ORDINANCE NO. 956
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING SEC'll ONS 10. 79.030
AND 10.79.120 OF THE EL SEGUNDO MUNICIPAL
CODE WHICH SAID SECTIONS RELATE TO ABAN-
DONED AND INOPERATIVE VEHICLES.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 10.79.030 of the El Segundo Municipal Code
is amended to read as follows:
10. 79.030 EXCEPTIONS. This chapter shall not apply to:
(1) A vehicle, or parts thereof, which is completely enclosed
within a building in a lawful manner where it is not visible from the
street or other public or private property; or
(2) A vehicle, or parts thereof, which is stored or parked in
a lawful manner on private property in connection with the business
of a licensed dismantler, licensed vehicle dealer, or a junk dealer;
or
(3) A vehicle, or parts thereof, which is located behind a wall
or solid fence, six feet in height and in good repair, which is not
plainly visible from a highway; or
(4) A vehicle, or parts thereof, which is stored or parked in
a lawful manner on private property in connection with the business
of an automobile repair garage; or
(5) A vehicle, or parts thereof, which is stored or parked in
a lawful manner on private property in a carport which serves as
required off - street parking for a residential use.
Nothing in this section shall authorize the maintenance of a pub-
lic or private nuisance as defined under provisions of law other than
Chapter 10 (commencing with Section 22650) of Division 11 of the
Vehicle Code and this chapter.
SECTION 2. Section 10.79. 120 of the El Segundo Municipal Code
is amended to read as follows:
10. 79.120 APPEAL OF DECISION. Any interested party may
appeal the decision of the chief of police by filing a written notice of
appeal with the city clerk within five days after his decision.
Such appeal shall be heard by the city council which may affirm,
amend or reverse the order or take other action deemed appropriate.
The city clerk shall give written notice of the time and place of
the hearing to the appellant and those persons specified in Section
10.79.090.
In conducting the hearing the city council shall not be limited
by the technical rules of evidence.
No action shall be taken to remove, destroy or dispose of any

vehicle or parts thereof during the pendency of an appeal from
the decision of the chief of police to the City Council pursuant
to this section.
SECTION 3. This ordinance shall become effective at midnight
on the thirtieth day from and after the date of the final passage and adoption
thereof.
SECTION 4. The City Clerk shall certify to the passage and adoption
of this ordinance; shall cause the same to be entered in the book of original ordi-
nances of said city; shall make a minute of the passage and adoption thereof in
the records of the meeting at which the same is passed and adopted; and shall
within fifteen days after the passage and adoption thereof, cause the same to
be published once in the El Segundo Herald, a weekly newspaper of general
circulation, published and circulated within said City of E1 Segundo and which
is hereby designated for that purpose.
