ORDINANCE 1052ORDINANCE NO. 1052 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 5 (BUSINESS REGULATIONS AND LICENSING) OF THE EL SEGUNDO MUNICIPAL CODE BY ADDING THERETO SECTION 5.04.223 WHICH SAID SECTION RELATES TO AN AMENDMENT TO DUE DATES AND DELINQUENCY DATES FOR THE SECOND SEMI- ANNUAL PERIOD, JULY THROUGH DECEMBER, 1983, CREATED BY SECTION 5.04.221 OF THE EL SEGUNDO MUNICIPAL CODE. WHEREAS, it has been recommended to the City Council that it defer until an effective date of October 1, 1983, any decision concerning an adjustment to the business registration fees required by Title 5 of the E1 Segundo Municipal Code; and WHEREAS, it has also been recommended that pending a decision on the adjustment of business registration fees on October 1, 1983, that business registration fees due and payable under Sections 5.04.221 and 5.04.222 be deferred until a decision is made concerning an adjustment to the business registration fees effective October 1, 1983; and WHEREAS, as a result of said recommendations, the City Council is unable at this time to make an adjustment to the business registration fees as of July 1, 1983, as author- ized under Section 5.04.222; and WHEREAS, the City Council may also wish to consider additional amendments to Title 5 no later than October 1, 1983, to be effective January 1, 1984; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5.04.223 is hereby added to the E1 Segundo Municipal Code to read as follows: "Notwithstanding the provisions of Sections 5.04.221 and 5.04.222, the business registration fee provided for and levied by those Sections for the period from July 1, 1983 through December 31, 1983, shall become due and payable October 1, 1983. The penalties for delinquency for the period from July 1, 1983 to December 31, 1983 shall be computed from November 1, 1983. rif (14 ;;f,fl ) The purpose of this Section is to levy a tax for the second six months of 1983 equal to one -half (1/2) of the tax for the entire year, to the end that if evaluation of the City's fiscal situation reflects a need for increased business registration fees, such increase can be imple- mented by amendment effective no later than October 1, 1983, but if no further amendment is made to this Title each business will pay the same tax during 1983 that it would otherwise have paid, but in two equal installments. Any business which was not issued a business license for the period January 1, 1983 to June 30, 1983, and which applies for a business license as required by this Title on or after July 1, 1983, shall, upon such application for a license, pay a business registration fee in an amount equal to one quarter (1/9) of the business registration fee otherwise required by this Title for all of the year 1983. Such business license shall be effective only for the period July 1, 1983 through September 30, 1983. In all other respects, the provisions of this Section with respect to business registration fees levied October 1, 1983, shall apply to such businesses." SECTION 2. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
