AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, APPROVING ENVIRONMENTAL
ASSESSMENT EA -163, PRECISE PLAN 88 -1 AND
SUBDIVISION 88 -4 /TENTATIVE TRACT MAP 46345,
TO ALLOW SIX TOWNHOUSE CONDOMINIUM UNITS AT
535 E. WALNUT AVENUE; PETITIONED BY R. JOSEPH
CAPO AND BETTY GARRARD.
WHEREAS, an application has been received from R. Joseph
Capo and Betty Garrard requesting approval of a precise plan and
subdivision to allow six townhouse condominium units on a 0.26
acre, L- shaped site located at 535 E. Walnut Avenue in the
Residential -3 (R -3) zone; and
WHEREAS, the Director of Planning has conducted an
Environmental Assessment EA -163 on the proposed precise plan and
subdivision, and has circulated the draft Initial Study for
interdepartmental comments; and
WHEREAS, the Planning Commission has reviewed the Initial
Study and supporting evidence in accordance with the authority
and criteria contained in the California Environmental Quality
Act, State CEQA Guidelines and the City of E1 Segundo Guidelines
for the Implementation of the California Environmental Quality
Act (Resolution No. 3517); and
WHEREAS, at the duly scheduled meeting of the Planning
Commission of the City of El Segundo on May 26, 1988, a duly
advertised public hearing was held on such matter in the Council
Chamber of the City Hall, 350 Main Street, E1 Segundo, CA; and
opportunity was given to all persons present to speak for or
against the findings of Environmental Assessment EA -163, Precise
Plan 88 -1 and Subdivision 88 -4 /Tentative Tract Map 46345; and
WHEREAS, at said hearing the Planning Commission adopted
Resolution No. 2213, recommending to City Council the approval of
Environmental Assessment EA -163, Precise Plan 88 -1, and
Subdivision 88 -4 /Tentative Tract Map 46345, subject to certain
conditions; and
WHEREAS, the City Council held, pursuant to law, a duly
advertised public hearing on such matters in the Council Chamber
of the City Hall, 350 Main Street, in the City of E1 Segundo on
June 21, 1988, and notice of said hearing was given in the time,
form and manner prescribed by law; and opportunity was given to
all persons to present testimony or documentary evidence for or
against the findings of Environmental Assessment EA -163, Precise
Plan 88 -1 and Subdivision 88 -4 /Tentative Tract Map 46345; and
WHEREAS, at said hearing the following facts and findings
were established:
Facts:
1. The existing 11,313 sq.ft. (0.26 acre) site is developed
with a single family residence which would be demolished to
accommodate three two -unit townhouses.
2. The site is zoned Residential -3 (R -3), which requires 1,500
sq.ft. of lot area per condominium unit. The proposed
precise plan and subdivision would create six condominium
units in conformance with the regulations of the R -3 zone.

Findings:
1. The proposed project will not have a significant effect on
the environment.
2. The proposed subdivision to create condominium ownership,
and the design of the proposed precise plan improvements are
consistent with the intended General Plan land use
designation for multiple family residential use, and with
the adopted General Plan Citizens Advisory Committee Goals
Report.
3. The site is physically suitable for residential townhouse
development at the proposed density of one unit per 1,886
sq.ft. of lot area.
4. The design of the subdivision and precise plan improvements
as modified by recommended conditions adequately provide for
public services and are not likely to cause any public
health problems.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby approves Environmental
Assessment EA -163, Precise Plan 88 -1, and Subdivision 88 -4/
Tentative Tract Map 46345, subject to the following conditions:
1. Prior to issuance of a building permit, the project shall be
redesigned as follows:
a. Reduce the driveway curb cut to a maximum width of 26
feet.
b. Provide a minimum 11 foot wide driveway with 10 feet
vertical clearance for the entire length of the
driveway along the west property line.
C. Provide a minimum 25 foot aisle width turning radius
for all required parking spaces.
d. Provide solid block wall a minimum six feet high along
the south and west sides of the recreation area.
e. A minimum of 65 cubic feet of private storage space
shall be provided for each dwelling unit, in addition
to the storage space provided within the dwelling unit
itself.
2. The project shall be constructed in substantial compliance
with the site plan and elevations reviewed by the Planning
Commission on file in the Planning Department, as modified
by Condition No. 1 above. Any subsequent modification to
the project as approved shall be referred to the Director of
Planning for a determination regarding the need for Planning
Commission review of the proposed modification.
3. Prior to issuance of a building permit, submit a soils
report and grading plan for review and approval by the
Director of Building Safety.
4. An encroachment permit shall be obtained from the Public
Works Department for demolition haul off. Permit must be
obtained at the same time the building permit for demolition
is issued. An encroachment permit for grading is also
required when importing or exporting 50 or more cubic yards
of dirt. Demolition and grading may be combined on one

encroachment permit.
5. A cash deposit of $6,500.00 or equivalent bond shall be
posted and retained by the City for one (1) year from date
of Certificate of Occupancy. This money to be used for
latent street damage as a result of heavy equipment traffic
during construction. All money not committed at the end of
the one (1) year period shall be refunded.
6. All utility services shall be placed underground.
7. All work in the public right -of -way shall require a public
works permit and shall be done in accordance with "Standard
Specifications for Public Works Construction," latest
edition, including any annual supplements thereto.
8. An encroachment permit is required from the Department of
Public Works for storage of material in the public right -of-
way and shall be allowed only with the approval of the
Director of Public Works.
9. The area of construction shall be enclosed by a 6' high
security fence, subject to approval by the Director of
Public Works. No gates shall open onto the public right -of-
way. Pedestrian walkway shall be maintained clear of
construction debris at all times.
10. All cracked, broken, off -grade and otherwise damaged curbs,
sidewalk, driveway approaches and pavement shall be removed
and replaced or repaired at discretion of Public Works
Inspector. Existing driveways not to be incorporated into
new construction shall be removed and replaced with standard
curb and sidewalk.
11. All sewer laterals in public right -of -way must be a minimum
of 6" inside diameter vitrified clay pipe (V.C.P.) with 6"
clean outs brought to grade at property line with a secure
cap and enclosed in a Portland Cement box with cover.
(Clean outs located in traffic areas shall have traffic
approved cover). Cover shall be emblazoned with the word
"sewer."
12. All planned sewer connections shall be checked for elevation
prior to starting construction.
13. Existing storm drain catch basin shall be maintained and
protected in place.
14. The hours of construction shall be 7:00 a.m. to 6:00 p.m.
Monday through Saturday. Construction is prohibited on
Sundays and Federal Holidays.
15. A trash receptacle enclosure shall be required. The trash
receptacle enclosure shall not be located in any required
yard or parking space, shall be fully accessible with
adequate ingress and egress, shall be appropriately screened
from the public view, and shall be conveniently located for
use by all dwelling units. The trash enclosure shall be
provided with automatic fire sprinkler protection.
16. A security lighting plan shall be submitted, reviewed, and
approved by the Police Department prior to issuance of a
building permit. Lighting fixtures shall be directional and
shall not intrude on adjacent properties.
17. A landscaping plan shall be submitted, reviewed, and
approved by the Director of Parks and Recreation and
landscaping installed prior to the issuance of a Certificate
of Occupancy. The landscape plan shall include a minimum of
four box specimen trees as replacement for the trees being

removed; at least two of the specimen trees should be
located within the front setback or within the public right-
of-way.
18. All landscaped areas shall be provided with permanent
automatic watering facilities. An irrigation plan shall be
submitted, reviewed, and approved by the Director of Parks
and Recreation and the irrigation system installed prior to
the issuance of a Certificate of Occupancy.
19. Required parking shall be in conformance with the zoning
ordinance requirements including garage and space sizes and
aisle widths. The CC +Rs for the project shall include
restrictions on the use of garages for storage so as not to
impact or reduce required parking, and shall require project
residents to park their personal vehicles inside their
garage to ensure an obstructed interior roadway.
SECTION 2. This ordinance shall become effective at
midnight on the thirtieth day from and after the final passage
and adoption hereof.
SECTION 3. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in
the book of original ordinances of said city; shall make a minute
of the passage and adoption thereof in the records of the meeting
at which the same is passed and adopted; and shall within fifteen
days after the passage and adoption thereof, cause the same to be
published once in the E1 Segundo Herald, a weekly newspaper of
general circulation, published and circulated within said City of
E1 Segundo and which is hereby designated for that purpose.
