ORDINANCE 1069573; ORDINANCE NO. 1069 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 5 (BUSINESS REGULATIONS AND LICENSING) OF THE EL SEGUNDO MUNICIPAL CODE RELATING TO CHAPTER 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES7. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.020, "Organizations Eligible for City License to Conduct Bingo Games," is herewith amended in its entirety to read as follows: "5.46.020 ORGANIZATIONS ELIGIBLE FOR CITY LICENSE TO CONDUCT BINGO GAMES. Organizations exempted from the payment of the bank and corporations tax by Sections 23701a, 23701b, 23701d, 2370le, 23701£, 23701g, 23701(1) of the Revenue and Taxation Code, mobile home park associations and senior citizens' organizations, are eligible to apply to the city for a license to conduct bingo games in the city under the provisions of Section 326.5 of the Penal Code and the provisions of this chapter; provided, however, that the receipts of such games are used only for charitable purposes. (Ord. 943 § 2 (part), 1977; Ord. 929 § 1 (part), 1977)." SECTION 2. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.030, "Application for License," is herewith amended in its entirety to read as follows: "5.46.030 APPLICATION FOR LICENSE. Eligible organiza- tions desiring to obtain such license to conduct bingo games in the city shall file an application in writing therefor with the Director of Finance on a form to be provided by the city. The issuing authority shall be the Director of Finance upon authorization of the City Council. The license issued shall be for a term of one year from the date of issuance, subject to a renewal and an annual fee of fifty dollars, plus an additional fee of one percent of the monthly gross re- ceipts collected in excess of five thousand dollars. If an application for a license is denied, one -half of any license fee paid shall be refunded to the organization. (Ord. 943 § 2 (part), 1977; Ord. 929 § 1 (part), 1977). SECTION 3. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.070, "Contents of License," paragraph 4, is herewith amended to read as follows: "The occupancy capacity of the room in which bingo .games are to be conducted as set forth on the Certificate of Occu- pancy and /or posting or room capacity as specified in the Uniform Building Code, as adopted by the City. A description of where the room is located at the address, room site, number of exits, type of seating that will be provided participants and other pertinent information shall be listed." SECTION 4. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.120, "Proceeds to be Kept in Separate CFund or Account," Subsection (a)(2), is herewith amended in its entirety to read as follows: "(2) A portion of such proceeds, not to exceed twenty per- cent (208) of the proceeds before the deduction for prizes, or one thousand dollars ($1,000) per month, whichever is less, may be used for rental of property, overhead, including the purchase of bingo equipment, administrative expenses, security equipment and security personnel." SECTION 5. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.140, "Exclusive Operation by Licensee," is herewith amended to add the following sentence at the end of said section: "Security personnel may be paid from proceeds of a bingo game if not members of the licensee organization." SECTION 6. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.160, "Attendance Limited to Occupancy Capacity" is herewith amended in its entirety to read as follows: "5.46.160 ATTENDANCE LIMITED TO OCCUPANCY CAPACITY. Bingo games shall be conducted only within structures ap- proved for public assembly as such is defined in the Uniform Building Code as adopted by the City and as evidenced by a valid certificate of occupancy as set forth in the Uniform Building Code as adopted by the City. Bingo games shall be permitted only in the interior of such structures and licensee shall not reserve seats or space for any person. (Ord. 929 § 1 (part), 1977)." SECTION 7. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.170, "Bingo Games Conducted Only on Licensee's Property," is herewith amended by deleting the first sentence thereof and replacing it with the following: "A licensee shall conduct a bingo game only on property owned or leased by it, or property whose use is donated to the organization, for ninety or more days prior to date of application and which property is used by such organization for an office or for performance of the purposes for which the organization is organized." SECTION B. Chapter 5.46 (BINGO GAMES FOR CHARITABLE PURPOSES), Section 5.46.180, "Parking to be Provided" is herewith deleted. SECTION 9. This ordinance shall become effective at midnight on the thirtieth day from and after the date of final passage and adoption thereof. -2- 5726 579 SECTION 10. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated within said city of El Segundo and which is hereby designated for that purpose.
