaper of
general circulation, published and circulated within said City of
E1 Segundo and which is hereby designated for that purpose.

so passed and adopted by the following vote:.
