ORDINANCE 10815794 ORDINANCE NO. 1081 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, CHAPTER 20.35 (SPECIAL COMMERCIAL DISTRICT (C -3) ZONE) OF TITLE 20 (THE COMPREHENSIVE ZONING ORDINANCE) OF THE EL SEGUNDO MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 20.35.050, "Height Requirements ", of Chapter 20.35 (Special Commercial District (C -3) Zone) of Title 20 (The Comprehensive Zoning Ordinance) of the E1 Segundo Municipal Code is hereby amended to read as follows: "20.35.050 HEIGHT REQUIREMENTS. A. No building within the C -3 zone shall exceed the allowable floor area by virtue of the building height. No building may exceed two hundred feet in height; however, when the C -3 lot or parcel is adjacent to, adjoining, or abuts a lot or parcel in any residential zone, in which case the C -3 development height limit shall not exceed one hundred feet in height. No building or structure shall exceed these limits except when expressly authorized in accordance with a procedure requiring approval of the planning commission or the city council. No building may exceed both the allowable floor area and height limits under any circumstances. (Ord. 1227 Sec. 3 (part), 1982.) B. No building west of Sepulveda Boulevard in the C -3 zone shall exceed the allowable floor area ratio of 1:1 by virtue of the building height. Maximum building height shall be forty -five feet, not to exceed four (4) stories; however, when the C -3 lot or parcel is adjacent to, adjoining, or abuts a lot or parcel in any residential zone, in which case the C -3 development height limit shall not exceed forty feet (40') in height. No building or structure shall exceed these limits except when expressly authorized by variance, conditional use permit or precise plan. No building may exceed both the allowable floor area and height limits under any circumstances." SECTION 2. Section 20.35.060, "Area Requirements ", of Chapter 20.35 (Special Commercial District (C -3) Zone) of Title 20 (The Comprehensive Zoning Ordinance) of the E1 Segundo Municipal Code is hereby amended to read as follows: 1120.35.060 AREA REQUIREMENTS. (a) Front Yard. Each lot shall have a fully landscaped and maintained front yard of not less than twenty -Five feet. No encroachment shall be allowed except when expressly author;.,,e.l in accordance with a procedure requiring approval of the planning commission or the city council. J:021886 -3.ORD (C-3) 5791 (b) Side Yard. Each lot shall have a fully landscaped and maintained side yard of not less than fifteen feet. Where side yards abut a dedicated street the yard shall be twenty -five feet. Where side yards abut property in a different zone, the zone with the most restrictive side yard requirement shall prevail, but in no case will the side yard be less than fifteen feet. No encroachment shall be allowed except when expressly authorized in accordance with a procedure requiring approval of the planning commission or the city council. (c) Rear Yard. Each lot shall have a fully landscaped and maintained rear yard of not less than ten feet. Where rear yards abut an alley, dedicated street, public right -of- way, or when the major access to the site is accomplished through the rear yard, the yard shall be twenty -five feet. No encroachment shall be allowed except when expressly authorized in accordance with a procedure requiring approval of the planning commission or the city council. (d) Where the parcel abuts any residentially zoned property there shall be provided within that set -back landscaping of sufficient height and density to buffer the visual impacts to said residential use, this landscaping shall be in addition to the 5% parking lot landscape requirement. Landscape plan to be approved by the Director of Parks and Recreation. (e) C -3 Minimum Lot Size and Frontage. Each lot in the C -3 zone shall be a minimum of ten thousand sq. ft. and have a minimum frontage of one hundred feet on a dedicated street; provided, however, that if a lot of lesser size was of legal record prior to May 24, 1970, this requirement shall not apply. (Ord. 1027 Sec. 3 (part), 1982.) " SECTION 3. Section 20.35.070, "Building Area ", of Chapter 20.35 (Special Commercial District (C -3) Zone) of Title 20 (The Comprehensive Zoning Ordinance) of the E1 Segundo Municipal Code is hereby amended to read as follows: "20.35.070 BUILDING AREA. (a) The total floor area of the main building, as defined in Chapter 20.08 as principal buildings, on any parcel or lot shall not exceed two times the parcel or lot area. Floor area is defined in Section 20.08.193. (Ord. 1027 Sec. 3 (part), 1982.) (b) For properties in the C -3 zone west of Sepulveda Boulevard, the total floor area of the main building, as defined in Chapter 20.08 of principal buildings, on any parcel or lot shall not exceed one times the parcel or lot area. Floor area is defined in Section 20.08.193." SECTION 4. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at J:021886 -3.ORD (C -3) 5792 which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
