ORDINANCE 830ORDINANCE NO. 830 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 20 (THE COM- PREHENSIVE ZONING ORDINANCE) OF THE "EL SEGUNDO MUNICIPAL CODE" BY ADDING CHAPTERS 20. 21 AND 20. 88 RELATING TO PLANNED RESIDENTIAL DEVELOPMENT (PRD) ZONE AND PROCEDURE. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 20. 16. 010 and 20. 16. 020 of Title 20 (The Comprehensive Zoning Ordinance) of the "E1 Segundo Municipal Code ", are amended to read as follows: "20.16. 010 DESIGNATION OF ZONE NAMES. In order to classify, regulate, restrict and segregate the uses of lands and buildings, to regulate and restrict the height and bulk of buildings, to regulate the area of yards and other open spaces about buildings and to regulate the density of population, the classes of use zones are by this title established, to be known as follows: R-1 --- One Family Residential Zone. R -2 - -- Two Family Residential Zone. R -3 - -- Multiple Family Residential Zone. P - -- Automobile Parking Zone. C -1 - -- Service Commercial - Professional Zone. C -2 - -- General Commercial Zone. C -M - - - Commercial Manufacturing Zone. M -1 -- -Light Manufacturing Zone. M -2 - -- Heavy Manufacturing Zone. O -S --- Open Space Zone. P -F - - - Public Facilities Zone. PRD---Planned Residential Development Zone. " "20. 16. 020 DEGREE OF RESTRICTIVENESS. ' More restrictive uses' as employed in this Title means the following: (1) Those uses first permitted in the R -1 zone are the m -)st restrictive. (2) All other uses are less restrictive in the order they are first permitted in the zones in the sequence shown, R -2, R-3, P, C -1, C -2, C -M, M -1 and M -2. (3) The PRD zone is a zone established solely for the purpose of implementing a specific planned residential use and the planned residential use permitted in such zone shall be exclusive to that zone and such zone shall not be considered in the restrictive sequence set forth in Section 20. 16. 020 (2). (4) The O -S zone is established solely for the purpose of implementing an Open Space Plan and the open space use in such zone shall be exclusive to that zone and such zone shall not be considered in the respective sequence set forth in Section 20. 16. 020 (2). (5) The P -F zone is a zone established solely for the purpose of implementing the location of public facilities and the uses permitted "in such zone shall be exclusive to that zone and such zone shall not be considered in the respective sequence set forth in Section 20. 16. 020 (2). " SECTION 2. That Section 20. 16. 025 of Title 20 (The Com- prehensive Zoning Ordinance) of the "E1 Segundo Municipal Code ", is added to read as follows; "20. 16. 025 ADDITIONAL ZONES. In order to classify, regulate, restrict and segregate the uses of lands and buildings, to regulate and restrict the height and bulk of buildings, to regulate the area of yards and other open spaces about buildings and to regulate the density of population, three additional classes of use zones are by this title established, to be known as follows: PRD-- Planned Residential Development Zone. O -S -- Open Space Zone. P -F -- Public Facilities Zone. "The foregoing zones are separate zones and shall not be deemed to be more restrictive or less restrictive than any other zone but shall be limited to the uses permitted in the specified zone. it SECTION 3. That Chapter 20. 21 entitled "Planned Residential Development (PRD) Zone" is added to the "E1 Segundo Municipal Code" to read as follows: "CHAPTER 20.21 "PLANNED RESIDENTIAL DEVELOPMENT "(PRD) ZONE. "20. 21. 010 INTENT. The Planned Residential Development (PRD) zone is established to encourage the development of residential acreage under an overall development plan; to permit flexibility that will encourage creative design and innovations; preserve open space; improve vehicular circulation; off - street parking facilities; and, through placement of buildings, utilize the potential of the site characterized by special or unusual features of geography, topography, size or shape. It is further intended to encourage the redevelopment of old or blighted neighborhoods by providing incentives for higher quality residential housing and project design through land consol- idation. No PRD zone shall be less than two acres of contiguous land. "20. 21. 020 PERMITTED USES. Property in the PRD zone may be used for: (1) Any use permitted in the Residential -1 zone; when a use is developed pursuant to this paragraph, it shall be controlled by the requirements of Chapter 20. 20 of this Code and not by the requirements of this Chapter. (2) A planned residential development in accordance with the principal uses set forth in Section 20. 21. 030 of this Chapter if approval is obtained as provided in Chapter 20. 88. Approval shall be based upon findings by the Planning Commission and City Council that the plan provides for adequate light and air, public safety and convenience, protection of property values in the neighborhood and preservation of the general welfare of the community. "20. 21. 030 PRINCIPAL PERMITTED USES. The following principal uses shall be permitted in the PRD zone if the property -2- "is used as described in Section 20. 21. 020 (2): (1) Dwelling units in detached, semi - detached, attached buildings, single -story or multi- storied buildings or any combination thereof; (2) Nonresidential uses of a recreational character to the extent they are designed and intended to serve the residents of the planned residential development under consideration; (3) Nonresidential uses of a commercial character in proposed PRD zone developments of four or more contiguous acres which are principally intended to serve the residents of the planned residential development under consideration, provided that the total square footage involved does not exceed two percent of the total gross square footage of the site; (4) Any building, structure or use customarily incidental to the permitted use; (5) Parking structures and surface or subterranean parking lots when same are for the use of the planned residential development under consideration. 1120. 21. 040 PERMITTED ACCESSORY USES. When property is used for the principal uses enumerated in Section 20. 21. 030, accessory uses shall be permitted if they are approved in the PRD plan. "20. 21. 050 PROHIBITED USES. Industrial uses are expressly prohibited in the PRD zone. " SECTION 4. That Chapter 20. 88 entitled "Procedure for Approval of PRD Plan" is added to the "El Segundo Municipal Code" to read as follows: "CHAPTER 20.88 "PROCEDURE FOR APPROVAL OF PRD PLAN "20.88,010 PRD PLAN -- PERMITTED. An application for approval of a PRD plan shall only be accepted for property: (1) When already zoned PRD; or (2) When an application is on file for a change of zone to a PRD zone, 1120. 88. 020 PRD PLAN -- APPLICATION. The application for a PRD Plan shall be initiated by filing with the Director of Planning an application for approval of a PRD plan for the property for which the application is made. The application shall contain a preliminary development plan which shall include the following: (1) A preliminary PRD plan of the entire proposed development showing land uses, traffic circulation, streets, private roadways, pedestrian circulation, general location and approximate size of structures, utilization of structures including activities and the number of dwelling units; estimated population, proposed reservations and dedications for public uses including parks, playgrounds and open spaces; major landscaping features and environmental sketches generally establishing the scale, character and relationship of -3- 'buildings, streets and open spaces. All elements listed in this paragraph shall be characterized as existing or proposed and shall be shown with such detail as is necessary to indicate clearly the intent and impact of the development. (2) A tabulation of the land area to be devoted to various uses including open space, parking and a calculation of the over- all density of dwelling units per acre. (3) A statement describing the existing topography, soil conditions and drainage. (4) A statement proposing the method of maintaining per- petuating common open space areas and facilities. (5) Evidence that the applicant has sufficient control over the land to effectuate the proposed plan. (6) A tentative subdivision map, when required, which in- cludes the subdivision of air rights prepared in accordance with the provisions of Title 19 (Plats and Subdivisions) of this Code. (7) Engineering feasibility studies as necessary. (8) Tentative landscape plan showing general location of landscaping, fences, walls and irrigation systems. (9) Character, general design and location of signs, street lighting and street furniture. (10) Such other information as the Director of Planning shall require. "20. 88. 030 PRELIMINARY PRD PLAN -- SETTING HEARING- - PLANNING COMMISSION. Upon receipt of an application for approval of a preliminary PRD plan the Director of Planning shall set the matter for public hearing before the Planning Commission and shall give notice of such hearing in the same manner as zone changes are considered by the Planning Commission. "20.88.040 PRELIMINARY PRD PLAN -- PLANNING COMMISSION HEARING. The Planning Commission shall hold a public hearing on the application for approval of a preliminary PRD plan. Upon the conclusion of the hearing the Planning Commission shall recommend approval of the preliminary PRD plan to the City Council if it finds that the plan is a suitable plan for the development of the property. "20. 88. 050 PRELIMINARY PRD PLAN -- PLANNING COMMISSION APPROVAL -- DISAPPROVAL. Upon the approval or disapproval of the preliminary PRD plan the Planning Commission shall forward the plan to the City Council together with the Planning Commission's recommendation and shall transmit to the City Clerk the Planning Commission's complete file of the case. "20.88.060 PRELIMINARY PRD PLAN - -CITY COUNCIL HEARING. If the Planning Commission recommends approval of the preliminary PRD plan the City Council shall, and if the Planning Commission recommends disapproval of the preliminary PRD plan the City Council may, hold a public hearing on the application for approval of the plan. The City Clerk shall set the matter for public hearing and shall give notice of such hearing in the same manner as zone changes are considered by the City Council. "20.88.070 PRELIMINARY PRD PLAN - -CITY COUNCIL APPROVAL - DISAPPROVAL. Upon the conclusion of the hearing the City Council shall by resolution, approve, modify or disapprove the preliminary PRD plan. 'The City Clerk shall forward a certified copy of the resolution to the applicant, at the address shown on the application, so that the applicant may develop a final plan in accordance with the preliminary approval of said plan, and one copy of the resolution shall be attached to the file in the case and the complete file returned to the Planning Commission for permanent filing. "20. 88. 080 FINAL PRD PLAN WITHIN ONE YEAR. The applicant may thereafter, at any time within one year from such preliminary approval by the City Council, submit to the Planning Commission an application for the approval of the final development plan. it 20. 88. 090 FINAL PRD PLAN. The Final development of the plan shall include: (1) A plot plan of the subject property boundaries prepared by a registered Civil Engineer or licensed land surveyor including metes and bounds or legal description. (2) Building plans of all uses including floor plans, exterior elevations and typical sections. (3) Final landscape plan showing size, species and location of trees and plants indicating the location of a permanent irrigation system. (4) Description of design principles for buildings and street-- - scapes. (5) Plan of street improvements, water, sewerage, flood control, and drainage facilities and public utilities. (6) Such other matters as the Planning Commission may require. "20.88. 100 FINAL PRD PLAN--SETTING HEARING- - PLANNING COMMISSION. The Planning Commission shall consider the final plan and may after such consideration require amendments or modifications to such final plan and when the plan is in a form satis- factory to the Planning Commission the final plan shall be set for public hearing before the Planning Commission. The Director of Planning shall give notice of the planned residential development hearing on the approval of the final PRD plan in the time, form and manner required by law for zone changes. "20.88. 110 FINAL PRD PLAN -- PLANNING COMMISSION HEARING -- APPROVAL FINAL. The Planning Commission shall hold a public hearing and consider the final PRD plan and approve it if it finds it conforms to the approved preliminary plan and this Chapter and such approval shall be final. "20. 88.120 APPEAL -- PLANNING COMMISSION ACTION. Any person dissatisfied with the action of the Planning Commission on the final PRD plan, may file a written notice of appeal with the City Council; provided, however, that an appeal may not be filed after ten days have expired from the action of the Planning Commission. -5- SECTION 5. That Section 20. 90. 040 of Title 20 (The Com- prehensive Zoning Ordinance) of the "E1 Segundo Municipal Code ", is amended to read as follows: "Section 20. 90. 040 FILING FEES. The applicant shall, at the time of filing the application, pay to the city, the following fees to cover the cost of examining and processing the application: (1) Reclassification or amendment.... $100. 00 (2) Precise Plan .................... $100. 00 (3) PRD plan ....................... $100. 00 (4) Unclassified use permit.......... $ 50. 00 (5) Variance ....................... $100.00 (6) Conditional use permit........... $100. 00 (7) Adjustments ..................... $ 25. 00" SECTION 6. This ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 7. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo, and which is hereby designated for that purpose.
