AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, EXTENDING AN INTERIM ZONING
ORDINANCE PROHIBITING THE CONVERSION OF
EXISTING APARTMENT BUILDINGS INTO CONDO-
MINIUM OWNERSHIP.
WHEREAS, on February 5, 1975, the City Council of the
City of E1 Segundo, California, adopted as an interim zoning ordinance,
Ordinance No. 835, entitled:
"AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, PROHIBITING THE CONVERSION
OF EXISTING APARTMENT BUILDINGS INTO CON-
DOMINIUM OWNERSHIP, EXCEPT UPON AUTHORI-
ZATION OF THE CITY COUNCIL DURING A PERIOD
OF STUDY OF CONDOMINIUM DEVELOPMENT AND
SETTING A PUBLIC HEARING FOR THE PURPOSE
OF CONSIDERING AN EXTENSION OF THIS ORDI-
NANCE. "; and
WHEREAS, Ordinance No. 835 expired on June 5, 1974; and
WHEREAS, on April 16, 1974, the City Council of said City, after
giving notice pursuant to Section 65856 of the Government Code, held a public
hearing and thereafter adopted Ordinance No. 841, entitled:
"AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, EXTENDING AN INTERIM ZONING
ORDINANCE PROHIBITING THE CONVERSION OF
EXISTING APARTMENT BUILDINGS INTO CONDO-
MINIUM OWNERSHIP.",
which ordinance extended the restrictions imposed by Ordinance No. 835 for
a period of eight months; and
WHEREAS, Ordinance No. 841 will expire on February 5, 1675; and
WHEREAS, the Planning Department and the Planning Commission
of the City of El Segundo have undertaken and are continuing with the study of
the conversion of existing apartment buildings into condominium ownership; and
WHEREAS, the Director of Planning has recommended to the City
Council that the prohibition contained in Ordinance No. 841 be extended for a
period of one year; and
WHEREAS, the City Council as authorized by Section 55858 of the
Government Code, desires to extend said urgency ordinance until February 5,
1976;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. The restrictions imposed by Ordinance No. 841
are hereby extended for a period of one year.
SECTION 2. Notwithstanding any other provision of the E1 Segundo
Municipal Code, no approval shall be issued for the conversion of an apartment
house into a condominium, except upon the following conditions:
1. An application for a Tentative Tract Map shall be filed
with the Director of Planning and plans submitted there-
with in accordance with the presently established pro-
cedures.
2. The plans shall be submitted to the Director of Planning
for a report thereon by the Director of Planning to the
Planning Commission.
3. The Planning Commission shall make such review of
the plans as it deems necessary; shall review the re-
port of the Director of Planning; and if it finds that said
proposed development is in accordance with the proposed
limitations, restrictions and recommendations of the City
of El Segundo and that such proposed development will
not be in conflict with the proposed zoning amendments or
land division amendments, the Planning Commission may
recommend to the City Council approval of the Tentative
Tract Map upon such conditions it deems necessary to
effect compliance with said report.
4. The City Council shall make such review of the plans it
deems necessary and shall review the report of the Direc-
tor of Planning and the action of the Planning Commission
and if it finds that said proposed development is in accordance
with the proposed limitations, restrictions and recommenda-
tions of the City of E1 Segundo and that such proposed develop-
ment will not be in conflict with the proposed zoning amend-
ments or land division amendments the City Council may
authorize the issuance of a building permit or may approve
the Tentative Tract Map upon such conditions as it deems
necessary to effect compliance with said report and said
proposed limitations, restrictions and recommendations
of the City of E1 Segundo.
SECTION 3. This interim zoning ordinance shall be of no further
force and effect on or after February 5, 1976.
SECTION 4. This ordinance is hereby declared to be an urgency
measure necessary for the immediate preservation of the public peace, health
and safety and shall take effect immediately upon its adoption, and the facts
constituting such urgency are as follows:

The restrictions imposed by Ordinance No. 841 will expire
on February 5, 1975, and it is urgently necessary that this
ordinance be effective before such restrictions expire in order
to preserve the restrictions during the entire period permitted
by Section 65858 of the Government Code of the State of
California in order to preserve the public health, safety and
general welfare.
SECTION 5. The City Clerk shall certify to the passage and adop-
tion of this ordinance; shall cause the same to be entered in the book of original
ordinances of said city; shall make a minute of the passage and adoption thereof
in the records of the meeting at which the same is passed and adopted; and
shall, within fifteen days after the passage and adoption thereof cause the
same to be published once in the E1 Segundo Herald, a weekly newspaper of
general circulation, published and circulated within the City of E1 Segundo,
and which is hereby designated for that purpose.
