ORDINANCE 83547 47 ORDINANCE NO. 835 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROHIBITING THE CONVERSION OF EXISTING APARTMENT BUILDINGS INTO CON- DOMINIUM OWNERSHIP, EXCEPT UPON AUTHORI- ZATION OF THE CITY COUNCIL DURING A PERIOD OF STUDY OF CONDOMINIUM DEVELOPMENT AND SETTING A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING AN EXTENSION OF THIS ORDI- NANCE. WHEREAS, the City Planning Commission, to protect the public health, safety and welfare is considering a revision of the zoning regulations and subdivision regulations for the conversion of existing apartment buildings to condominiums within the City, and WHEREAS, at its meeting of January 24, 1974, the Planning Com- mission by motion made a recommendation that the City Council place a moratorium on the conversion of existing apartment buildings into condomin- ium ownership in order to enable the Planning Commission to conduct a study for the purpose of holding public hearings and making recommendations to the City Council relative thereto; and WHEREAS, Section 65858 of the Government Code of the State of California authorizes the adoption of an interim ordinance as an urgency mea- sure prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body, or Planning Commission or the Planning Department is considering, or studying, or intends to study within a reasonable period of time. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALI10 RNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Notwithstanding any other provision of the E1 Segundo Municipal Code, no approval shall be issued for the conversion of an apart- ment house into a condominium, except upon the following conditions: 1. An application for a Tentative Tract Map shall be filed with the Director of Planning and plans submitted there- with in accordance with the presently established pro- cedures. 2. The plans shall be submitted to the Director of Planning for a report thereon by the Director of Planning to the Planning Commission. r • 3. The Planning Commission shall make such review of the plans as it deems necessary; shall review the re- port of the Director of Planning; and if it finds that said proposed development is in accordance with the proposed limitations, restrictions and recommendations of the City of El Segundo and that such proposed development will not be in conflict with the proposed zoning amendments or land division amendments, the Planning Commission may recommend to the City Council approval of the Tentative Tract Map upon such conditions it deems necessary to effect compliance with said report. 4. The City Council shall make such review of the plans it deems necessary and shall review the report of the Direc- tor of Planning and the action of the Planning Commission and if it finds that said proposed development is in accordance with the proposed limitations, restrictions and recommenda- tions of the City of E1 Segundo and that such proposed develop- ment will not be in conflict with the proposed zoning amend- ments or land division amendments the City Council may authorize the issuance of a building permit or may approve the Tentative Tract Map upon such conditions as it deems necessary to effect compliance with said report and said proposed limitations, restrictions and recommendations of the City of E1 Segundo. SECTION 2. The provisions of this ordinance shall not apply to any condominium for which a valid building permit has been issued or for which there is an approved zone exception or land division as of the effective date of this ordinance. SECTION 3. This ordinance is declared to be an ordinance for the immediate protection of the public health, safety and general welfare. The facts constituting the urgency are as follows: There has been an increase in the requests for the conversion of apartment buildings to condominiums and the conversions will result in a lack of adequate off - street parking, visitor parking, structural amenities, noise pollution control, recrea- tional areas, and security devices for condominiums. SECTION 4. A public hearing shall be held before the City Council on Tuesday, April 2, 1974, beginning at the hour of 7:00 p. m. in the Council Chamber of the City Hall for the purpose of considering an extension of this ordinance for a period of eight months and the City Clerk is directed to give notice of such hearing in the time, form and manner required by law. SECTION 5. This ordinance shall take effect upon its adoption and shall continue in effect four months from the date of adoption hereof. SECTION 6. The City Clerk shall certify to the passage and adop- tion of this ordinance; shall cause the same to be entered in the book of original -2- ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof cause the same to be published once in the El Segundo Herald, a weekly news- paper of general circulation, published and circulated within the City of E1 Segundo, and which is hereby designated for that purpose.
