ORDINANCE NO. 863
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING CHAPTER 5.08 OF THE
"EL SEGUNDO MUNICIPAL CODE" BY ADDING SEC-
TION 5. 08, 078 RELATING TO BUSINESS REGISTRA-
TION FEES FOR AMUSEMENT CENTERS.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. That Chapter 5. 08 of the "El Segundo Municipal
Code" is hereby amended by adding thereto Section 5. 08. 078 which said
Section shall read as follows:
"5.08. 078 AMUSEMENT CENTER. An amusement
center is defined as any place to which the public is admitted
or invited where eight or more coin or slug- operated amuse-
ment machines are maintained, operated or available for
operation.
'Any person operating an amusement center shall pay
a business registration fee of $200 per year.
"It is unlawful for any person to establish, maintain,
conduct, or keep open any amusement center as defined in
this section within the corporate limits of the city without first
having obtained a permit in writing from the Director of Finance.
In any application for an amusement center the Director of
Finance may require, in addition to other information, that the
applicant furnish the information necessary to enable the Chief
of Police to make an investigation of any prior criminal activity
of the applicant or any operator of the amusement center. It
"After an investigation by the Chief of Police the Director
of Finance shall approve the application for the Amusement Center
permit or renewal of such permit if he finds:
(1) A completed written application form therefor has been
filed; and
(2) The required application fee therefor has been paid to
the city treasurer; and
(3) As a result of his investigation all applicable provisions
of this section with regard to such permit application have been met;
and
(4) That the operation by the applicant will be carried on in
a building, structure and Location which complies with and meets all
of the health, zoning, fire, building and safety requirements and
standards of the laws of the State of California and this code applicable
to such business operation; and
(5) That the applicant, his employee, agent or any person con-
nected or associated with applicant as partner, director, officer, stock-
holder, associate or manager has not been convicted in a court of com-
petent jurisdiction by final judgment of an offense involving the main-
tenance of a nuisance in connection with the same or similar business
operation; and
(6) That the business is not a public nuisance or has not been
a public nuisance at any time within the Last five years; and
(7) That the applicant, his employ ee, agent, or any person con-
nected or associated with applicant as partner, director, officer, stock-
holder, associate, or manager has not knowingly made any false, mis-
Leading or fraudulent statement of a material fact in the application for
a permit, or in any report or record required to be filed with the Chief
of Police; and
(8) That the applicant has not had a similar type permit pre-
viously revoked for good cause within the past year unless the applicant
has shown a material change in circumstances since the date of revoca-
tion. "
SECTION 2. That this ordinance shall become effective at
midnight on the thirtieth day from and after the date of the final passage
and adoption thereof.
SECTION 3. That the City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in the book of
original ordinances of said city; shall make a minute of the passage and adopt -
tion thereof in the records of the meeting at which the same is passed and
adopted; and shall, within fifteen days after the passage and adoption thereof,
cause the same to be published once in the E1 Segundo Herald, a weekly news-
paper of general circulation, published and circulated within the City of El
Segundo, and which is hereby designated for that purpose.
