AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, ADDING CHAPTER 2.04.095, TO THE
EL SEGUNDO MUNICIPAL CODE, RELATING TO
PREEMPLOYMENT CRIMINAL RECORDS CHECKS.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Chapter 2.04.095, is hereby added to the E1
Segundo Municipal Code, which shall read as follows:
112.04.095 PREEMPLOYMENT CRIMINAL RECORDS CHECKS. It
shall be the duty of the City Manager, and he, the City
Attorney, or any other city official designated by the
City Manager, is hereby authorized to access state and
local summary criminal history information for
preemployment screening purposes pursuant to Penal Code
§ §11105(b)(10), 11105.3 and 13300(b)(10).
Except as otherwise provided in §432.7 of the Labor
code, no person who has been convicted of a felony, or
a misdemeanor involving moral turpitude, shall be
eligible for employment by the City; except that such
conviction may be disregarded if it is determined that
mitigating circumstances exist, or that the conviction
is not related to the employment in question."
SECTION 2. This ordinance shall become effective at
midnight on the thirtieth day from and after the date of the
final passage and adoption thereof.
SECTION 3. The Mayor shall sign and the City Clerk shall
certify to the passage and adoption of this ordinance; shall
cause the same to be entered in the book of original ordinances
of said city; shall make a minute of the passage and adoption
thereof in the records of the meeting at which the same is passed
and adopted; and shall within fifteen days after the passage and
adoption thereof, cause the same to be published once in the El
Segundo Herald, a weekly newspaper of general circulation,
published and circulated within said City of E1 Segundo and which
is hereby designated for that purpose.
