ORDINANCE 1044ORDINANCE NO. 1044 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALI- FORNIA, AMENDING CHAPTER 1.12 OF THE EL SEGUNDO MUNICIAPL CODE, WHICH CHAPTER RELATES TO PENAL- TIES FOR CODE VIOLATIONS. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 1.12.010 of Chapter 1.12 of the "E1 Segundo Municipal Code" is amended to read as follows: 1.12.010 VIOLATION - PENALTY. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of E1 Segundo shall be guilty of a misdemeanor unless the violation is made an infraction by the provisions of this Code. Any person convicted of a misdemeanor under the ordinances of El Segundo shall be punished by a fine of not more than five hundred dollars, or by imprisonment not to exceed six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of E1 Segundo is committed, continued, or permitted by any such person, and he shall be punished accordingly. SECTION 2. Chapter 1.12 of the "E1 Segundo Municipal Code" is amended by adding thereto Sections 1.12.020 and 1.12.030 which sections shall read as follows: 1.12.020 VIOLATION PENALTY -- INFRACTIONS. Any person convicted of an infraction for a violation of this Code is punishable by (1) a fine not exceeding fifty dollars for the first violation; (2) a fine not exceeding one hundred dollars for the second violation of the same Code section within one year; (3) a fine not exceeding two hundred fifty dollars for each additional violation of the same Code Section within one year. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any section of this Code is committed, continued, or permitted by any such person, and he shall be punished accordingly. 1.12.030 PROVISIONS PUNISHABLE AS INFRACTIONS. The following sections of this Code shall be punishable as infractions and not as misdemeanors: Section 10.12.010 - Driving Through Funeral Procession Section 10.12.020 - Clinging to Moving Vehicle Section 10.12.030 - Commercial Vehicles Using Private Driveways Section 10.12.040 - Riding /Driving on Sidewalk Section 10.12.050 - Driving Over New Pavement or Markings `w; ( E6 Section 10.12.060 - Placing of Signs or Barriers Section 10.12.070 - Obstructing Traffic Section 10.12.080 - Limited Access Roadway Section 10.12.090 - Restrictions on Freeway Use Section 10.12.100 - Noncompliance to Signs Section 10.12.110 - Park or Recreation Ground Section 10.20.010 - Permit Required - Load Violation Section 10.20.020 - Flange Wheel Machinery Section 10.24.020 - Crossing Roadway in Business Districts Section 10.24.030 - Crossing Roadway at Right Angle Section 10.24.040 - Standing in Roadway Section 10.24.050 - Obstructing Free Passage of Pedestrians 1.12.040 MANDATORY APPEARANCE. Whenever any person is arrested for any violations of this code not declared to be a misdemeanor, the arrested person shall be taken without unnecessary delay before a magistrate within the county in which the offense charged is alleged to have been committed and who has jurisdiction of the offense and is nearest or most accessible with reference to the place where the arrest is made in any of the follow- ing cases: (1) When the person arrested fails to present his driver's license or other satisfactory evidence of his identity for examination. (2) When the person arrested refuses to give his written promise to appear in court. (3) When the person arrested demands an immediate appear- ance before a magistrate. SECTION 3. This ordinance shall become effective at mid- night on the thirtieth day from and after the date of the final pas- sage and adoption thereof. SECTION 4. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of - 2 - general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
