ORDINANCE NO. 991
AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIF-
ORNIA, GRANTING TO THE ATCHISON, TOPEKA AND SANTA
FE RAILWAY COMPANY, ITS SUCCESSORS AND ASSIGNS,
A PERMIT TO MAINTAIN AND OPERATE A SPUR TRACK
ACROSS DOUGLAS STREET 512.09 FEET SOUTH OF IMPERIAL
HIGHWAY.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of El Segundo hereby grants to The
Atchison, Topeka and Santa Fe Railway Company, a corporation organized and incorporated
under the laws of the State of Kansas, its successors and assigns, a revocable spur track
permit to maintain and operate a railroad spur track of standard guage across Douglas
Street 512.09 feet south of Imperial Highway, in the City of El Segundo, California, at
the location hereinafter described for a period of twenty -five years from and after the
effective date of this ordinance.
The center line of the proposed spur track is shown on print from CECL Drawing
No. 603 -38718 dated January 14, 1980, attahced to the Petition for Spur Track Permit dated
February 14, 1980, on file in the Office of the City Clerk of El Segundo, said center line
being more particularly described as follows:
BEGINNING at a point in the easterly line of Douglas Street
(150.00 feet wide) distant 492.95 feet southerly along said
easterly line, from the point of the intersection with the south-
erly line of Imperial Highway (95 feet wide); THENCE west-
erly along the arc of a curve concave southerly and having
• radius of 478.34 feet through a central angle of 18
• distance of 151.00 feet to point of ending in westerly line
of Douglas Street, distant 512.09 feet southerly from the point
of intersection with said southerly line of Imperial Highway
(90 feet wide).
SECTION 2. That said revocable Spur Track Permit is ganted subject to the
following conditions:
(a) That the said track shall be used only for the operation of freight cars and
locomotives necessary for the transportation of freight for hire.
(b) That said track must be kept and maintained in good condition and repair
to the satisfaction of the City Engineer of the City of El Segundo.
(c) That said track must be maintained and operated under such restrictions
as not to unreasonably interfere with the use of any streets by the public. Operations and
maintenance are herby strictly prohibited between the hours of 3:00 p.m. to 6:00 p.m.
Monday through Friday.
(d) That whenever the street traversed by said track is paved or repaved, at
or near the point where said street is so traversed, the grantee herein shall likewise, at
the same time and as part of the same operation as the work on the remainder of said
street, pave or repave the crossing traversing said street, between the tracks and two (2)
feet on each side thereof with such materials and in such manner as this City Council may
direct, to the satisfaction of the City Engineer.
(e) That there be compliance with staff recommendations regarding the engi-
neering requirements within the street right -of -way including removal of two (2) abandoned
spur tracks across Douglas Street immediately north of proposed spur track.
SECTION 3. This ordinance shall become effective at midnight on the thirtieth
day from and after the date of the final passage and adoption thereof.
SECTION 4. The City Clerk shall certify to the passage and adoption of this
ordinance; shall cause the same to be entered in the book of original ordinances of said
city; shall make a minute of the passage and adoption thereof in the records of the meeting
at which the same is passed and adopted; and shall within fifteen days after the passage
and adoption thereof, cause the same to be published once in the El Segundo Herald, a
weekly newspaper of general circulation, published and circulated within said City of El
Segundo and which is hereby designated for that purpose.
