ORDINANCE 960J l�N ORDINANCE NO. 960 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING WITH CERTAIN CONDITIONS PRECISE PLAN NO. 3 -78 FOR PROPERTY LOCATED SOUTH OF EL SEGUNDO BOULEVARD BETWEEN SEPULVEDA BOULEVARD AND DOUGLAS STREET WITHIN SAID CITY. WHEREAS, under the provision of Title 20 (The Comprehensive Zoning Ordinance) of the "E1 Segundo Municipal Code" and the laws of the State of California applicable to such matters, Hughes Aircraft Company has filed a petition for the adoption of Precise Plan No. 3 -78; and WHEREAS, said Plan is for property located in the City of E1 Segundo, County of Los Angeles, State of California, more particularly described as follows: That portion of Section 18, Township 3 south range 14 west in the Rancho Sausal Redondo, in the City of E1 Segundo, County of Los Angeles, State of California, as shown on the map filed in Case No. 11629 Superior Court of said County on June 21, 1890, in the Office of the County Clerk of said County on copy of said map appears in the files of the County Surveyor of said County a Clerk's filed Map No. 218 bounded as follows: Bounded on the north by a line parallel with and 50.00 feet southerly of the north line of said Section 18; bounded on the east by the westerly line of Tract No. 26556 as shown on Map recorded in Book 675, Pages 92 and 94 of Maps, in the Office of the County Recorder of said County; bounded on the southeast by the northwesterly line of the 80.00 foot strip of land described in the Deed to Pacific Electric Railway Company recorded May 27, 1913 as instrument No. 210 in Book 5750, Page 43 of Deeds Records of said County and bounded on the southwest by the northeasterly line of the land described as Parcel 2 in the deed to Southern California Edison Company recorded March 6, 1930 as Instrument No. 535 in Book 9840, Page 33 Official Records of said County, said northeasterly line also being the northeasterly line of Lot 12, Map No. 8 of property of Southern California Edison Company, Ltd. filed in Book 3, Page 5 of Official Maps in the Office of said County Recorder; and WHEREAS, said Plan was submitted to the Planning Commission of the City of E1 Segundo, and after a public hearing duly and regularly held, was approved and recommended for adoption by the City Council; and WHEREAS, the City Council of the City of E1 Segundo has duly and regularly held a public hearing on said Plan; and 5193 WHEREAS, the City Council of the City of El Segundo has now acquired jurisdiction to adopt this ordinance: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION I. That said Precise Plan No. 3 -78 hereinabove referred to as approved by the Planning Commission of the City of E1 Segundo in its Resolution No. 960 be, and the same is hereby approved and adopted upon the following conditions: (1) The developer shall provide recreation facilities in accordance with a plan approved by the Recreation and Parks Commission. The developer shall submit to the Recreation and Parks Commission a recreational plan for approval. No building permit shall be issued until such recreational plan has been approved. (2) The developer shall install all off -site improve- ments including but not limited to sewers, storm drains, water lines, streets, curbs, sidewalks, and traffic signals. The developer shall prepare a plan for all such off -site improvements and submit them to the Director of Public Works for his approval. The Director of Public Works shall approve the plan if the plan satisfactorily provides for all required off -site improvements. (3) If said off -site improvements are not installed prior to the developer requesting issuance of a building permit, the developer shall furnish surety with the City in the amount to be determined by the Director of Public Works before any building permit is issued. Said surety shall be in the form of a cash deposit or other surety approved by the City Council in the agreement provided for in Section III of this ordinance. (4) The developer shall enter into an agreement with the City to pay its proportionate share of the cost of purchasing addi- tional capacity for sewage treatment and the City Council shall be reasonably satisfied that such additional capacity will be available - 2 - ZIS4 before any building permit, authorization to construct, or other permit authorizing construction on the premises, which is dependent upon this ordinance for validity, is issued. (5) The developer shall landscape the premises in accor- dance with a landscaping plan approved by the Planning Commission. The developer shall prepare and submit for approval a landscape plan. (6) No building or use shall be permitted on the above described premises that is not in accordance with this approved Precise Plan. (7) That construction shall commence on or before January 1, 1980, and this Precise Plan shall become null and void if construction has not commenced on or before said time. Provided, how- ever, that the City Council may, for good cause, extend the period for commencement of construction not to exceed two additional years. SECTION II. This ordinance shall be inoperative unless within thirty days after the effective date of this ordinance the developer files with the City Clerk, its written agreement to be bound by the foregoing conditions. SECTION III. This ordinance shall become operative when all of the following have occurred: (1) An agreement has been entered into by the developer and the City of E1 Segundo and such agreement has been approved by the City Council. (2) The foregoing agreement expressly states that the parties agree that it satisfies conditions 2, 3 and 9 set forth in Section I of this ordinance. (3) An executed copy of the agreement is filed with the City Clerk. This ordinance shall remain inoperative until all of the foregoing have occurred. SECTION IV. The City Clerk is hereby authorized and directed to endorse upon said Plan the approval of the City Council when the provisions of Section II and III have been complied with. Said Plan is on file in the office of the City Clerk, open to public - 3 - 51 )J inspection, and is by this reference incorporated herein and made a part hereof. SECTION V. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION VI. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo, and which is hereby designated for that purpose.
