AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING SECTION 10.20.010 OF
CHAPTER 10, AND SECTION 12.04.010 OF CHAPTER
12, AND ADDING SECTION 12.04.025, OF THE EL
SEGUNDO MUNICIPAL CODE, WHICH SECTIONS RELATE
TO OVERLOAD AND EXCAVATION PERMIT FEES AND
INSURANCE REQUIREMENTS.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 10.20.010 of Chapter 10 of the E1 Segundo
Municipal Code is hereby amended to read as follows:
"10.04.010 PERMIT REQUIRED. No persons shall move or operate
upon any of the city streets any vehicle with a load or loads in
excess of those permitted by the Vehicle Code without a written
permit from the city traffic engineer.
The city traffic engineer may, by written permit, authorize a
load or loads in excess of those allowed for in the Vehicle
Code, if in his judgment, the streets upon which the vehicle is
to be operated can safely withstand the additional weight or if
the applicant will guarantee to the city that all costs of
repair to the streets or to the public property of the city
damaged by the movement of such load or loads will be paid in
full. The permit shall be granted upon such conditions and upon
depositing such bond as the city traffic engineer in his
discretion may require.
For any permit so issued there shall be a charge and the
permittee shall pay a fee of Twenty Five Dollars for each and
every single operation or moving of a vehicle or combination of
vehicles made under the provisions of the permit. Provided,
however, that for oversize or overweight vehicle movements
involving repetitive trips over the same fixed route in the city
an annual permit may be issued for a fee of Two Hundred Fifty
Dollars per vehicle, which permit shall authorize an unlimited
number of oversize or overweight vehicle trips over a designated
route by such vehicle.
Whenever the city traffic engineer shall deem a police escort
necessary or advisable in connection with any operation under
the permit, the permittee shall pay the current charge for the
escort so required.
Any future changes of Permit Fees, and the effective dates
thereof, shall be fixed and established by the city council from
time to time by resolution."
SECTION 2. Section 12.04.010 of Chapter 12 of the E1 Segundo
Municipal Code is hereby amended to read as follows:
"Section 12.04.010 EXCAVATION PERMIT FEE AND DEPOSIT.
Notwithstanding any of the other provisions of this chapter,
before the street superintendent shall issue any permit required
under the provisions of Section 12.04.060, (including the
cutting of curbs, etc.), the permittee shall pay to the street
superintendent for the city an excavation permit fee of Twenty
Five Dollars for the permit, which shall be retained by the city
to cover clerical costs incident to the permit and the work
covered thereby. The fee of Twenty Five Dollars shall be in

addition to any cash deposit or bond for restoration which the
permittee may be required to make or furnish.
In addition, permittee will be required to provide a cash
deposit sufficient to cover the cost of inspection as determined
by the street superintendent and any unused portion thereof will
be refunded to permittee.
It is provided, however, that the provisions of this section
shall not apply to any excavation or work which is done or
performed under, or in connection with, any franchise which the
city has heretofore granted, or may hereafter grant by
ordinance, and the owner or holder of which franchise makes
annual or other payments to the city under the franchise.
Any future changes of Excavation Permit Fees, and the effective
dates thereof, shall be fixed and established by the city
council from time to time by resolution."
SECTION 3. Section 12.04.025 shall be added to Chapter 12 of the
E1 Segundo Municipal Code and shall read as follows:
"Section 12.04.025 PERMIT ISSUANCE - PROOF OF INSURANCE. In
addition to the requirement of Section 12.04.020, no permit
shall be issued until the person has provided the street
superintendent for the city proof of both general liability and
worker's compensation insurance in the form of a certificate of
insurance reflecting current insurance policies. The City of E1
Segundo shall be named as additional insured under the general
liability policy. The certificate of insurance shall provide
that 30 days notice of cancellation be furnished the city by
registered or certified mail."
SECTION 4. This ordinance shall become effective at midnight on
the thirtieth day from and after the final passage and adoption
hereof.
SECTION 5. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in
the book of original ordinances of said city; shall make a minute of
the passage and adoption thereof in the records of the meeting at
which the same is passed and adopted; and shall within fifteen days
after the passage and adoption thereof, cause the same to be
published once in the E1 Segundo Herald, a weekly newspaper of
general circulation, published and circulated within said City of E1
Segundo and which is hereby designated for that purpose.

Council held on the 3rd day of February, 1987, and that the same
was so passed and adopted by the following vote:
