ORDINANCE 964ORDINANCE NO. 964 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING THE "UNIFORM FIRE CODE, 1976 EDITION, INCLUDING APPENDIXES A, B, C, D, E, F AND G; REPEALING IN ITS ENTIRETY CHAPTER 17.04 OF, AND ADDING CHAPTER 17.04 TO, THE "EL SEGUNDO MUNICIPAL CODE," WHICH CHAPTER RELATES TO THE FIRE CODE. THE CITY COUNCIL OF THE CITY OF F,L, SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLONS: SECTION 1. Chanter 17.04 of the "E1 Segundo Municipal Code" is repealed. SECTION 2. Chapter 17.04 is added to the "El Segundo Municipal Code" to read as follows: CHAPTER 17.04 FIRE CODE 17.04.010 ESTABLISHED. The "Uniform Fire Code, 1976 Edition," including Appendixes A, B, C, D, E, F, and G, promulgated and published by the Western Fire Chiefs Association and the International Conference of Building Officials of which Code not less than three copies have been and are now filed in the office of the City Clerk, are hereby adopted with the same force and effect as though set out herein in full. 17.04.020 CHANGES AND ADDI'PIONS TO THE CODE. The Uniform Fire Code is amended by changing, aiding and deleting the articles, sections and portions of sections designated in Sections 17.04.030 through 17.04.110. 17.04.030 SECTION 1.215 AMENDED. Section 1.215 is i amended to read as follows: APPEALS- -BOARD OF APPEALS. Sec. 1.215. Whenever the Chief of the Fire Depart- ment shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or )w,.I wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the Board of Appeals within thirty days from the date of the decision appealed. There shall be and hereby is created a Board of Appeals which shall consist of the City Council. The Fire Chief shall be an ex- officio member of the Board; the City Clerk shall act as Secretary of the Board. The Board shall adopt reasonable rules and regulations for conducting its hearings and shall render all deci- sions and findings in writing to the Appellant with a duplicate copy to the Fire Chief. 17.04.040 SECTION 1.216 AMENDED. Section 1.216 is amended to read as follows: COMPLIANCE WITH RECOGNIZED STANDARDS Sec. 1.216. Whenever this Code is inapplicable for any reason to any situation involving the protection of persons and property from the hazards of fire and explo- sion, the materials, methods of construction, installa- tions, practices, or operations necessary to provide such protections shall, to a reasonable degree, be in accordance with nationally recognized and accepted standards, principles and tests and generally recognized and well established methods of fire prevention and control, as set forth in the National Fire Codes, Volumes 1 through 5 and Volumes 7 through 16, 1978 Edition, published by the National Fire Protection Asso- ciation, a recognized national authority and technical and scientific organization, which Volumes are adopted by reference as part of this Code with the same force and effect as though set out herein in full. 17.04.050 SECTION 1.423 DEFINITIONS AMENDED. The definitions of Uniform Building Code, Uniform Mechanical Code and Uniform Plumbing Code in Section 1.423 are amended to read as follows: UNIFORM BUILDING CODE shall mean the Code adopted by Chapter 16.04 of the "El Segundo Municipal Code ", as amended by said Chapter. UNIFORM MECHANICAL CODE shall mean the Code adopted by Chapter 16.16 of the "El Segundo Municipal Code ", as amended by said Chapter. UNIFORM PLUMBING CODE shall mean the Code adopted by Chapter 16.12 of the "El Segundo Municipal Code ", as amended by said Chapter. 17.04.060 SUBSECTION 13.302(b) AMENDED. Subsection 13.302(b) is amended to read as follows: (b) The building owner shall be responsible for - 2 - Y M IIw l aJ assuring that the fire and life safety systems required by Sections 1807 and 1907 of the Uniform Building Code shall be maintained in an operable condition at all times. Unless otherwise required by the Chief, quarterly tests of such systems shall be conducted and certified by qualified persons approved by the Chief. A written record of the tests shall be maintained by the occupant and a copy of the certification forwarded to the Fire Prevention Bureau. 17.04.070 SUBSECTION 13.307(a) AMENDED. Subsection 13.307(a) is amended to read as follows: (a) Every apartment house three stories or more in height or containing more than 15 apartments and every hotel three stories or more in height containing 20 or more guest rooms, shall have installed therein an approved automatic or manually operated fire alarm system designed to warn the occupants of the building in the event of fire. Such fire alarm system shall be so designed that all occupants of the building may be warned simultaneously. 17.04.080 SUBSECTIONS 15.704(g) AND (h) ADDED. Sub- sections 15.704(g) and (h) are added to read as follows: (g) Containers. Signs shall be prominently posted, stating: PORTABLE CONTAINERS. No delivery of any flam- mable or combustible liquids shall be made into portable containers, unless such container is of material and construction as approved by the Chief, having a tight closure with screwed or spring cover, so designed that the contents can be dispensed without spilling. Delivery of any flammable or combustible liquid into any glass container is prohibited. - 3 - r"' [ i (h) Annual Permit. Self -serve service station ope- rators are required to obtain an annual Fire Department Permit for such self -serve operation; such annual Permit fee shall be $15.00. 17.04.090 SECTION 20.110 AMENDED. Section 20.110 is amended to read as follows: SMOKING AND OPEN FLAME DEVICES Sec. 20.110(a) The Chief may require the posting of "NO SMOKING" signs. No person shall smoke within 50 feet of any LP gas container. (b) No person shall install or maintain any open flame device outside of buildings within 50 feet of any LP gas container. (c) No person shall install or maintain any LP gas container within 50 feet of any open flame device. 17.04.100 ARTICLE 37 ADDED. Article 37 is added to read as follows: ARTICLE 37 - EXCLUSIONS Sec. 37.101 FIRE ZONE NO. 4 EXCEPTED. The provisions of this Uniform Fire Code shall not apply within Fire Zone No. 4 of this city. 17.04.110 ARTICLE 38 ADDED. Article 38 is added to read as follows: ARTICLE 38 - ESTABLISHMENT OF DISTRICTS REGULATING STORAGE OF FLAMMABLE OR COMBUSTIBLE LIQ- UIDS, LIQUEFIED PETROLEUM GASES, AND EXPLOSIVES AND BLASTING AGENTS. Sec. 38.101. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF FLAMMABLE OR COMBUSTIBLE LIQUIDS IN OUTSIDE ABOVEGROUND TANKS IS TO BE PROHIBITED. (a) The limits referred to in Section 15.201 of the Uniform Fire Code in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited, are hereby established as follows: In all land use zones as described in Title 20 (The Comprehensive Zoning Ordinance) of the "E1 Segundo Municipal Code", except M -2 zoned areas. EXCEPTION: The Fire Chief may approve storage in C -M or M -1 zoned areas. (b) The limits referred to in Section 15.601 of the Uniform Fire Code, in which new bulk plants for flammable or combustible liquids are prohibited, are hereby estab- lished as follows: All of the City except Fire Zone 4 as described in Section 16.40.050 of the "El Segundo Municipal Code ". Sec. 38.102. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH BULK STORAGE OF LIQUEFIED PETROLEUM GASES IS TO BE RESTRICTED. The limits referred to in Section 20.105 (a) - 4 - of the Uniform Fire Code, in which bulk storage of liquefied petroleum gas is restricted, are hereby estab- lished as follows: In all land use zones within the City as described in Title 20 (The Comprehensive Zoning Ordinance) of the "El Segundo Municipal Code" except M -2 zoned areas. Sec. 38.103. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED. The limits referred to in Section 11.106 (b) of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are hereby established as follows: In all land use zones within the City as described in Title 20 (The Comprehen- sive Zoning Ordinance) of the "El Segundo Municipal Code" except by special permit granted by the Fire Chief." SECTION 3. PENALTIES. (a) Any person who shall violate any of the provisions of this Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such viola- tion and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine not exceeding five hundred dollars or impri- sonment for a term not exceeding six months, or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. SECTION 4. EFFECTIVE DATE: This ordinance shall become effective at midnight on the thirtieth day from and after - 5 - the date of the final passage and adoption thereof. SECTION 5. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
