ORDINANCE NO. 1082
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, CERTIFYING A MITIGATED
NEGATIVE DECLARATION OF ENVIRONMENTAL
IMPACT EA -098 AND ADOPTING PRECISE PLAN
85 -4, WITH CONDITIONS, FOR A PROPOSED NEW
PATIO DINING STRUCTURE AT 147 RICHMOND
STREET TO BE USED IN CONJUNCTION WITH AN
EXISTING RESTAURANT AT 145 RICHMOND
STREET WITHIN SAID CITY.
WHEREAS, the Planning Commission of the City of E1 Segundo,
after a public hearing duly held, has adopted its Resolution No.
2133, recommending to the City Council the certification of a
Mitigated Negative Declaration of Environmental Impact EA -098 and
the adoption of Precise Plan 85 -4, with conditions; and,
WHEREAS, the City Council held a duly noticed public hearing
on February 18, 1986, in the time, form, and manner prescribed by
law;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby certifies that the
Mitigated Negative Declaration of Environmental Impact EA -098 for
Precise Plan 85 -4 as prepared and forwarded by the Planning
Commission has been completed in compliance with the California
Environmental Quality Act (CEQA) and that the said Declaration has
been presented to the City Council and that the City Council has
reviewed and considered the information contained in the said
Declaration prior to approving the project. The changes or
alterations have been required in, and incorporated into, the
project which avoid or substantially lessen any environmental
effects identified in the said Declaration. The City Council
further finds that there is no evidence that the project will have a
significant effect on the environment. Attached hereto is
Resolution 2133 of the Planning Commission identifying and
mitigating any environmental impacts originally identified in the
CEQA process.
SECTION 2. The City Council hereby approves and adopts
Precise Plan 85 -4, subject to the following conditions:
1. That the project shall substantially comply
with the site plan and elevations
accompanying this application.
2. That the use of the structure at
147 Richmond Street shall be limited to
restaurant dining area for the adjacent
restaurant kitchen at 145 Richmond Street
for the duration of this approval. Beer
and wine service shall be permitted only in
conjunction with restaurant food service.
3. That eight parking stalls shall be provided
on site, including one handicapped space,
in substantial compliance with the'
submitted site plan.

4. That adequate trash handling and enclosed
storage area shall be provided and
maintained, pursuant to a plan which shall
be approved by the Public Works Director,
prior to issuance of any building permits,
which plan shall show that there will be no
interference with parking lot usage.
5. That landscaping plans for the parking lot
shall be submitted and approved by the
Parks and Recreation Director, in
consultation with the Planning Director,
prior to issuance of any building permit.
Said plans shall avoid any encroachment
into the public right -of -way.
6. That the applicant shall pay a fire /life
safety mitigation fee of 11 cents per
square foot of enclosed area prior to issuance
T building permits.
7. That the Planning Director will review and
approve the signage plan prior to issuance
of building permits for signs.
8. That the landscaped courtyard shall not be
used for seating and dining, and that the
Planning Director review building and
seating plans to ensure there is an
adequate barrier between the courtyard and
dining areas. Further, that the seating
plan be approved by the Fire Chief.
9. That the applicant contribute to the
Downtown Revitalization streetscape fund a
fair -share amount equal to 3.70 of the cost
of landscape improvements to the 55 -space
public parking lot, plus the cost of two
street trees in the vicinity.
10. That the project shall comply with all
applicable building and fire code
requirements to the satisfaction of the
Director of Building Safety and the Fire
Chief, prior to the issuance of any
building permits. This shall include
compliance with the following:
a. The design be modified to assure proper
protection of openings along the property
line.
b. A ramp should be provided to replace the
steps near Door 5 allowing the physically
handicapped access through Door 5 to the
courtyard area, the new dining area and the
existing dining area.
c. A 5 -foot level landing is required in the
direction of door swing at Door 5.
d. The width of the corridor connecting Door 3
and the existing dining area shall be 44
inches minimum.
11. The project shall provide adequate exterior
lighting at all customer entrances and the
parking lot, which shall be approved by the
Chief of Police prior to issuance of any
building permit. Lighting shall be
shielded and directed to eliminate glare
and spillover onto adjacent properties and
public rights -of -way.

12. A permit from Public Works Department is
required for modifications to driveway
aprons.
13. All off grade, broken, or cracked sidewalk,
curbs, curb and gutter, driveway
approaches, wheel chair ramps and pavement
shall be replaced or repaired. Street
excavation permit is required from the
Public Works Department.
14. Curb drains shall be allowed for discharge
of storm water only. Floor drains shall be
routed into a clarifier and discharged into
the sanitary sewer.
15. Developer shall connect to existing sewer
lateral at property line and provide
cleanout at property line; if existing
lateral is less than 6" dia. or is not in
good condition a new 6" lateral and
cleanout shall be constructed. Any sewer
work in the public right -of -way requires a
sewer permit from the Public Works
Department.
16. All utility services shall be placed
underground.
17. Any change in the use or the structures
at either 145 or 147 Richmond Street
requires an amendment to the Precise Plan.
18. The applicant shall file an agreement to hold
the two parcels as one with the City Planning
Department for its approval and shall there-
after record the agreement with the Los Angeles
County Recorder prior to the issuance of a
building permit.
SECTION 3. This ordinance shall become effective at midnight
on the thirtieth day from and after the date of the final passage
and adoption thereof.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in
the book of original ordinances of said city; shall make a minute of
the passage and adoption thereof in the records of the meeting at
which the same is passed and adopted; and shall within fifteen days
after the passage and adoption thereof, cause the same to be
published once in the E1 Segundo Herald, a weekly newspaper of
general circulation,,published and circulated within said City of E1
Segundo and which is hereby designated for that purpose.
